RESOLVED, that upon the petition of Har-Mar , Inc. per File
29-1986 that part of Roy Street and part of the alleys in Block 1
and 2 , Homer H. Hoyt Co' s Addition bounded by University ,
Snelling, Shields and Fry, hereinafter described be and the same
are hereby vacated and discontinued as public rights-of-way upon
the following terms and conditions:
That the vacated area be described as follows:
That part of Roy Street and its Northerly extension and
the alleys in Blocks 1 and 2 as originally platted in
Homer H. Hoyt Co's Addition, Ramsey County, Minnesota,
and any other right-of-way conveyed to the City of
Saint Paul located in said Addition, including without
limitation all alleys, streets and public rights-of-
way, lying within the following described tract:
A tract of land comprising part of the South 122 . 82
feet of the North 182.82 feet of the Northeast
Quarter of the Southeast Quarter of Section 33
Township 29, Range 23, Ramsey County, Minnesota
together with a part of Lots 1 through 7 inclusive,
Block 1, Lots 21 through 24 inclusive Block 1, Lots
1 through 4 inclusive Block 2 and Lots 15 through 17
inclusive, Block 2, and including the streets and
alleys as designated and delineated all in HOMER H.
HOYT CO'S ADDITION, according to the recorded plat
thereof in said Ramsey County and said tract being
described as follows:

1. That the vacation be subject to all the terms and conditions
of Chapter 130 , codified March 1, 1981 of the St. Paul
Legislative Code, as amended.
2 . The petitioner will be replatting property including the
property contained in the above legal description for
development as Spruce Tree Centre. The replat will include
a loop road (hereinafter referred as "Loop Road") described
as follows:
A tract of land comprising part of Lots 5 through 7
inclusive, Lots 21 and 22 , Block 1 , Lots 3 and 4 and
Lots 15 through 17 inclusive , Block 2, together with
the streets and alleys as designated and delineated
all in HOMER H. HOYT CO'S ADDITION, according to the
recorded plat thereof in said Ramsey County, Minnesota
and said tract being described as follows:
Commencing at a point on the north line of the South
122.82 feet of the North 182.82 feet of the Northeast
Quarter of the Southeast Quarter of Section 33 ,
Township 29, Range 23, distant 453.50 feet west of the

3 . The petitioner shall convey to the City of Saint Paul , the
following described property for the construction of a public
parking ramp which includes a portion of the above vacated
premises. It shall be conveyed in a form to be approved by
the City Attorney.
A tract of land comprising part of the South 122.82
feet of the North 182.82 feet of the Northeast Quarter
of the Southeast quarter of Section 33 Township 29 ,
Range 23, Ramsey County, Minnesota together with a part
of Lots 1 through 5 inclusive Lots 22 and 24 , the
vacated alley between said Lots 22 and 24 , which alley
was formerly Lot 23 , Block 1 , Lots 1 through 3
inclusive , Block 2, and the streets and alleys as
designated and delineated in HOMER H. HOYT CO ' S
ADDITION, according to the recorded plat thereof in
said Ramsey County, and said tract being described as
follows:

4 . That the petitioner shall pay all costs and expenses for the
abandonment of the existing 12" sanitary sewer located in
vacated Roy Street north of the proposed "Loop Road" and pay
all costs and expenses for the redirecting and construction
of sewers in the "Loop Road" to Fry Street.
5. That the petitioner shall pay all costs and expenses for all
storm sewer facilities required in the construction of the
proposed "Loop Road." Construction of this sewer shall be
done in accordance with applicable codes and ordinances and
shall be subject to the approval of Public Works Sewer
Engineer .
6 . Based upon utility easement Certificates of Intended Non-Use
filed voluntarily on behalf of the Water Utility, Department
of Public Works , Continental Cablevision, District Energy
St. Paul, Inc. and Western Union and made a part hereof by
this reference and filed in the office of the City Clerk of
Saint Paul , the City for itself and on behalf of these
corporations and departments waives the right to utility
easements in that portion of the vacated area, described as
follows :

of the Southeast Quarter of Section 33 , Township 29 ,
Range 23, Ramsey County, Minnesota together with a

7 . That the petitioner shall pay all costs and expenses for the
installation of an eight-inch water main in the "Loop Road"
between Roy Street and Snelling Avenue .
8 . That the petitioner shall pay all costs and expenses for the
installation of a hydrant and hydrant control valves on the six
inch water main in Roy Street at approximately four feet south of
the south curb line of University Avenue .
9 . That a specific easement be retained within the vacated areas to
protect the interests of Northern States Power Company.
10 . That a specific easement be retained within the vacated area to
protect the interests of Northwestern Bell Telephone Company.
11. That the petitioner shall pay $500 administrative costs for this
vacation which is due and payable within 60 days of the
publication date of this resolution. That no compensation shall
be charged for this vacation as the land to be dedicated or
conveyed by the petitioner for the "Loop Road" and the public
parking ramp is equal to or greater than the vacated area.
12 . That the petitioner, its successors or assigns, by acceptance of
the terms and conditions of this vacation, agrees to indemnify,
defend and save harmless the City of Saint Paul, its officers and
employees from all suits, actions or claims brought as a result
of injuries or damages received or sustained by any person,
persons, or property on account of construction work and related
activities arising out of the construction of the new Spruce Tree
Centre project on or about the property herein vacated which are

caused by the negligence or intentional misconduct of said
petitioner or any of its agents or employees; or injuries or
damages received or sustained by any person, persons, or property
on account of or arising out of the vacation of these streets and
alleys, excluding that portion of vacated property that will be
dedicated for the "Loop road" and that property conveyed for the
proposed public parking ramp."
13 . That the petitioner shall within 60 days of the publication date
of this resolution file with the City Clerk an acceptance in
writing of the conditions of this resolution and shall within the
period(s) specified in the terms and conditions of this resolution
comply in all respects with these terms and conditions .
That the Council of the City of Saint Paul hereby authorizes the
proper City Officials to convey by Quit Claim Deed to Har-Mar , Inc.
the following described land:
Lot 3 , Block 1, Homer H. Hoyt Co' s Addition
