WHEREAS, Twin Cities Housing Development Corporation is
developing the vacant property north and immediately adjacent to
IPeople's Park for an eighteen-unit townhouse development; and,
WHEREAS, a 20-foot grading and utility easement is needed
along the northwesterly line of People's Park to complete that
development; and,
WHEREAS, the Division of Parks who has jurisdiction over
this property has determined that the proposed use of this
easement does not interfere with the use of this 20-foot strip
for park purposes and has consented to this conveyance subject to
certain restrictions which are intended to prevent any such
interference; and
WHEREAS, the Division of Parks, who has jurisdiction over
this property, has consented to the conveyance of this easement
to Twin Cities Housing Development Corporation.
THEREFORE BE IT RESOLVED, that the proper City Officials are
hereby authorized to convey to Twin City Housing Development
Corporation a permanent easement for grading and utility purposes
on, over and across land described as follows:
A Perpetual Easement for Grading and IItility
purposes over, under and across that part of Park
1, CONCORD TERRACE PLAT NO. l, according to the
recorded plat thereof, Ramsey County, Minnesota;
said easement being 20.00 feet wide adjoining
Southeasterly of the Northwesterly line of said
Park l.

BE IT FURTHER RESOLVED, that the above described
easement shall be subject to the following conditions:
1. That the compensation paid to the City for this
easement shall be $5, 620.00 which is due and
payable upon delivery of the deed for this
easement.
2. That no tree removal will be permitted within the
easement area.
3. That all disturbed areas will be restored by
sodding and these areas will be maintained by the
developer until the sod is fully established.
4. That the developer will be required to install a
fence at least four feet in height along the entire
length of their property line adjoining the park.
5 . That electric service to the park will be
maintained in workinq order throughout the
construction period. Any interruption of service
necessitated or caused by the construction shall be
im mediately restored such that night lighting of
the park area is continuously maintained.
6. That the final site plan will require the written
approval of the Superintendent of Parks and
Recreation.

Dear Mr. Nelson:
� Last week we received site plan review documents from the Zoning Division
for the referenced project and discovered that the developer proposes to
construct storm water detention facilities on People's Park, which adjoins
the eastern edge of the housing site.
After conversations with the parties involved it is apparent that this work
is necessary and can, with some modification, be constructed with minimum
disturbance to the park.
We have advised the developer, however, that because the construction
involves installation of sewer lines and catch basins in addition to some
minor grading, a permanent easement will have to be obtained, and that we
would initiate this process by contacting your office.
I have enclosed a copy of the developer's May 19, 1987 request for an
easement 20 feet wide running parallel to the property line, plus a site
plan illustrating the easement location and the work to be done. I request
that you determine the amount of compensation due and prepare the necessary
documents including a City Council Resolution approving the easement, and
further request that the following provisions be included therein:
1 . No tree removal will be permitted.

Twin Cities Housing Developm2nt Corporation is finalizing their �
plans to acquire the vacanz property north of People ' s Park for
an eighteen unit townhouse development. In order for us io
obtain the required storm water detention in this area (sze
enclosed site grading plan) , we are requesting that the Parks
� Dept. provide an easement approximately 20 ' wide running east
and west along the property line for site grading and storm
water utilities . Our proposed storm water detention plan would
also benefit the park in that we would be controlling storm
water for a portion of the park as well as our adjoining
property. All work within the requested easement-would be
completed at no cost to the City of St. Paul and subject to
their review and approval.
We will be contacting you to arrange a meeting for alI concerned
parties after you have had t:me to review our proposal within
your department.
