WHEREAS , the Council of the City of Saint Paul, on May 12, 1982,
adopted resolution C.F. 278642 which vacated the following described
land:
That part of East Ninth Street lying within the
following described lines:
Beginning at a point on the northwesterly line of
Lot 5, V. D. Walsh's Rearrangement of Lots 1 and 2,
Block 16 , Robert & Randall's Addition and Block 7,
Hoyt's Addition accoraing to the recorded plat
thereof, said line also being the southeasterly line
of said East Ninth Street, distant 79.65 feet
southwesterly of the most northerly corner of said
Lot 5; thence northeasterly along said northwesterly
line and its northeasterly extension 81.5 feet, 1.5
feet beyond the northeasterly face of the existing
four-story brick building on said Lot 5; thence
northwesterly parallel to the northwesterly
extension of the northeasterly line of said Lot 5 a
distance of 1.52 feet, 1.0 foot northwesterly of the
northerly corner of said building ; thence
southwesterly parallel to and 1.0 foot distant from
the northwesterly face of said building 81.5 feet to
a point 1.0 foot northwesterly of the westerly
corner of said building and distant 1. 95 feet
northwesterly of the point of beginning; thence
southeasterly 1.95 feet to the point of beginning;
and
That part of Temperance Street lying within the
following described lines: Beginning at the most
northerly corner of Lot 5 , V. D . Walsh ' s
Rearrangement of Lots 1 and 2, Block 16 , Robert &

1 . 85 feet , 1 . 5 feet northeasterly of the
northeasterly face of the existing four-story brick
building on said Lot 5; thence southeasterly 99.48
feet parallel to and 1.5 feet distant from the face
of said building and its southeasterly extension to
a point 1.5 feet northeasterly of the southeasterly
corner of the existing concrete founc3ation wall on
the southeasterly side of said building; thence
southwesterly 1.85 feet along the southeasterly face
of said foundation wall to the southwesterly line of
Temperance Street , said line being also the
northeasterly line of said Lot 5 ; thence
northwesterly along said southwesterly line of
Temperance Street 99.48 feet to the point of
beginning;
WHEREAS, condition number four of resolution 278642 required Farm
Credit Banks to furnish the City with an indemnity bond in the amount
of $10 ,000 . 00; and,
WHEREAS, the City will accept a Covenant of Indemnity from Farm
Credit Banks in lieu of the indemnity bond.
THEREFORE BE IT RESOLVED, that the requirement of an indemnity
bond in condition four be deleted and replaced with a Covenant of
Indemnity which is described as Exhibit "A" attached hereto and made a
part of this resolution; and,

The Federal Land Bank of Saint Paul , the Federal Intermediate Credit Bank of
St. Paul , and the St. Paul Bank for Cooperatives, Federally chartered
corporations , owners of the property previously vacated by
resolution C.F. 278642 approved P�lay 6, 1982 agree on
behalf of themselves, their assigns and successors in interest to indemnify,
defend and save harmless the City of Saint •Paul , its officers and employees
from all suits, actions or claims of any character brought as a result of
injuries or damages received or sustained by any person, persons, or property
on account of this vacation, including but not limited to a claim brought
because of any act of omission, neglect or misconduct of said corporations
or because of any claims or liability arising from any violation of any law or•
regulation made in accordance with the law whether by said corporations
or any of their agents, employees, assigns, or successors in interest.
This indemnification is offered in lieu or the bonding requirement set forth
in Condition #� of the above referenced vacation.
