Final Plat Approval for Irvine Avenue Townhouses
WIIEREAS, Michael Lander has submitted for City Council approval the attached fmal plat for four lots for four
townhouses at 275-285 Irvine Avenue between the Walnut stairs and Summit Avenue;
WI the appropriate City departments have reviewed the plat and found, as explained in the staff report to the
City Council, that it meets the requirements of Chapter 67 of the Zoning Code;
WF�REAS, notice of a public heazing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all properry situated within 350 feet of the
subject property;
WHEREAS, the City Council held a public hearing on the proposed plat on May 5, 1999, where all interested parties
were given the opporiunity to be heard and the Council considered all the facts and recommendations concerning the
plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached fma] plat for Irvine
Avenue Townhouses subject to the following conditions:
1. The developer shall file a copy of the Council Resolution approving the plat with the Ramsey County
Recorder's Office. The developer shall file a copy of the Council Resolution on each property deed
within the development.
2. Except for small wall anchors, screws, or nails suitable for attaching pictures, frames, shelves or similar
attachments, the common interior "party walls" between units shall not be altered, penetrated, or
modified in any way without first receiving proper approvals and permits from the City of Saint Paut
Office of License, Inspection, and Environmental Protection.

North: Summit Avenue homes, condos, and Deva House in RT-2 zone
East: Rear yazdslsteep siopes of Summit Ave. properties; stone wall of J.J. Hill
Mansion
South: Irvine Hill Condominiums and parking ramp in an RM-2 zone with the I-35E
Parkway below and single-family houses on ihe lower section of Irvine Ave. in

the RT-2 zone •
West: Two townhouses built a year ago as the fust phase of the subject development,
next door a single-famity carriage house, then more undeveloped slope, then a
lazge new house, then more carriage houses.
E. ZONING CODE CITATION: Section 67.301 says that platting is required when a
subdivision creates five or more lots. This appiication has anly four lots but is part of a
six-lot development for sis townhouses. The first set of townhouses was subdivided by
Registered Land Survey {RI,S) in 1998. Section 67.705 says that a Registered Land
Survey may not be used to avoid subdivision requirements, so the appficant was told by
city staffthat when the remainder of the lots were ready for subdivision, replatting would
be required. Section 67.406 gives criteria for the review of subdivision applicafions.
These criteria aze covered below in tiie findings section of this staff report.
F. HISTORY/DISCUSSION: A few years ago Michael Lander purchased a large section
of side yazd from the former Weyerhauser mansion on Summit Avenue and split the
properiy front-and-back for a condominium building on Summit Avenue and a
townhouse site on Irvina Avenue. When the condominiwn building was completed, he
proceeded with the first set of townhouses in 1997-8. The property is in the Historic Hi11
District and the plans were approved by the Heritage Preservation Commission. The
townhouses also receivad variances from the Board of Zoning Appeats. City Council
ResoIution 98-901 approved the RLS for the first set of townhouses. .
G DISTRICT COiTNCIL RECOMMENDATION: The site is in Summit
University/District 8 although the land on the other side of Irvine Avenue is in
Downtown/District 17. Summit HiIUDistrict 16 aiso likes to be informed of Irvine
Avenue issues. None of the three dish councils has submitted any comments on this
application, presurrtably because the development is nearly finished and the creation of
the lots is a technicaiity.
H FINDINGS:
1. All the applicable provisions of the Legislative Code are complied with. City staff
have reviewed the proposed final plat and previously reviewed the site plan. They have
deternuned that atl applicable provisions of city codes aze met.
2. The proposed subdivision will not be detrimental to tke present and poteatiat
surrounding land uses. 'I'he townhouses are not detrimental to surrounding land uses.
3. The area surrounding the subdivision can be p[anned and devetoped in coordination
and compafibility with the proposed subdivisioa. These townhouses and the repaving
of Irvine Avenue have increased awareness of development opportunities on the street.
This plat does not cause problems for the developmenY of neighboring properties bui each .

� potential site must be cazefully planned because the slopes impose environmental
constraints on development.
4. The subdivision is in conformance with the Comprehensive Plan. The development
is consistent with the new Housing Plan which recommends increasing new townhouse
development to catch the growing market of empty-nesters.
The subdivision preserves and incorporates the site's important existing natural
features, wherever possible. The townhouses are designed to fit into the s]ope. Special
measures were taken to divert run-off and groundwater around the shvctures. The slopes
are being revegetated.
6. All land intended for building sites can be used safely without endangering residents
by peril from flood, erosion, continuously high water table, severe soil conditions or
other menace. These issues have been addressed by city staff in site plan review and
during construction. The challenges have been to ensure the stability of the slope and to
manage stormwater and groundwater.
The development can be economically served with public facilities and services.
Utility connections aze in Irvine Avenue.
� I STAFF RECOMMENAATION: Based on required findings 1 through 7, staff
recommends approval of the final piat for the Irvine Avenue Townhouses at 275-285
Irvine Avenue by Michael Lander with the foilowing conditions:
The developer shali file a copy of the Council Resolution approving the piat with
the Ramsey County Recorder's Office. The developer shall file a copy of the
Council Reso]ution on each property deed within the development.

