4. Granting the requested variance will not impair an adequate supply of light
and air to adjacent property, nor will it alter the essential character of
the surrounding area or unreasonably diminish established property values
within the surrounding area; and
5. The variance, if granted, will not permit any use of the land that is
inconsistent with the provisions of the Zoning Code; and
6. The owners request for this variance is not based primarily on a desire to
increase the value of income potential of the parcels of land; and
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves
this lot split for property situated at 1304 Desoto Ave. legally described as
Lots 31, 32, 33, Block 3, Stone's & Morton's Addition with the following
variances:
Lot 31: Reduce lot area from 5000 square feet to 4800 square feet.
Lot 32: Reduce lot area from 5000 square feet to 4800 square feet.
Lot 33: Reduce lot area from 5000 square feet to 4800 squa�e feet.

B . ZONING CODE CITATION 62 . 102 SUB 2 • If three or more lots or
combination of lots and portions of lots with continuous street
frontage in single ownership are of record on the effective date of
, this code or amendments thereof , and if all or part' of the lots do
not meet the requirements for lot width and area as established by
, this code , the lands involved shall be considered to be an
undivided parcel for the purpose of this code , and no portion of
said parcel shall be used or occupied which does not meet lot width
; requirements established by this code , nor shall any division of
the parcel be made which leaves remaining any lot with width or
area below the requirements stated in this code .
C . SITE & AREA CONDITIONS : The site is flat with a single family home
on the middle lot . There is also a detached garage on the middle
lot that encroaches slightly onto the lot to the north .

foot lots out a possible 29 .
