RESOLUTION CYTY OF SAINT PAUL, MINNESOTA Green Sheet # � � Sf�/ a7 Presented By Refened To Committee: Date 2 3 4 5 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 WHEREAS the Aepartment of Public Health, Code Enforcement Program (now the Citizen Service Office, Code Enforcement Program) requested the St. Paul City council to hold public hearings to consider the advisability and necessiry of ordering the repair or wrecking and removal of a two-story, wood-frame dwelling located on properry hereinafter referred to as the "Subject Property" and commonly Irnow as 777-779 Aurora Avenue; this properry is legally described as follows: Lot 21, Chute Brothers Aivision No. 9, Addition to the City of St. Paul, Minnesota WHEREAS the Department of Public Health served in accordance with the provisions of Chapter 45 of the St. Paul Legislative Code an Order identified as an"Order to Abate Nuisance Building(s)" dated February 5, 1997; and WHEREAS this Order informed the then known interested or responsible parties that then structure located on the Subject Property is a nuisance building pursuant to Chapter 45; and WIiEREAS this Order informed the interested or responsible parties that they must repair or demolish the structure located on the Subject Properry by February 20, 1997; and WHEREAS the enforcement officer has posted a placazd on the Subject Properiy declaring this building to constitute a nuisance condition subject to demolition; and WIIEREAS this nuisance condition has not been corrected and the Public Health Department requested that the City Clerk schedule public hearings before the Legislative Hearing . Officer of the City Council and the Saint Paul City Council; and WI�EREAS the interested and responsible parties were served notice in accordance with the provisions of Chapter 45 of the Saint Paul Legislative Code, of the time, date, place and purpose of the public hearings; and WHEREAS a hearing was held before the Legislative Hearing Officer of the St. Paul City Council on Tuesday March 18, 1997 to hear testimony and evidence, and after receiving testimony and evidence, made the recommendation to approve the request to order the interested or responsible parties to make the Subject Property safe and not detrimental to the public peace, health, safety, and welfaze and remove its blighting influence on the community by rehabilitating this shucture in accordance with all applicable codes and ordinances, or, in the alternative, by demolishing and removing the structure in accordance with all applicable codes and ordinances. The rehabilitafion or demolition of the structure to be completed witkrin one hundred and eighty 2 4 5 6 7 8 9 10 11 12 13 14 �� �s (180) days after the date of the Council Hearing conditioned upon the posting of the bond and payment of the vacant building registration fee by March 26, 1997; and WI�REAS a hearing was held before the St. Paul City Council on Mazch 26, 1997 and the testimony and evidence inciuding the action taken by the Legislarive Hearing Officer was considered by the Council; and WIIEREAS the City Council passed a Resolufion (C.F.#97-316) regazding the abatement of a nuisance building located at 777-779 Aurora Avenue in the City of St. Paul which was adopted on March 26, 1997, and wluch provided in pertinent part that the Depar[ment of Public Health, Division of Code Enforcement would demolish the structure if the properry owners did not make all repairs necessary for code compliance within one hundred and eighty (180) days of said resolution; and 15 WHEREAS based upon the testimony and evidence presented at the Mazch 18, 1997 and 16 Mazch 26, 1997 public hearings, the St. Paul City Councii, in C.F. #97-316, adopted the following 17 Findings concerning the Subject Properiy at 777-779 Aurora Avenue: 18 19 20 21 22 23 24 25 26 27 28 29 30 31 32 33 34 35 36 37 38 39 40 41 42 43 44 45 46 47 48 49 50 51 That the Subject Property comprises a nuisance condition as defined in Saint Paul legislative Code, Chapter 45. 2. � That the costs of demolition and removal of this building(s) (sic) is estimated to exceed three thousand dollars ($3,000.00). That there now exists (sic) and has existed multiple Housing or Building code violations at the Subject Property. 4. That an Order to Abate Nuisance Building(s) was sent to the then known responsible parties to correct the deficiencies ar to demolish and remove the building(s). 5. 6. 7. 8. That the deficiencies causing this nuisance condition have not been corrected. Public Health has posted a placazd on the Subject Properiy which declares it to be a nuisance condition subject to demolition. That this building has been routinely monitored by the Vacant/Nuisance Buildings Code Enforcement Program. That the known interested parties and owners are as previously stated in this resolution and that the notification requirements of Chapter 45 have been fixlfilled. Said Findings served as the basis far the Order set forth in C.F. #97-316; and WFIEREA5 the owner of the subject properry has requested the delay of the demolition of the properry for an additional one hundred and eighty (180) days in order to rehabilitate the properiy and to bring the properiy into compliance with the ali applicable codes and ordinances; now, therefore BE IT RESOLVED, resolution, Council File Number 97-316 which was passed on Mazch 26, 1997, requiring the rehabilitarion or demolition of the properiy located at 777-779 Aurora 2 3 4 6 7 8 9 10 11 12 13 14 15 16 17 18 19 20 21 22 23 24 25 26 27 28 29 Avenue within one hundred and eaghty (180) days shall be amended in part as follows: ORDER The Saint Paul City Council hereby makes the following Order: �9 �s The above-referenced interested or responsible parties shall make the Subject Property safe and not detrimental to the public peace, heaith, safety and welfare; shall remove its blighring influence on the community by rehabilitating this structure in accordance with all applicable codes and ordinances; shall correct all deficiencies as prescribed in the "Order to Abate Nuisance Building(s)" dated Febniary 5, 1997; or in the altemative by demolishing and removing the stntcture in accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure shall be completed within one hundred eighty days (180) after the passing of this resolufion. 2. If the above corrective action is not completed within this period of time, the St. Paui Citizen Service Office, Code Enforcement Program is hereby authorized to take whatever steps are necessary to demolish and remove this structure, fill the site and charge the costs incurred against the Subject Property pursuant to the provisions of Chapter 45 of the St. Paul Legislative Code. In the event the building is to be demolished and removed by the City of St. Paul, all personal properry or fixtures of any kind which interfere with the demolition and removal sha11 be removed from the properiy by the responsible parties by the end of this time period. If all personal property is not removed, it shall be considered to be abandoned and the City of St. Paul shall remove and dispose of such property as provided by law. 4. It is further ordered that a copy of this resolution be mailed to the owners and interested parties in accordance with Chapter 45 of the Saint Paul Legislative Code.
