Cockriei and Rosella Cockriel ("Cockriels") hereby appeal to the District Court from the adoption of assessment by the City of St. Paul (the "City") as to the assessment for improving Gabriel Road by grading and paving, stormwater drainage facilities, sanitary sewer, and sewer service connections for the property located at 815 Gabriel Road, St. Paul , Minnesota, 55119, Parcel I.D. No. 14-28-22-11-0037 which property is referred to in the attached Exhibit A, "Notice of Objections" to said assessments as proposed, which Notice is incorporated herein and made a part hereof, on the grounds that said assessments are invalid, excessive, arbitrary, contrary to law and unconstitutional for the following reasons: (a) The proposed assessments will constitute an unconstitutional taking of Cockriels' property without just compensation in violation of the Fourteenth Amendment to the United States Constitution and Article I, Sec. 7 of the Constitution of the State of Minnesota; (b) The proposed assessments are not uniform upon the same classes of property in violation of Article 10, Sec. 1 of the Constitution of the State of Minnesota; , �� � � (c) The proposed assessments against Cockriels' property constitute an unfair, disproportionate, arbitrary and excessive proportion of the costs of the improvement; (d) The proposed assessments are in direct violation of an agreement entered into by the City of St. Paul and Mr. Vince Norton, former owner of the property in question, in which the City of St. Paul agreed that if Mr. Norton were to construct and maintain Gabriel Road at his own expense, there would be no assessment at any time in the future levied by the City of St. Paul against the property in question for grading and paving of Gabriel Road; (e) The proposed assessment is inequitable and arbitrary and without due process of law and, therefore, unlawful and invalid. WHEREFORE, Cockriels' request that the Court order that the assessments be annulled and vacated and that a reassessment be made, reduced and limited to such amounts as are proper and in accordance with law, or, in the alternative, that the Court order the City of St. Paul to annul and vacate said assessments and that the City of St. Paul make a reassessment and limited to such amounts as are proper and in accordance with law, and, that Plaintiffs be awarded their costs and disbursements herein.
