RESOLVED, that upon the petition of Estelle and Donald Sell,
per File No. 8-1987 , that part of Goodrich Avenue from Highway
35E designated by Minnesota Department of Transportation as S.P.
6280 (35E = 390) 94 to 430 feet west and bounded by Lincoln,
Grand and Crocus hereinafter described be and the same is hereby
vacated and discontinued as public right-of-way.
That the vacated area be described as follows:
All that part of Goodrich Avenue lying easterly
of the Southerly extension of the Easterly line
of the West 10.0 feet of Lot 5, Block 6, Terrace
Park Addition and Northwesterly of the
Northwesterly right-of-way line of Interstate
Highway No. 35E, except that part of Goodrich
Avenue as described above previously vacated by
Council Resolution No. 155167, recorded October
31, 1951 as Document No. 1268924 , Ramsey County,
Minnesota.
1. That the vacation be subject to all the terms
and conditions of Chapter 130, codified March 1,
1981 of the St. Paul Legislative Code , as
amended.
2. That there shall be no right of access from
vacated Goodrich, as described above, to Trunk
Highway 35E designated by Minnesota Department of
Transportation as S.P. 6280 (35E = 390) 94.
3 . That the petitioner shall pay $ 5 , 580 .00 as
compensation for this vacation which is due and
payable within 60 days of publication of this
resolution.

4. That the petitioner, its successors or assigns,
by acceptance of the terms and conditions of
this vacation, agrees to indemnify, defend and
save harmless the City of Saint Paul , its
officers and employees from all suits, actions
or claims of any character brought as a result
of injuries or damages received or sustained by
any person, persons, or property on account of
this vacation, including but not limited to a
claim brought because of any act of omission,
neglect or misconduct of said petitioner or
because of any claims or liability arising from
any violation of any law or regulation made in
accordance with the law whether by the
petitioner or any of its agents or employees.
5. That the petitioner shall within 60 days of the
publication date of this resolution file with
the City Clerk an acceptance in writing of the
conditions of this resolution and shall within
the period (s) specified in the terms and
conditions of this resolution comply in all
respects with these terms and conditions.
