An Ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Donald R. Robinson duly petitioned to rezone 735 South
Robert Street, located on the northwest corner at Sidney Street, from RT-1 to
B-3, later amended to OS-1, for the purpose of establishing a real estate
office; the petition having been certified by the Planning Division on March
19, 198_7 as having been consented to by at least two-thirds of the owners of
the area of the property to be rezoned, and further having been consented to
by at least 67X of the owners of the property situated within 100 feet of the
total contiguous property within one year preceding the date of the petition;
and
WNEREAS, The Zoning Committee on April 16, 1987 conducted a public hearing for
the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition for B-3 be denied; and
WHEREAS, The Planning Corr�nission considered the rezoning petition at its
meeting held on April 24,1987 and recommended that the City Council deny the
B-3 petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
May 2, 1987 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought
to be rezoned; and

A. PURPOSE : To consider the approval of a Registered Land Survey for
property located at the old NSP Island Power Plant . This property is
unplatted and the R . L. S . is needed for recording purposes .
B . SITE & AREA CONDITIONS : This property is now located in the
Floodway, Flood Fringe , Urban Diversified River Corridor Overlay
Zoning District . The proposed Floodway 40 Acre Study zoning study
recommends that most of the property be in the Flood Fringe District .
It is surrounded by the Mississippi River and Shepard Road. There is
an existing building on this site that used to be an old power plant .
There are scattered trees and underbrush on site . This is a landlock
parcel .
C . REOUIRED FINDINGS :
1 . All the applicable provisions of the Legislative Code are
complied with .
2 . The proposed subdivision will not be detrimental to the present
and potential surrounding land uses .
The surrounding land uses are heavy industrial .
3 . The area surrounding the subdivision can be planned and
developed in coordination and compatibility with the proposed
subdivision.
The surrounding area is NSP land and is undeveloped.
4 . The subdivision is in conformance with the Comprehensive Plan.
The River Corridor Plan proposes open space for the site with
adaptive commercial reuse of the existing building .
5 . The subdivision preserves and incorporates the site ' s important
existing natural features , whenever possible .
No development has been proposed at this time .
, 6 . All land intended for building sites can be used safely without
endangering the residents by peril from floods , erosion,
continuously high water table , severe soil conditions or other
menace .
This site is in the Mississippi River Corridor Floodway . Any
proposed development must meet all River Corridor Overlay Zoning
requirements .
7 . The subdivision can be economically served with public
facilities and services .
This site has no water services at this time .

WHEREAS, A public hearing before the City Council , having been conducted on
May 14, 1987 where all interested persons were heard and where the petitioner
stated his desi�e to amend the petition, to OS-1, and the Council having
considered all the facts and recommendations concerning the petition; and
WHEREAS; , the City Council requested that a new site plan be submitted by the
petitioner to the Planning Division and to the West Side Citizens Organization
which indicates a new rear parking lot configuration with four off-street
spaces; now therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 37, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 735 South Robert, being more particularly
described as Lots 9, 10 and the south 10' of Lot 8, Paul Martin's
Rearrangement of Block 144 be and is hereby rezoned from RT-1 to
OS-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

the public hearing, the Committee voted 6 to 2 to recommend denial of a B-3
rezoning.
On April 24, 1987, the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on May 14, 1987.

This is to noti�y all interested parties that the WSCO Building
and Land Use Committee has recently acted to recommend approval for the
rezoning request pending for 735 S. Robert from RT-1 to B-3. The committee
was acting on referral of the matter from the full WSCO Board at their March
9 meeting. At the committee meeting on March 11 , staff presented the packet
of information in their hands and then had Mr. Klinger present his plans in
detail , including architect ' s drawings . The committee was well satisfied
with the thoroughness of Mr . Klingers responses , recognizing that while
late, was all in order beyond any doubts . Tt was because of the late
notice that the full Board had referred it to committee rather than set a
precedent allowing for a change in a strongly participative process .by rul-
ing on an item that had not gone through committee review.
The committee did review his plans for improving the corner and
the traffic flow, along with his intentions for the future . They came to
recognize Mr. Klinger' s professionalism and his good intentions to help the
community, and acknowledging the trends along Robert Street as a major
thoroughfare, then passed unanimously their recommendation to the WSCO
Board for approval of the rezoning request . This action will permit Mr.
Klinger to set up his Real Estate office along with a �eneral Contracting
office w�hout storage on site. The WSCO Board will be meeting on Apri,l 13
to review the recommendation , and I will be advisiing interested parties
again at that time of the Board action.

