An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City of Saint
Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Edward E. Brugler duly petitioned to rezone 501 Drake Street
located at the northwest corner of Juno from RM-2 to I-1 for the purpose of
establishing industrial zoning designation for property used as manufacturing
since 1956; the petition having been cert'ified by the Planning Division on
January 14, 1987 as having been consented to by at least two-thirds of the
owners of the area of the property to be rezoned, and further having been
consented to by at least 67% of the owners of the property situated within 100
feet of the total contiguous property within one year preceding the date of
the petition; and
WHEREAS, The Zoning Corrnnittee on February 19 and March 5, 1987, conducted
public hearings for the purpose of considering the rezoning petition, and
pursuant to Section 107.03 of the Administrative Code, submitted its
recommendation to the Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on March 13, 1987 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
March 21, 1987 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought
to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
April 9, 1987, where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 27, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 501 Drake Street being more particularly
described as Lots 22, 23 and 24, Block 1, Beck and Brekenridge
Addn. be and is hereby rezoned from RM-2 to I-1.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

PURPOSE: Rezoning from RM-2 (multiple family) to I-1 (light industrial) to re-
establish industrial zoning for property used as manufacturing since 1956.
PLANNING COMMISSION DECISION: Approve rezoning to B-3 (15-1)
ZONING COMMITTEE DECISION: Approve rezoning to B-3 (6-1)
STAFF RECOMMENDATION: Approve rezoning to I-1
SUPPORT: Petition with 11 signatures submitted in support of I-1 zoning.
OPPOSITION: One person spoke (2/19/87) and District 9 sent letter.
Dear Sir:
On February 19 and March 5, 1987 the Zoning Committee of the Planning
Commission held a public hearing on this rezoning. The petitioner testified.
At the close of the public hearing, the Committee voted 6 to 1 to approve a
less intensive rezoning to B-3 (rather than I-1) because the applicant had no
definite industrial use planned for the property and because the parcel can be
seen from the intersection of Randolph and West Seventh.
On March 13, 1987 the Planning Commission upheld the Zoning Committee's
recommendation on a vote of 15 to l.
This rezoning is scheduled to be heard by the City Council on April 9, 1987.
On Monday, April 6, the proposal will be reviewed by the City Development and
Transportation Committee and slides will be shown at that time.

EDWARD E AND JOSEPHINE L BRUGLER (#10064): A Rezoning for property used for
manufacturing since 1956 located at SO1 Drake Street.
Ms. Datsko showed slides of the site and reviewed the staff report with a recommendation
for approval. She stated that District 9 sent a letter recommending denial.
Edward E. Brugler, Route 3, Box 45, Hudson, Wisconsin stated that he would like to have
the property rezoned to its former status.
Mr. Christenson asked if Mr. Brugler currently uses the property. Mr. Brugler statcd that
he is using it, the building is for sale and hc feels it would be more salable if zoned I-1 for
light industrial.
Mr. Repke asked if Mr. Brugler uses the building for welding. Mr. Brugler stated that it is
used for an office.
Laverne Pflaum, 637 Juno, stated that he wants to keep the residential RM-2 zoning
because of the possible devaluation of his property if zoning is changed.
Hcaring no further testimony, Ms. Morton closed the public portion of the hearing.
Ms. Tracy and Mr. Ferderer inquired regarding buffer zones around intensively used
industrial property. Mr. Soderholm stated that land use is considered rather than a
particular strategy to buffer industrial properties. He stated that I-1 is less of a spot
zoning than RM-2.
Mr. Repke stated that the railroad runs by the property, the property is visiblc from West
Seventh and Randolph and that it should be separated from the nearby West Seventh retail
area; he recommended that the applicant consider rezoning to B•2.
Mr. Ferderer made a motion to recommend layover to March 5 for staff consultation with
the applicant. Ms. Tracy seconded the motion which passed on a unanimous voice vote.

