The Com- mission' s approval is expressed in the letter from its Chairperson to Bruce Hutchins of the College and dated January 23, 1987. The letter contains three conditions: 1) that a performance bond or irrevocable letter of credit in the amount of $100,000 be submitted to guarantee completion of landscaping, stormwater management facilities and other required improvements; 2) that landscaping be installed as per "Phase I planting plan" ; and 3) that stormwater management facilities be constructed in accordance wtih plans approved by the Public Works Sewer Engineer; and WHEREAS, Jean M. Kummerow, 823 Portland Avenue, Saint Paul , Minnesota duly filed an appeal to the City Council from this decision of the Planning Commission contending that the site plan approved by the Commission was a new site plan from that approved previously by the Commission and that this plan does not meet several conditions required by the Zoning Code for the preservation of historically significant characteristics of the city and the protection of neighboring properties; and WHEREAS , Acting pursuant to the provisi.ons of the Legislative Code and upon due notice to all affected parties , a public hearing tiTas conducted by the City Council on April 9, 1987, for the purpose of considering this appeal and at which hearing the Council heard from all persons who wished to present testi- mony; and . WHEREAS, the Mayor met with both College and neighborhood � represzntatives on April 27, 1987 and asked them to consider a compromise plan with a smaller parking lot and a larger setback from Summit Avenue ; and WHEREAS , On May 7 , 1987 the Council passed a resolution py a vote of 4 to 3 to approve the library, deny the parking lot along Summit Avenue, and grant a parking variance for existing � parking spaces that will be displaced by the library. However, . onr%lay 1?_, 1987 the City Council voted to reconsider the reso- . lution and to reopen the public hearing on May 26, 1987 to receive testimony regarding a compromise plan with a smaller parking lot and a larger setback from Summit Avenue; and 2. . � ��_ ��s WHEREAS , the College administration and the Executive Committee of the Board of Trustees indicated their willingness to agree to a compromise that reduces the parking lot to approxi- mately 140 spaces and increases the Summit Avenue setback to a minimum of 100 feet, and directed their architect to prepare such a plan for the public hearing on May 26 , 1987 , which is herein referred to as Plan D; and WHEREAS, the Office of the City Rttorney sent the Mayor a letter on March 24, 1987 advising him that "William Mitchell College of Law may legally use its property for off-street parking purposes as that is a permitted use under the C.�,t��� zoning ordinances" ; and WyEREAS , the Summit Avenue Plan, which is a chapter of the Comprehensive Plan, recommends that the City "grant permits allowing (the) William Mitchell parking lot. The City should require extraordinary setbacks and landscaping, but should then approve the large parking lot proposed by William Mitchell . . . . the proposed lot is both a practical solution to an area parking problem and fully within the legal rights of the college. " WHEREAS , the Grand Avenue Parking Study documents that William Mitchell has an actual parking shortage of 150 spaces or more on three evenings a week, and Plan D provides a net increase in on-campus parking of approximately 70 spaces ; and WHEREAS , the Council , having heard the testimony at both public hearings , and having considered the actions of the Planning Commission, the report of the staff, and all the documents presented at the hearings, does hereby RESOLVE , that the Council of the City of Saint Paul does hereby find and determine : (1 ) That the Planning Commission was correct in considering the December 22 , 1986 plan as a revision of Plan B which it had approved on March 28 , 1986, rather than considering it a new plan, since the revisions were caused by the Council ' s denial of a variance requested for the library and by the College ' s attempt to reduce the impact of the parking lot on Summit Avenue ; 3 . . . . � ��- �,ss (2) That Ms . Kummerow' s appeal on the grounds of preservation of historically significant characteristics of the city and protection of neighboring properties should be considered as timely because the action of the Planning Commission to approve either Plan A or Plan B subject to revisions was confusing to citizens and because City staff told the neighbors they could wait and appealthe revised plan; ( 3) That the Planning Commission committed an error when it found that a 45-foot setback was sufficient green space to protect the historically significant character of this section of Summit Avenue from the aesthetic intrusion of a parking lot ; (4) That Plan D, dated may 22, 1987 , is approved and shows (a) the library; (b) a Summit Avenue parking lot for approxi- mately 140 cars ; (c) the parking lot set back 100 feet from Summit Avenue ; and (d) all the essential landscape features of Plan C including a berm, a depressed lot, planting islands in the lot, a hedge and evergreen trees screening the lot; (5) That the details of Plan C of December 22 , 1986 , such as the landscaping and lighting of the front walk to Summit Avenue are approved, except where they are specifically modified by Plan D, and also that the requirements of the Planning Commission chairperson' s letter of January 23, 1987 to Bruce Hutchins