At the April IIoard meeting of the West Side Citizens Organization,
the WSCO Board approv.ed .the rezoning.�ofl 735 South Roliert� hut rather than
rezoning from its present RM-�1 to the reque,sted B�3, the Board approved
a rezoning to OS-1 , allowing for whatever non-conforming use permits might
be deemed necessary for Mr. Klinger to conduct business � as he had planned.
The B.oard ,took this action based on their desire to maintain some
control over the �evel o£ commercial development along Rohert Street , where
there is still a mix of residential and business zoning. The Board did,
however, want to help Mr. Klinger, who has shown good faith and has
developed some plans that are viewed as improvir�g the area.

Septemb�r 30th, 1986 to a youny man named Donald Robinson. Lesc than tcao
�aeeks after the sale, we received word from former neighbors that the house
�aas taken over by a man named Klinger who turned our old house into a Real
Estate office. Our home of twenty-two years is located on the corner of South
Robert Street and Sydney.
Now, in 11pri1, c.e ur� gettin� ca]1s from back there--pre�Pnt olc.c�r
neighbors still living in this neighborhoo�3, that he, Mr. Klinger, has
applied for and is attempting to change the Zoning of this blocic to incor�r-
ate a cabinet making business in the basement; a construction Company from
this residence; and about nine�rl;iny placs, to the rear and si.de of this
residential home.
We understand from received letters and pt��ne calls, that the neighk�or-
hood/neighbor� on Su�ath Rok��rt Street object very much to him doinc� some-
thing lilce this.
Now, I don't lcnow if this letter will do much to help their cause, btzt
they callecl us--lon� distancP--out here in Denver, Colorado (where �ve moved
from South Ro�ert :�treet) after living there for some twenty-two years. I
realize the are busines�es both up and down South Robert Street, but not in
this particular blocic--700 blo�:k--and have been for years. But these r,00d
pe<�ple, who have lived in this particular block for many, many years, are
trying to l:eep this residential neighborhood from being turned into more
business places. When tli�y took the time to call us out here, they are plead-
ing a desperate czu;�. These people have lived there for many, many years
and would li]ce t� lcec�p it just a residential place to live. I certainly hope

Iflinger--supposedly Mr. Klinger Sr.s son--with the older Mr. Klinger's
name not mentioned on the papenrork. Who knows what his future plans
are for this property?

presently living in St. Paul anymore, but, as mentioned in the al�ove letter
the entire neighborhood is totally upset with the manner of business siag-
yested.

A. PURPOSE: To permit the establishment of a real estate office and contractor's
shop.
B. SUFFICIENCY: The petition was declared sufficient by the Planning Division on
March 19, 1987; 14 parcels eligible, 10 parcels required, 12 parcels signed.
C. PARCEL SIZE: The parcel has 60' on So. Robert and 140' on Sidney for a total
lot area of 8,400 square feet.
D. EXISTING LAND USE: The property is now used as a real estate office with a
dwelling unit on the second floor;a small, detached one-car garage faces the
alley.
E. SURROUNDING LAND USE AND ZONING DISTRICT:
North: One and two family residential, RT-1 i�
East: Residential and commercial, RT-1 and B-1
South: Commercial, B-3
West: One and two family residential, RT-1
E. ZONING HISTORY: Prior to 1975 this parcel was zoned commercial.
F. FINDINGS:
1. The applicant proposes converting the residential dwelling into a commercial
establishment for a real estate office and contractor's (remodeling) shops.
2. The applicant has stated that the building would contain no dwelling unit, would

3. Permitted uses in the B-3 zoning district include all OS-1 through B-2 uses,
mortuaries, manufacturing of small precision goods, car washes, auto repair, new
and used car sales and fast food restaurants. Contractor's shops are first
permitted in the B-2 zone.
4. The applicant's property is one lot, 8,400 square feet in area, with only 1000'
square feet of usable floor area in the structure. It does not seem likely that
an actual shop area as well as office area can be accommodated in a building of
this size. A more likely scenario would be that offices for both real estate
and contractor's work would be situated in the building. This type of activity
could be accommodated in the OS-1 zoning district.