West: Two townhouses built a year ago as the fust phase of the subject development,
next door a single-famity carriage house, then more undeveloped slope, then a
lazge new house, then more carriage houses.
E. ZONING CODE CITATION: Section 67.301 says that platting is required when a
subdivision creates five or more lots. This appiication has anly four lots but is part of a
six-lot development for sis townhouses. The first set of townhouses was subdivided by
Registered Land Survey {RI,S) in 1998. Section 67.705 says that a Registered Land
Survey may not be used to avoid subdivision requirements, so the appficant was told by
city staffthat when the remainder of the lots were ready for subdivision, replatting would
be required. Section 67.406 gives criteria for the review of subdivision applicafions.
These criteria aze covered below in tiie findings section of this staff report.
F. HISTORY/DISCUSSION: A few years ago Michael Lander purchased a large section
of side yazd from the former Weyerhauser mansion on Summit Avenue and split the
properiy front-and-back for a condominium building on Summit Avenue and a
townhouse site on Irvina Avenue. When the condominiwn building was completed, he
proceeded with the first set of townhouses in 1997-8. The property is in the Historic Hi11
District and the plans were approved by the Heritage Preservation Commission. The
townhouses also receivad variances from the Board of Zoning Appeats. City Council
ResoIution 98-901 approved the RLS for the first set of townhouses. .
G DISTRICT COiTNCIL RECOMMENDATION: The site is in Summit
University/District 8 although the land on the other side of Irvine Avenue is in
Downtown/District 17. Summit HiIUDistrict 16 aiso likes to be informed of Irvine
Avenue issues. None of the three dish councils has submitted any comments on this
application, presurrtably because the development is nearly finished and the creation of
the lots is a technicaiity.
H FINDINGS:
1. All the applicable provisions of the Legislative Code are complied with. City staff
have reviewed the proposed final plat and previously reviewed the site plan. They have
deternuned that atl applicable provisions of city codes aze met.
2. The proposed subdivision will not be detrimental to tke present and poteatiat
surrounding land uses. 'I'he townhouses are not detrimental to surrounding land uses.
3. The area surrounding the subdivision can be p[anned and devetoped in coordination
and compafibility with the proposed subdivisioa. These townhouses and the repaving
of Irvine Avenue have increased awareness of development opportunities on the street.
This plat does not cause problems for the developmenY of neighboring properties bui each .

� potential site must be cazefully planned because the slopes impose environmental
constraints on development.
4. The subdivision is in conformance with the Comprehensive Plan. The development
is consistent with the new Housing Plan which recommends increasing new townhouse
development to catch the growing market of empty-nesters.
The subdivision preserves and incorporates the site's important existing natural
features, wherever possible. The townhouses are designed to fit into the s]ope. Special
measures were taken to divert run-off and groundwater around the shvctures. The slopes
are being revegetated.
6. All land intended for building sites can be used safely without endangering residents
by peril from flood, erosion, continuously high water table, severe soil conditions or
other menace. These issues have been addressed by city staff in site plan review and
during construction. The challenges have been to ensure the stability of the slope and to
manage stormwater and groundwater.
The development can be economically served with public facilities and services.
Utility connections aze in Irvine Avenue.
� I STAFF RECOMMENAATION: Based on required findings 1 through 7, staff
recommends approval of the final piat for the Irvine Avenue Townhouses at 275-285
Irvine Avenue by Michael Lander with the foilowing conditions:
The developer shali file a copy of the Council Resolution approving the piat with
the Ramsey County Recorder's Office. The developer shall file a copy of the
Council Reso]ution on each property deed within the development.
2. Except for smali wa11 anchors, screws, or nails suitable for attaching pictures,
frames, shelves or similaz attachments, the common interior "party walls"
between units shall not be altered, penetrated, or modified in any way without first
receiving proper approvals and pernuts from the City of Saint Paul Office of
License, Inspection, and Environmental Protection (LIEP).