EDWARD E. BRUGLER (#10064): A rezoning from RM-2 to I-1 for property at 501 _
Drake to re-establish industrial zoning for property used for manufacturing �
since 1956. This item was laid over from February 5� 1987 to allow the
applicant time to consider alternative zoning classifications.
The applicant was present.
Ms. Datsko showed slides of the site.
Ms. Datsko stated that staff believed I-1 was appropriate. She stated that
the historical use of the property was an I-1 use� there is I•1 zoning to the
south and having this parcel I-1 would buffer the W. Seventh commercial uses
from the I-2 uses located to the south-east. She submitted commercial zoning
restrictions to the applicant to review but he preferred I-1.
Mr. Neid asked Ms. Datsko if the applicant stated why his business was closed.
Ms. Datsko stated no.
The Committee discussed spot zoning. Mr. Soderholm stated that the property
would not be spot zoned because there is an I-1 zone next to the applicant's
property.
Mr. Neid requested to ask Mr. Brugler some questions even though the public
hearing had been closed; request was granted.
Mr. Neid asked Mr. Brugler why he closed his business. Mr. Brugler answered
because of his arthritis. He stated that he attempted to sell but then
decided to sell the machinery and property separately. Mr. Neid asked Mr.
Brugler if he had discussed with Ms. Datsko what could go into a B-2 zoning.
Mr. Brugler stated that he has reviewed those uses but historically the
property was industrial and changed in 1975.
Mr. Christenson stated that I-1 zoning was not an area of heavy industrial
uses but provided opportunity for many clean and high quality businesses.
Mr. Repke made a motion to recommend denial for I-1 zoning district because
applicant has no indication of what business will occupy the property and �
because the property is visible from the intersection of W. Seventh and
Randolph. Ms. Zieman seconded the motion, which passed on a roll call vote of
4 to 3 (Christenson� Neid, Morton).
Ms. Morton asked Mr. Brugler if he would consider B-3 zoning. Mr. Brugler
answered yes.

WHEREAS, Edward E. and Josephine L. Brugler, file #10064, has petitioned to rezone SO1 Drake
Street situated on the northwest corner at Juno from RM-2 to I-1 for the purpose of establishing
zoning which is consistent with the intended use; and
WHEREAS, the Zoning Committee of the Planning Commission on February 19, and March 5,
1987, held a public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requirements of Section 64.400 of the Saint
Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as subsequently reflected in the minutes, made the following
findings of fact:
1. The applicant stated that he conducted his welding operation from this location from 1956
until last spring when the business closed. He attempted to sell his building and was informed
by one realty company that the current residential zoning was acting as a deterrent to
potential industrial clients. He therefore would like to have the zoning amended.
2. Uses permitted in the I-1 zoning district include all principal uses in the B-3 district, research
uses, warehousing and wholesale establishments, manufacturing, welding, laboratories, storage
facilities and so on. The applicants use of the structure for welding was an I-1 use.
3. The applicants' parcel also contains a small rasidential structure; the code requires that zoning
lots must be in one zoning district and therefore the residential building area would also be
rczoned if the petition is approved.
4. Other uses in the surrounding area -- heavy industrial, greenhouse storage and commercial
uses and historical recorded use of this parcel all indicate that multiple family residential
uses are not appropriate uses for this property and are unlikely to be established in this
immediate area.
5. The applicants have no committed purchaser of their property; the former industrial building
is now used as the applicants' office. Office uses are permitted in the B-3 zoning district.

6. The City's comprehensive plan states that the city "will require through zoning ... the
scparation and buffering of those industries which may adversely impact adjacent activitics"
(policy 4.3-10). By rezoning this parcel from residential to commcrcial the city will confine
any negative impacts which may result from the close proximity of residential and heavy
industrial uses.
NOW, THEREFORE, BE IT RESOLVED, by the Saint Paul Planning Commission that the petition
of Edward E. and Josephine L. Brugler to rezone property at SO1 Drake Street more particularly
