Re: Davic Cole v. City of St.Paul
Plaintiff David Cole's parked automobile was struck by an
unmarked police car on February 22 ,1986 at Rice and Como. The
police officers, Randall Schwartz and Joe Strong were followirig a
car suspected to be stolen and witing for marked squad cars to
apprehend the suspects. 5uspects vehicle cut the police vehicle
off, forcing the police vehicle to swerve on slushy streets and
hit Coles parked car. The plaintiff claims that his car was
properly parked. A police report states that it in fact was
legally parked.
The rear bumper , trailer hitch and panels of the plaintiffs car
were damaged. The plaintiff claims property damage in excess of
$i . .
Our office has agreed to settle the plaintiff's claim in the sum
of $5501 .4Jg . We recommend approval of the settlement.