5. The parcel is a corner lot on a minor arterial and in an area where four streets
converge. Within one block from the parcel are found four other business
districts--OS-1, B-1, B-2 and B-3. To the immediate north of the parcel and on
the same block are exclusive one and two family residential uses however. To
introduce an intensive commercial zone such as B-3 to an exclusive residential
block is inappropriate. A rezoning to OS-1 would accommodate the proposed uses
and would provide a reasonable transition from the B-3 use located to the south
and the residential uses to the north of this parcel.
6. The City's land use component of the Comprehensive Plan states as policy 4.2-1
that "the City will support a diverse commercial activity base by working with
business and community groups to. . .continue efforts to encourage small
business." Policy 4.2-5 states that the City will "review its present . . .zoning
to ensure that each zoning classification reflects uses appropriate to the
intended application of the district."
7. The District 3 plan recommends a mix of residential and commercial uses along
Robert Street " in order to reinforce neighborhood-based commercial
development."
G. STAFF RECOMMENDATION:
Based on staff findings 1 through 7, staff recommends rezoning 735 South Robert
from RT-1 to OS-1 to permit the establishment of real estate and contractor's
offices.

My husband and I wish to voice our ob�ection to the rezoning of tot
8,9,10 of block 144 from RT-1 to OS-1. We have not been contacted by said
petitioner or by Mr. Klinger, who is now occupying said address, concerninq
the issue.
The building at 735 S. Robert St. is extremely small and we cannot see how it
will accomadate said businesses within environmental codes. Also, the porposed
9 car parking lot leaves us concerned as we have two small children. Their
safety will be further compromised by traffic on three sides of our lot located
at the opposite end of s�id block 144.
We feel strongly too, that 'Mr. Klinger has misrepresented the issues involved
, and has blantly done his imQrovements without regard to �roper city procedure
or to neighborhood attitudes.
We feel that the rezoning tQ anythiRg other than RT-1 will lower the
market value of our home, raise property valuethus raising our taxes. ���
are against this. This is-a_multi-generation neighborhood with pride in their
hanes and hertiage. Our children are the fifth generation to live in our
home. We would like it to remain that way. For these reasons we are opposed to
rezoning now or at anytime in the future.

This property has a sixtq-foot lot with a small one-family dwelling and
garage on it. The previous owners, Mr. and �Irs. Emil Kleidon, are appalled
at what is happening to their property because they thought they sold their
home to a bachelor for his residence; Re: Donald R. Robinson Application for
Rezoning. (Mr. Klinger represented Mr. Robinson at the closing, even thaugh
Coldwell Banker was the listing realtor).
The Zaning Committee �Ieeting on April 6, 1987, was full of false statenents
by Mr. Gerald Klinger. It was stated Mr. Klinger bought the above-referenced
property without knowing the zoning status. Mr, Klinger, a realtar for more
than two decades, stated that he did not find out it was zoned residemtal
until he went to get a permit for his oversized realty company sign. I
personally called the Building Department once the sign was up and was told
no application had been made.
�[r, Klinger responded to a question at the meeting as to whether he owned
other property in the area. He said one son owns property one block south
at Curtice and South Robert Streets. A second son owns the duplex located
at ?25 South Robert Street (right next door to the Sub,�ect Property). Also,
one of the two sons owns property at 84 East Sidney Street Cacross the
street from the Sub�ect Property>, Plus, Mr. Klinger purchasing the Sub,�ect
Property.
Xr. Klinger did not contact everyone within 350 feet of the Sub�ect Property
as stated in t�e Zoning Committee's Public Hearing Notice, mailed April 3,
