An Ordinance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning for the City of Saint
Paul and the zoning maps thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, William F. Jones duly petitioned to rezone 1002 E.
Minnehaha, located at the southeast corner at Cypress Street, from RT-1 to
RT-2 for the purpose of establishing a triplex; the petition having been
certified by the Planning Division on February 5, 1987 as having been
consented to by at least two-thirds of the owners of the area of the property
to be rezoned, and further having been consented to by at least 67% of the
owners of the property situated within 100 feet of the total contiguous
property within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on February 25, 1987 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on March 13, 1987 and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
March 21, 1987 and notices were duly mailed to each owner of affected property
and property situated wholly or partly within 350 feet of the property sought
to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
April 2, 1987 where all interested persons were heard, and the Council having
considered all the facts and recommendations concerning the petition; now,
therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 14, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 1002 East Minnehaha being more
particularly described as Wly. 1/2 of Lot 14, and all of Lot
15, Blk 109, Schiffmann's Subd. of Blks. 109 and 110 be and
is hereby rezoned from RT-1 to RT-2.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

Dear Sir:
On March 5, 1987 the Zoning Committee of the Planning Commission held a public
hearing on this rezoning. The petitioner testified. At the close of the
public hearing, the Committee voted 8 to 0 to approve the rezoning based on
staff findings.
On March 13, 1987 the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on April 2, 1987.
Please notify me by March 31, 1987 if any member of the City Council wishes to
have slides of the site presented at the public hearing.

WILLIAM F. JONES [#10069) : A rezoning from RT-1 to RT-2 for property at 1002
East Minnehaha Avenue to allow legal conversion to a three unit residence.
. The applicant was present. There was no opposition present at the hearing.
Ms. Datsko showed slides of the site and reviewed the staff report with a
recommendation for approval. She stated that District 4 and Dayton's Bluff
Neighborhood Housing Services sent letters in support� two other letters were
received in support and one letter was received in opposition.
The Committee discussed being able to make the property a legal nonconforming
use.
Ms. Datsko stated that the Comprehensive Plan encourages neighborhood
rehabilitation and that the St. Paul Tomorrow Report reinforces that activity.
Bill Jones, �1349 Midway Parkway, stated that he believes the former owner
intended to convert the home into three units as three lines were running into
the home for electricity and there were three furnaces. He stated that there
is one neighbor who is against the conversion. One unit would have five
bedrooms if the building was a duplex.
Ron Wagner� Community Organizer for District 4, stated that the District is in
support of the conversion. He understood that the previous owner did apply to
convert the home into three units. Ms. Datsko stated that the previous owner ,
applied for a variance for building lot coverage.
Hearing no further testimony, Ms. Morton closed the public hearing portion of
� the meeting.
Ms. Zieman made a motion to recommend approval based on staff findings 1
through 7. Mr. Neid seconded the motion� which passed on a roll call vote of
8 to 0.

WHEREAS, William F. Jones, File #10069 has petitioned to rczone 1002 East Minnehaha Avenue
situated on the southeast corner at Cypress from RT-1 to RT-2 for the purpose of three unit legal
conversion; and
WHEREAS, the Zoning Committee of the Planning Commission on February 25, 1987, held a
public hearing at which all persons present were given an opportunity to be heard pursuant to said
� application in accordance with the requirements of Section 64.400 of the Saint Paul Legislative
� Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its Zoning
Committee at the public hearing as subsequently reflected in the minutes, made the following
findings of fact:
1. The applicant started rehab work on structure as a three unit; he has stated that the building
may have originally contained three units because there were three furnaces and utility
services for three dwelling units.
2. The applicant has received City rehab funds for some of the work through the rental rehab
loan program. Although financing was based on three rental units, funds were dispersed only
for two legal units. If the building is kept as three units, one unit must be rented to a Section
8 eligible household. .
3. The property is located on Minnehaha Avenue, classified as a minor-arterial level B street.
Land uses adjacent to these streets are often commercial or multiple family, although on this
block they are primarily one and two family residential. These streets are also usually ma jor
public transit routes.
4. The City's comprehensive plan states that sensitive location of higher density residential
development can have economic benefits including increased bus usage and decreased energy
consumption. The plan also states that a major portion of rental units constructed should Uc
affordable to moderate income households.
5. The District 4 plan recommends that proposals for upgrading rental housing should be
considered for their impact on low-income renters. The plan also suggests that construction
should be architecturally compatible with the existing neighborhood.
