THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN: Section 1 . That Section 404.04, Subdivision 1 of the Saint Paul Legis- lative Code be and hereby is amended to read as follows: Subdivision 1 (a) Area prohibited; maximum number. No license shall be granted hereunder for the operation of a private club except in a B-2 Community Business District, a B-3 General Business District, an I-1 Industrial District; nor shall there be more than one such license issued for every �A ,-9AA 17 , 000 inhabitants of the city, st���ee�-�e-a x�a�}x���x-e�-�3-st�e�i-��eer�ses ,- which shall not be transferable from person to person. Private clubs l�_censed on April 1 , 1976 , even though in excess of the above limitation, may continue to operate and have their licenses renewed so long as such clubs comply with all other provisions of this chapter and other laws . Bottle clubs having a state bottle club permit on April l , 1976 , and continuously thereafter, may obtain a private club license without regard to the numerical or population limitations above , so long as such clubs comply with all other provisions of this chapter and other laws. Private club licenses issued to clubs which had either a state bottle club permit or a private club license on April l , 1976 , shall not be trans- ferable from person to person. That Section 404. 04, Subdivision 1 be and is hereby amended so as to add the following thereto: (b) The provisions of section 409. 16, subdivisions 3 , 4a, 5 and 6, to the extent applicable , shall apply to the Council ' s initial issuance of private club licenses pur- suant to this amending ordinance ; provided however, that the priority listing contained in section 409. 16 , subd. 4a(2) shall be revised as follows : (1 ) As an absolute priority, an applicant who at some previous time was licensed by the state and/or the city as a private club or bottle club. (2) All other applicants , in the order by date and time on which their completed applications were received by the license inspector. Section 3. This ordinance shall take effect and be in force thirty days from and after its passage , approval and publication. 2.
