WHEREAS , the Council of the City of Saint Paul, by Council
Resolution C.F. 87-35, approved January 15, 1987, did vacate
certain public right--of-way in the City of Saint Paul which is
more particularly described as follows:
Except the southwesterly 20 feet; all that part of
Pine Street lying southeasterly of the
southwesterly extension of the centerline of the
alley in Block 62 and northwesterly of Rellogg
Blvd. , in Kittson's Addition to Saint Paul, and
all of the easement in the land necessary for the
slopes , cuts and fills, including the right of
removal of lateral support from subject land or
remainder thereof occasioned by excavation thereof
or construction of slopes in the grading of said
rights-of-way lying within or adjacent to said
vacated area described above.
WHEREAS, the Council of the City of Saint Paul by Board File
16966, approved February 29, 1903, did vacate certain public
right-of-way in the City of Saint Paul which is more particularly
described as follows:
The westerly 20 feet of Pine Street from the
southerly boundary of Prince Street to the
northerly boundary of East Third Street.
WHEREAS, Based upon utility easement Certificates of
Intended Non-Use filed voluntarily on behalf of Northern States
Power Company, the Department of Public Works, the Water Utility,
Western Union, District Energy St. Paul , Inc., Continental
Cablevision and Northwestern Bell Telephone and made a part

Clerk of Saint Paul, the City for itself and on behalf of these
corporations and departments waives the right to utility
easements in the vacated areas as described in the Certificates
of Intended Non-Use.
NOW THEREFORE BE IT RESOLVED, pursuant to Section 130.06 of
the Saint Paul Legislative Code and on behalf of the City of
Saint Paul and those persons for whom the City has reserved
easements, the Council of the City of Saint Paul does hereby
waive and release the retained utility easements in the vacated
public property as specified in the Certificates of Intended Non-
Use; and
BE IT FURTHER RESOLVED , That upon passage of this
resolution, the City Clerk is hereby authorized and directed to
file a copy of this resolution with the Registrar of Titles and
to record a copy of this resolution in the Office of the County
Recorder of Ramsey County, Minneaota and shall maintain a copy of
all certificates of Intended Non-Use referenced in this
resolution on file in the Office of the City Clerk .

the State of Minnesota from any claims, demands and
actions as a condition of granting a variance to the State
from State Standards for the SIXTH STREET PROJECT from
Hope to Cypress.
AND
10. RESOLUTION: Agreement to indemnify, save and hold harmless
the State of Minnesota from any claims, demands and
actions as a condition of granting a variance to the State
from State Standards for the LEXINGTON PARKWAY PROJECT.
These two items have already been acted on at City
Council .
