RESOLVED, that Council Resolution, C .F. 87-591 , adopted
April 30, 1987 , is hereby amended to read as follows :
RESOLVED, That as the sole condition to receiving a variance
from the provisions of State Aid Rules Section 88�A.-99��; 8820.9919,
the Council of the City of Saint Paul does hereby agree to indemnify,
save , and hold harmless the State of Minnesota and all of its
agents and employees of and from any and all claims , demands ,
actions or causes of actions of any nature or character arising
out of or by reason of, in any manner, the bituminous overlay
project on SIXTH STREET from Hope Street to Cypress Street,
in any other manner than as a 46 foot wide curb to curb street
and a design speed of 30 miles per hour, in accordance with
the Minnesota Rules Section 88�A.-�3A9; 8820. 9919, and further
agrees to defend at trieir sole cos� and expense any action
or proceeding commenced for the purpose of asserting any claim
of whatsoever character arising as a result of the granting
of this variance.
