An Ordinance amending Chapter 60 of the Saint Paul Legislative
Code pertaining to zoning for the City of Saint Paul and zoning
maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Mc Donald's Corporation duly petitioned to rezone 229,
�231 and 233 Aurora Avenue located on the northwest corner at Marion
Street from RT-2 to P-1 for the purpose of expanding a surface parking
lot; the petition having been certified by the Planning Division on
March 2, 1987 as having been consented to by at least two-thirds of the
owners of the area of the property to be rezoned, and further having
been consented to by at least 67% of the owners of the property situated
within 100 feet of the total contiguous property within one year
preceding the date of the petition; and
WHEREAS, The Zoning Committee on April 2, 1987 conducted a public
hearing for the purpose of considering the rezoning petition, and
pursuant to Section 107.03 of the Administrative Code, submitted its
recommendation to the Planning Commission that the petition be granted;
and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on April 10, 1987 and recommended that the City Council
approve the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the
City on April 18, 1987 and notices were duly mailed to each owner of
affected property and property situated wholly or partly within 350 feet
of the property sought to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
April 30, 1987 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 20, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 229, 231 and 233 Aurora Avenue, being
more particularly described as Lots 18, 19 and 20, Block 2,
Florence Addition, be and is hereby rezoned from RT-2 to P-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

Dear Sir:
On April 2, 1987 the Zoning Committee of the Planning Commission held a public.
hearing on this rezoning. The petitioner testified. At the close of the
public hearing, the Committee voted 7 to 0 to approve the rezoning based on
staff findings.
On April 10, 1987 the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on April 30, 1987.

WHEREAS, McDonald's Corporation, file it10085, has petitioned to rezone 229, 231, 233
Aurora Ave. situated on the northwest corner at Marion St. from RT-2 to P-1 for the
purpose of establishing a surface parking lot; and
WHEREAS, the Zoning Committee of the Planning Commission on April 2� 1987 held a
public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
2oning Committee at the public hearing as subsequently reflected in the minutes,
made the following findings of fact:
1. The applicant intends to expand the existing nonconforming parking lot which is
on the corner of Aurora and Marion Streets; this lot contains 10 parking spaces.
A new lot would be created with all three parcels and would contain 30 spaces.
The applicant's site plan indicates that access would be on Aurora Street and
from the alley to the rear of the lot; this location for access is similar to
the current access of the existing parking lot.
2. The applicant's landscape plan indicates a 4'6" redwood obscuring fence at the .
west property line; landscaping materials would be provided at the entrance to
the lot from Aurora. The existing duplex to the west of the applicant's parcel
has a sidewalk which runs along the east property line and is actually on the
applicant's property. The site plan indicates that sidewalk will be retained to
the west of the wood obscuring fence. The P-1 zoning district would require that
the residential front yard setback on Aurora Street be maintained across the
parking lot.
3. The existing McDonald's to the north has approximately 5,500 square feet of
usable floor area and provides 45 parking spaces; code requirements for off-
street parking for restaurants are one for every 100 square feet of usable floor
area or 55 spaces in this case.
4. The P-1 parking district is intended to permit the establishment of off-street
parking facilities to be used solely for off-street parking of private passenger
vehicles as a use incidental to a principal use. The applicant's petition is
for incidental parking.

NOW, THEREFORE, BE IT RESOLVED� by the Saint Paul Planning Commission that the
petition of McDonald's Corporation to rezone property at 229, 231, and 233 Aurora
Avenue more particularly described as Lots 18� 19 and 20, Block 2, Florence Addition
from a RT-2 zoning classification to P-1 zoning classification is consistent with
the Comprehensive Plan for the City; and
BE IT FURTHER RESOLVED, that the Saint Paul Planning Couunission does hereby
recommend to the Council of the City of Saint Paul that property located at 229,
231� and 233 Aurora Avenue be rezoned from RT-2 to P-1 in accordance with the
petition for rezoning on file with the Saint Paul Planning Division.

The meeting was chaired by Gladys Morton, Chairman.
MC DONALD'S CORPORATION (#10085) : A Rezoning for property located at 229,231,
233 Aurora Ave. to allow the establishment of a surface parking lot.
Ms. Datsko showed slides, reviewed the history of the site and the staff
report. She stated that District Council 8 sent a letter recommending denial.
The applicant was present. There was no opposition present.
Jeffrey Cook, McDonald's Corporation representative, stated that they met with
residents living within 100 feet of the proposed parking lot and have
incorporated the neighbors' suggestions into the plan. He said he was
unaware of the letter sent by the District Council.
Ms. Datsko read the letter, dated March 30� 1987, from the District Council
which stated that the district reviewed their original approval and changed
their position to recommend denial of the rezoning.
Mr. Christenson questioned the separation of the parking lot and the alley and
asked how that area would be defined.
Richard Engstrom, McDonald's Corporation representative, showed a site plan,
described various areas and how they would be defined by landscaping, concrete
medians, etc.
Mr. Soderholm stated that the planners would check with the traffic engineer
at the time of the site plan review and would also check for appropriate
landscaping.
Ms. Zieman asked if the lot would be used for employee parking. Mr. Engstrom
stated yes� that it would be a dual use lot and that the west end would be for
employees.

