That said permittee and/or its successors in interest shall fully indemnify, hold harmless and defend the City of Saint Paul, its agents, officers and employees from any and all damages, claims, losses, judgments, suits or expenses and on account of all claims of whatever nature for injury to persons and/or property arising out of or connected with the construction and maintenance of said stone facade and by permission and authority granted herein, and that the successors in interest to the permittee HRA shall insure this obligation to indemnify by obtaining and keeping in force a liability insurance policy, which names the City of Saint Paul and the HRA as additional insureds, with a company authorized or certified by the Commissioner of Insurance to transact business in Minnesota with respect to such policy, in the minimum coverage of $1,000,000.00 combined single limit for injury (including death) to any person or persons and for damages to property in any single accident or occurrence, which policy shall not be written on a � claims-made basis; e. That said permitee shall, within a period of thirty (30) days after the publication of this Ordinance, file with the City Clerk its written acceptance of this Ordinance and agreement to be bound by all the provisions, terms and conditions thereof without limitation which written instrument of acceptance and agreement shall be in the form approved by the City Attorney. SECTION 3 This Ordinance shall take effect and be in force 30 days from and after its passage, approval and publication. VACATION: Petition of City of St. Paui for the vacation of � WELLS STREET from Arcade to Mendota and part of the alley in Block 2, Williams Rearrangement bounded by Arcade. Bush, Mendota and York for the purpose of commercial development ( laid over from 4-15-87). Recommended matter be withdrawn - already acted on. 2. 5/14/87 VACATION: Petition of Estelie and Do�ald Sell for the vacation of GOODRICH AVENUE from Highway 35-E to approximately 410 feet east bounded by Dale 5treet, Lincoln and Grand Avenue � Highway 35-E. Purpose is to allow more effective utflization of the land now owned by petitioners. Laid over in Committee to 5-13-87. 3. 5/5/87 RATIFICATI�N OF ASSESSMENTS: Improving GABRIEL ROAD by grading and paving, storm water drainage facilities, sanitary sewer and sewer service connections. Also, constructing a water main in Gabriel Road and water service connections.
