That the compensation paid to the City for this easement shall be $5, 620.00 which is due and payable upon delivery of the deed for this easement. 2. That no tree removal will be permitted within the easement area. 3. That all disturbed areas will be restored by sodding and these areas will be maintained by the developer until the sod is fully established. 4. That the developer will be required to install a fence at least four feet in height along the entire length of their property line adjoining the park. 5 . That electric service to the park will be maintained in workinq order throughout the construction period. Any interruption of service necessitated or caused by the construction shall be im mediately restored such that night lighting of the park area is continuously maintained. 6. After conversations with the parties involved it is apparent that this work is necessary and can, with some modification, be constructed with minimum disturbance to the park. We have advised the developer, however, that because the construction involves installation of sewer lines and catch basins in addition to some minor grading, a permanent easement will have to be obtained, and that we would initiate this process by contacting your office. I have enclosed a copy of the developer's May 19, 1987 request for an easement 20 feet wide running parallel to the property line, plus a site plan illustrating the easement location and the work to be done. I request that you determine the amount of compensation due and prepare the necessary documents including a City Council Resolution approving the easement, and further request that the following provisions be included therein: 1 .