Joseph Buckhalton, District 8 Council board member, stated that the biggest
misunderstanding centered around the moving and demolishment of the house at
231 Aurora. The District Council was given 30 days to move the house and the
Council was not set up to act on the proposal so quickly. He mentioned that
McDonald's has been in contact with the Aurora Block Club and that that
organization has supported the proposed parking area.
Hearing no further testimony� Ms. Morton closed the public portion of the
hearing.
Mr. Ferderer made a motion to recommend approval based on staff findings and
the applicant's testimony. Mr. Neid seconded the motion which passed on a
unanimous voice vote.

A. PURPOSE: To provide additional off-street parking for the ad�acent McDona��''s
restaurant.
B. �UFFICIENCY: The petition was declared sufficient by the Planning Division on
March 2, 1987; 17 parcels eligible, 12 parcels required, 14 parcels signed.
C. PARCEL SIZE: The parcei is composed of three lots; 114' on Aurora and a depth
of about 116.5 for a total lot area of 13,281 square feet.
D. �XISTING LAND USE: The eastern most lot is used as off-street parking, the
middle and the western lots are vacant.
E. SURROUNDING LAND USE AND ZONING DISTRICTS•
North: Commercial, B-3
East: State Capitol
South: Parking, P-1
West: Two family residential, RT-2
F. ZONING HISTORY: In 1974 the easterly most parcel was rezoned from C Residential
to Commercial to allow the establishment of an 8-car parking lot; this rezoning
was approved with the understanding that the zoning would be changed to P-1 once
the reew zoning district designations were established. In 1975 the parcel was
designated RT-2 based on land use maps which indicated duplex use; these maps
were incorrect.
G. FINDINGS:
1. The applicant intends to expand the existing nonconforming parking,lot which

applicant's petition is for incidental parking.
5. Establishing a P-1 zoning district requires a review of eight conditions as
set forth in Section 60.723; these conditions and the applicant's ability to
meet them are as follows:
a) The parking facility shall be accessory to and for use in connection with
one or more businesses.
The parking facility is intended solely for McDonald's use.
b) The parking facility shall not be used during hours when the principal
use is not in operation. During such periods the parking facility shall
be inaccessible for public use.
The applicant has stated that access to the lot would be restricted to
parallel the restaurant's hours of operation.
c) The parking facility shall be used solely for parking of private
passenger vehicles and shall not be used as an off-street loading area.
The applicant has stated parking is the sole intended use.
d) No commercial repair work or service of any kind, or sale or display
thereof, shall be conducted in such parking facility.
No repair work or servicing of vehicles will occur on the lot.
e) No signs of any kind, other than signs designating entrances, exits and
conditions of use, shall be maintained on such parking facility.
Entrance and exit signs are designated on the site plan.
f) No building other than that for the shelter of attendants shall be
erected upon the premises unless specifically approved by the planning
administrator during site plan review.
The applicant's site plan indicates an enclosed trash area and a small

H. STAFF ANALYSIS:
An existing P-1 lot to the south, frontage on Marion Street and the proximity to
the existing restaurant indicates that it is unlikely that these vacant parcels
would be used for residential development despite the two-family zoning
designation.
The rezoning to P-1 would provide needed parking for the existing restaurant and
would reduce on-street parking which now accommodates customers and employees.
Standards of the P-1 district help to ensure that the parking area would be
visually integrated into the neighborhood yet without causing an overwhelming
burden resulting from headlights, noise and continuous use.
I. STAFF RECOMMENDATION:
Based on findings 1 through 7, staff recommends approval of the rezoning from
RT-1 to P-1 for 229, 231 and 233 Aurora.