WIIEREAS, Michael Lander has submitted for City Council approval the attached fmal plat for four lots for four
townhouses at 275-285 Irvine Avenue between the Walnut stairs and Summit Avenue;
WI the appropriate City departments have reviewed the plat and found, as explained in the staff report to the
City Council, that it meets the requirements of Chapter 67 of the Zoning Code;
WF�REAS, notice of a public heazing before the City Council was duly published in the official newspaper of the
City and notices were mailed to each owner of affected property including all properry situated within 350 feet of the
subject property;
WHEREAS, the City Council held a public hearing on the proposed plat on May 5, 1999, where all interested parties
were given the opporiunity to be heard and the Council considered all the facts and recommendations concerning the
plat;
NOW, THEREFORE, BE IT RESOLVED, that the City Council accepts and approves the attached fma] plat for Irvine
Avenue Townhouses subject to the following conditions:
1. The developer shall file a copy of the Council Resolution approving the plat with the Ramsey County

West: Two townhouses built a year ago as the fust phase of the subject development,
next door a single-famity carriage house, then more undeveloped slope, then a
lazge new house, then more carriage houses.
E. ZONING CODE CITATION: Section 67.301 says that platting is required when a
subdivision creates five or more lots. This appiication has anly four lots but is part of a
six-lot development for sis townhouses. The first set of townhouses was subdivided by
Registered Land Survey {RI,S) in 1998. Section 67.705 says that a Registered Land
Survey may not be used to avoid subdivision requirements, so the appficant was told by
city staffthat when the remainder of the lots were ready for subdivision, replatting would
be required. Section 67.406 gives criteria for the review of subdivision applicafions.
These criteria aze covered below in tiie findings section of this staff report.
F. HISTORY/DISCUSSION: A few years ago Michael Lander purchased a large section
of side yazd from the former Weyerhauser mansion on Summit Avenue and split the
properiy front-and-back for a condominium building on Summit Avenue and a
townhouse site on Irvina Avenue. When the condominiwn building was completed, he
proceeded with the first set of townhouses in 1997-8. The property is in the Historic Hi11
District and the plans were approved by the Heritage Preservation Commission. The
townhouses also receivad variances from the Board of Zoning Appeats. City Council
ResoIution 98-901 approved the RLS for the first set of townhouses. .
G DISTRICT COiTNCIL RECOMMENDATION: The site is in Summit
University/District 8 although the land on the other side of Irvine Avenue is in
Downtown/District 17. Summit HiIUDistrict 16 aiso likes to be informed of Irvine
Avenue issues. None of the three dish councils has submitted any comments on this
application, presurrtably because the development is nearly finished and the creation of
the lots is a technicaiity.
H FINDINGS:
1. All the applicable provisions of the Legislative Code are complied with. City staff
have reviewed the proposed final plat and previously reviewed the site plan. They have
deternuned that atl applicable provisions of city codes aze met.
2. The proposed subdivision will not be detrimental to tke present and poteatiat
surrounding land uses. 'I'he townhouses are not detrimental to surrounding land uses.
3. The area surrounding the subdivision can be p[anned and devetoped in coordination
and compafibility with the proposed subdivisioa. These townhouses and the repaving
of Irvine Avenue have increased awareness of development opportunities on the street.

� potential site must be cazefully planned because the slopes impose environmental
constraints on development.
4. The subdivision is in conformance with the Comprehensive Plan. The development
is consistent with the new Housing Plan which recommends increasing new townhouse
development to catch the growing market of empty-nesters.
The subdivision preserves and incorporates the site's important existing natural
features, wherever possible. The townhouses are designed to fit into the s]ope. Special
measures were taken to divert run-off and groundwater around the shvctures. The slopes
are being revegetated.
6. All land intended for building sites can be used safely without endangering residents
by peril from flood, erosion, continuously high water table, severe soil conditions or
other menace. These issues have been addressed by city staff in site plan review and
during construction. The challenges have been to ensure the stability of the slope and to
manage stormwater and groundwater.
The development can be economically served with public facilities and services.

� I STAFF RECOMMENAATION: Based on required findings 1 through 7, staff
recommends approval of the final piat for the Irvine Avenue Townhouses at 275-285
Irvine Avenue by Michael Lander with the foilowing conditions:
The developer shali file a copy of the Council Resolution approving the piat with
the Ramsey County Recorder's Office. The developer shall file a copy of the
Council Reso]ution on each property deed within the development.
2. Except for smali wa11 anchors, screws, or nails suitable for attaching pictures,
frames, shelves or similaz attachments, the common interior "party walls"
between units shall not be altered, penetrated, or modified in any way without first
receiving proper approvals and pernuts from the City of Saint Paul Office of
License, Inspection, and Environmental Protection (LIEP).
