WHEREAS, Johannes Huyen resigned from his position of Director of Human Rights
on January 3, 1986, and
WHEREAS, prior to his appointment as Director of Human Rights he held a title �,
in the classified service with the City of Saint Paul under the classification '
entitled Affirmative Action Officer--Department of Human Rights; and �
WHEREAS, the Saint Paul City Charter and the Civil Service Rules in accordance I�,
with said Charter provide that when a person is appointed to an unclassified position
from a classified position and then leaves that unclassified position, he or she
will be reappointed to the classified position he or she previously held or an �
equivalent position with no loss of any rights or privileges; and I
WHEREAS, the position that Mr. Huyen held prior to his appointment to the �
unclassified position is no longer effectively in use within the Department of
Human Rights; now, therefore, be it '
RESOLVED, that there is hereby established in the Classified Service in the �
City of Saint Paul a position of Human Rights Program Analyst at Grade 19 of the
Professional Ernployees Non-Supervisory Standard Ranges in the Salary Plan and -_ �
Rates of Compensation, Section I D 3; and, be it
FURTHER RESOLVED, that the current class title of Human Rights Analyst-Researcher
is hereby abolished and that the current class title of Affirmative Action Officer--
Department of Human Rights is hereby abolished; and, be it
FURTHER RESOLVED, that Mr. Huyen is hereby appointed as of the effective date
of this resolution to the position of Human Rights Program Analyst; and, be it
FINALLY RESOLVED, that Mr. Huyen should receive an amount of back pay equal to
t'ne difference between what he has received since he resigned from his position of
Director of Human Rights and that which he would have received had he been placed at
t'na� time into the position of Human Rights Program Analyst up to the date of his
appointment to the position of Human Rights Program Analyst. •

The GREEN SHEET has several PURPOSES: � � '

the reinstatement of any employee in the classified service who
r�hall take leave to serve in the unclassi�ed service,in a position of
equivalent salary and tenure to that which the employee held
prior to such leave,upon termination of the employee's service in
the unclassified service.

REASONS FOR FLEAVE OF ABSENCE
";�»�.>' Appointment of the employee to an Unclassified City
position. Such leave shall be granted for a period
extending over the time of actual and continuous service
in such position or positions. At the termination of
the exempt service such employee shall be reinstated to
his/her former Classified position or in an equivalent
position without loss of any right or privilege that
would have accrued to the employee had he/she aot left
. the former position, including but not limited to any
salary or fringe benefit increments accruing to such
position during the leave, except for accumulating
service credit for police and fize pension unless the
exempt position is in the police or fire service. If
• such a current position is not funded at the time, the
City Council shall provide such funding. If such
employee has a minimum of two-thirds (2/3) of the
experience necessary to take an examination in the
classified service, then such experience gained in the
unclassified position may be substituted as additional
experience in any classified position.
c. Disability or injury received in the performance of duty
not due to the negligence of the employee for the period
he/she is receiving compensation payments from the City
for temporary partial disability or temporary total
i disability.
d. Maternity, upon the request of the employee.
e. Current civil service employees of the Model Cities
Health project shall be granted a two-year leave of
absence, notwithstanding the provisions of 19.A This
leave shall begin in November, 1985, when the Model
Cities Clinic becomes an independent agency.