We represent the McDonald's Corporation.
NcDonald's appeared in front of the St. Paul Zoning Committee meeting on April 2,
1987 to answer any questions pursuant to its petition for rezoning lots 18, 19 and 20
of Block 2, Florence Addition. Prior to this meeting we had met with virtually all
of the available neighbors regarding our plans for those lots. The neighbors with
whom we dealt were in support of our efforts and, accordingly, signed our petition
for rezoning. When we appeared at the Zoning Committee meeting, then, we were
completely without notice that anyone was adverse to our intentions. Frankly put,
�cDonald's was completely shocked and aghast at the language of the letter
submitted by you on behalf of the District 8 Planning Council opposing M►cDonald's
application to rezone. Moreover, the tenor of your letter was rather accusatory in
nature and warrants a response which manifests facts rather than erroneous
conclusions.
On January 31, 1986 the McDonald's Corporation informed the Summit Ur.iversity
Planning Council of its intention to rezone the aforementioned property. A copy of
NlcDonald's letter is attached for your convenience. On February 19, 1986,
. McDonald's appeared at a District 8 Planning Council meeting and made a short
�� presentation regarding the rezoning and the proposed parking lot on Aurora Avenue.
Attached please find a copy of that meetinb's agenda (with attachments).
At the February 19th meeting, McDonald's was requested by the District 8 Planning
Council to, in effect, donate the abandoned house located on lot 18, Block� 2,
Florence Addition, to the District 8 Planning Council. After consideration by the
corporation, McDonald's agreed to, in effect, "give" the house to the District 8
Planning Council after McDonald's closed on its purchase of lot 18. By way of

letter dated July 16, 1986, McDonald's informed you it had set a ciosing date and
transmitted to you four copies of an agreement the terms of which transferred
ownership of the house to the Summit University Planning Council. As is evident on
the face of the copy of the letter attached, McDonald's gave you two weeks from
the date of the closing to remove the house as McDonald's needed the property
vacated and was concerned about potential liability among other problems associated
with an abandoned house.
McDonald's did not receive the signed agreements within a reasonable period of time
but received communications from your office indicating the Summit University
Planning Council required more time. Accordingly, on August 5, 1986 McDonald's
transmitted to you another letter which, in effect, extended the time the Summit
University Planning Council had to make a decision on the house. As 1�9cDonald's
communicated to you at that time, McDonald's was extremely concerned with
respect to the potential liability risk of an unattended abandoned house. By the
terms of the agreement, District 8 was required to maintain liability insurance.
Notwithstanding the Summit University Planning Council never signed and returned
the agreement, McDonald's consistently apprised the council of its fear with respect
to liability coverage.
By the terms of the August 5th letter (attached for your convenience) McDonald's
informed the council that the house would have to be moved by September 8, 1986,
if the council made the decision to take the home. Otherwise, McDonald's would be
forced to demolish the home in order to preclude the liability risk and vacate the
property for development, among other reasons.
In September, McDonald's was informed by yourself that District 8 had obtained a
lot for free from the City of St. Paul and that the Council was now attempting to
find a contractor willing to donate the move of the house from 231 Aurora Avenue
to wherever the lot was located. McDonald's, however, simply could not wait any
longer for arrangements to be made especially since it had given the District 8
Planning Council over two months to make a decision with respect to the house.
I�4oreover, at that time, McDonald's discovered the City of St. Paul had not in fact
donated a lot to District 8, contrary to what McDonald's was told. Telephone
communications continued and McDonald's informally extended the "deadline" on
action on the house until October 1986, but eventually was forced to demolish the
home on October 10, 1986.
McDonald's takes great issue with the language manifested in your Mar�h 30, 1987
' letter to Ms. Donna Datsko. McDonald's, in good faith, dealt with the District 8
` Planning Council from February 1986 through early October 1986 in an attempt to,
literally, give a house to the planning council. Your implication that McDonald's
was unwilling to negotiate in good faith is not only factually inaccurate but unfairly
lends itself to a negative characterization of i�IcDonald's good faith efforts to work
with the planning council. In addition, McDonald's never agreed or offered to move

As you are aware, the Summit-Univers�ity Planning C�uncil ficst
reviewed the request by McDonald's Corporation to rezone lots
18, �19, 20, block 2, Florence addition from RT-2 to P-1 in
February, 1986.
On October 28� 1986, the Summit-U Board again reviewed the matter
, of rezoning lots 18, 19, and 20 for a parking lot. At the October
meeting, the Board reversed it3 early motion to support the rezoninq
request by McDonal.ds and went on record as supporting the area
residents who were oppo:,ed to the rezoning. �
The reason for this ct�anye were two-fold. Fir�t, at the first
cummunity meeting held in February, only cnP resident was present
reqard'ing the rezoning and tie was opposed. The Board iater found •
out that the reason more residents did not attend the meeting was
because it was held in the eveninq and many of the seniors would
not attend a meeting after dark. A meeting was held at one of the
residents September, 1986 where over 50$ of the area residents . �
attended and voiced their �pposition to the rezoning. The second
reason has to do with McDonalds' and their unwillingness to negotiate
a .good faith deal to move the house located at 235 Aurora Avenue off
their property. The neighborhood had been told by McDonalds in '
FeSruary that they would sell the house located at 235 Aurora Avenue
to the community Lor one dollar. After months of negotiating,
McDonalds said they could no longer wait and would have to demol,i�h
the house. They could wait only if the neighborhood group could qet
the residents to sign the rezoning petition. They were told this wa�
not the role of the neighborhood group and shortly aEterwards,the
house was demolished.
