In November of 1963, the Citt�, by means of Council File No. 281141, begon
toking Sewer Availebility Chorge (SAC} credits, tor ihe reduction ot cleor
water or sonitary sewoge flow into the Metropolitan Waste Control
Commission's {MWCC) interceptors and treotment works, when preparing
Lnd tronsmitiing the monthiy 'Reserve Copecity Chorge Report' to the
nwcc.
The MWCC took the position that the teking ot S+4C credits tor the removel
o! cleor water trom the metropolit�r� disposol sysiem wos an incorrect
interpretetion ot the '1WCC SAC policy becaus� a ciear water discherge is
not e permitted discharSe snd the MWCC does not assign SAC chorges tor
it. Therefore, MWCC requested thot the City ceose toking SAC credits tor
cieor woter removal ond pey the tiwCC tor those credits previously token.
In order to resolve the differences, the City requested that the t1wCC
revise their SAC policy io inciude the ossignment ot SAC credits tor the
removnl ot cTeor woter dischorge trom the metropolitan dispose] system.

tn response to this, the MWCC eppointed e special committee to consider
the requesi by the City thet the Commission modity its SAC chorge policy.
Bosed on this Commission action and in on ettempt to resolve this
disputed issue administratively, the City, by means ot Council File
No. 86-1325, approved September 25, 1986, egreed to stop applying these
clear water credits ettective htay 1, 1966 until the special committee
(task torce} begins its deliberetions or until april 1, 1987, whichever
comes tirst.
In December 1986, the MWCC and the City arrived ot an administrotive
resolution ot their ditterences end the Gity withdrew its request that the
Commission modify its SAC charge policy. � �
This odministrotive resalution provides for the opplicotion of industriol
waste dischorge SAC credits (c��tomineted woste, not clear water) in
occordonce with ihe F1wCC SAC charge policy ond results in on
immedintely evailable SAC credit pooi ot 8,527 SAC units.

k'HEREAS, The City of Saint Paul, pursuant to C.F. 2871l1, approved
November 14, 1983, has been claiming credit for building permits issued for
commercial and industrial b�ilding modifications, renovations and �
reconstructions a�hich resulted in the permanent removal of industrial w•aste or
sanitary sev.•age flow into the Metropolitan Waste Control Commission's
interreptor and treatment works;and
V�'HEREAS. Thc Metropolitan Waste Control Commission has appointed a
Task Force to m��iew this practice and to report back to the Metropolitan V4'aste
Control Commission;and '
Vs'HEREAS.The Metropolitan Waste Contml Commission has asked the City
of Saint Paul to stop applying these industrial waste credits until such time as the
Task Forre reports its findings;and
WHETtEAS, The City agrees to cooperate with this request a ith the
understanding that this action will not affect or jeopardize the City's position
which is that the reduction of a substantial amount of industrial sek•age flow
� from an indusirial building renovation qualifies for SAC credits in the same
manner as the reduction of sea•age flow resulting fmm a demolition;and
RESOLVED,That the proper City olficials, retroactive to May 1, 1986, are
hereby directed not to apply industrial waste credits when transmitting the
monthiy "Reserve Capacity Charge Report"to the Metmpolitan Waste Control
, Commission, provided the Task Forre delays the commencement of its
deliDerations until L)eeember 1, 1986, snd be it .

9. 4/21/87 FINAL OROER: Improving BIRMINGHAM STREET from York Avenue
to Case Avenue by grading and paving, constructing
concrete curb and gutter, constructing storm water
drainage facilities and constructing a street lighting
system and doing all work necessary to compiete said
proJect. Also slope construction in the above grading and
paving. (Laid over from March 4. 1987) .