of the College (covering perform- ance bonding, landscaping for Phase I and Phase II , and stormwater facilities ) are also approved except as specifi- cally modified by Plan D; and, be it, 4. Since that meeting the neighbors have made some revisons to the plan. I was asked to do a preliminary review of this plan. I have reviewed the plan and compared it to the earlier compromise plan submitted by Planning staff. The neighborhood plan is acceptable from a functional stand point (i.e. , traffic and sewer) if the driveway is relocated and a setback variance is granted for parking along Portland Avenue. In terms of aesthetics the neighborhood plan has an initial advantage because it saves more mature trees and green space. However, in the long term the Planning staff plan is superior in terms of unifying the site with a formal design and how the parking lot relates to the buildings. SITE FUNCTION l. The neighborhood plan provides 173 parking spaces comuared to 199 for the staff vlan. in the neighborhood plan 89 cars would use the lot on Summit and 84 cars would use an expanded version of the existing lot on Portland. In the staff plan 144 cars would use the Summit lot and 55 would use the Portland lot. 2. The neighborhood plan meets City standards for traffic safetv if the driveway to Victoria is moved further south so it is not so close to Portland Avenue The staff vlan is acceptable for traffic safetv. The neighborhood plan would decrease the number of cars exiting from the Summit - lot onto Victoria by 55 and provide a stacking lane for cars waiting to exit the main lot onto Victoria. 3. Both plans can meet stormwater mana�ment reQUirements. 4. The nei�hborhood plan would recLuire a zoning variance for setback. Dr. Michael Chopek af 833 Portland presented to us a compromise plan that members of our committee thought was the best plan we'd �een yet. We support this plan and voted full approval. Chopek's plan was particularly sensitive to the need for retaining as many mature trees as passible while keeping the appearance of a large lawn. His plan included a 130 ft. setback on Summit Avenue and � a 120 ft. setback on Victaria. It would provide 103 parking spaces in the new lat and 83 sgaces in the existing lot - a total of 186 spaces. There has been very little discussian of landscaping in all of the proposals we've seen. We believe whatever lot plan is finally approved, that landscapin� is an extremely important factor. i�Te urge the Cauncil to require a �unken lot that would be screened by both berm� and shrubbery. Many of ths proposals rely on mature trees for �creening, but trees grow very slawly. We encourage the Council to carefully consider Dr. Chopek's plan because it seems ta offer the best options. It recognizes that the trees in place are worth protectin� as much as the lawn area. Thank you for your careful consideration of this problem. T,��i - CITY OF SAINT PAUL INTERDEPARTMENTAL MEMORANDUM DATE: May 12, 1987 T0: Members of the City Council FROM: Larry Soderholm �� V SUBJECT: William Mitchell Parking Lot I have drawn up the attached site plan as a compromise proposal for the William Mitchell parking lot. Compromise Proposal: Bigger Setback. Smaller Lot 1. Retain the basic design approved by the Planning Commission but eliminate the double-loaded parking bay closest to Summit Avenue. 2. The size of the lot drops from 181 spaces to about 140 spaces. 3. The Summit Avenue setback increases from 45 feet to 102 feet. Ar�uments for This Compromise l. The 4-3 vote at the City Council is a fair indication of how people in the city feel -- they wish another large lot on Summit Avenue wasn't necessary, but many acknowledge that it is necessary and/or legal. People have worked sincerely on this issue for a long time and are unable to reach a genuine compromise that the factions agree on. What I am proposing �ust splits the difference. Each side gets half a loaf. 2. The integrity and rationality of William Mitchell's campus master plan remain intact. Form and function still fit together. 3. I believe and have confidence that a lot set back 100 feet or more will be aesthetically acceptable to a large majority of people. The existing lot on the Milton side with its "suburban" berm is 105 feet from the Summit Avenue sidewalk. 4. No parking variance is granted for the 69 spaces lost when the library is built. This makes it easier for the City to deal with St. Thomas because the City continues ahead with a consistent policy of trying to reduce parking spillover by colleges into neighborhoods. � , �- ���.�s-- a City Councilmembers May 12, 1987 Page T�ao 5. The Summit Avenue Assembly of God church is taken care of, reducing the risk that more Portland Avenue houses will be demolished for parking. (To provide parking for their new sanctuary, the Summit Avenue Assembly of God was required by the Board of Zoning Appeals to arrange to share 109 parking spaces on the William Mitchell campus.) 6. The college's alternative design -- an architectural tragedy -- is averted. They told me they're considering swinging the Burger Library around 180 degrees to stand in front of the beautiful, historic Our Lady of Peace Building. While they don't like this alternative aesthetically, they think that, as a practical matter, this alternative would: (a) save 69 precious parking spaces in the existing lot; (b) give them use of the front lawn area; and (c) make use of their library design, built as a mirror image of the present design. 7.
