WHEREAS , the Council of the City of Saint Paul, on July 8 , 1982,
adopted resolution C.F. 278940 which vacated the following described
land:
All of the alley in V.D. Walsh's Rearrangement of
Lots 1 & 2, Block 16, Robert & Randall's Add. and
Block 7 , Hoyt' s Add. in the block bounded by
Temperance , E. Eighth , Jackson and E. Ninth
Streets, subject to streets;
WHEREAS, condition number 5 of resolution 278940 required Farm
Credit Banks to furnish the City with an indemnity bond in the amount
of $2,000.00= an8
WHEREAS, the City will accept a Covenant of Indemnity from Farm
Credit Banks in lieu of the indemnity bond.
THEREFORE IT IT RESOLVED, that the requirement of an indemnity
bond in condition 5 be deleted and replaced with a Covenant of
Indemnity which is described as Exhibit "A" attached hereto and raade a
part of this resolution; and,
BE IT FURTHER RESOLVED, that in all other respects resolution
278940 shall remain in full force and effect; and,
BE IT ALSO RESOLVED, that the City Clerk shall file a copy of
this resolution in the office of the Registrar of Titles, and record a
copy of this resolution in the Office of the County Recorder , Ramsey
County, Minnesota.

COVENANT OF INDEMNITY
To the Honorable, the City Council
of Saint Paul , Minnesota
The Federal Land Bank of Saint Paul , the Federal Intermediate Credit Bank of
St. Paul , and the St. Paul Bank for Cooperatives, Federally chartered
corporations , owners of the property previously vacated by
resolution C.F. 278940 approved July 6, 1982 agree on
behalf of themselves, their assigns and successors in interest to indemnify,
defend and save harmless the City of Saint Paul , its officers and employees
from all suits, actions or claims of any character brought as a result of
injuries or damages received or sustained by any person, persons, or property
on account of this vacation, including but not limited to a claim brought
because of any act of omission, neglect or misconduct of said corporations
or because of any claims or liability arising from any violation of any law ar
regulation made in accordance with the law whether by said corporations
or any of their agents, employees, assigns, or successors in interest.
This indemnification is offered in lieu of the bonding requiremenL sPt forth
in Condition #5 of the above referenced vacation.
