The Office of License, Inspections and Environmental Protection has recommended the
denial of your license applications for an Auto Repair Garage License and Second Hand Motor
Vehicle Dealer's License at the above-referenced premises. The basis for the denial is as
follows:
The property at 545 i3niversity Avenue is located in a B-3 commercial zoning
district. Auto sales with outdoor display requires a special condition use
permit which must be approved by the Saint Paul Planning Commission.
Although the property at 545 University Avenue has a special condition use
permit, you have been advised both verbally and in writing that the use by
you of property leased from Fred's Tire Service at 519 University Avenue
requires that you obtain a new special condition use permit for that property.
You have not applied for the special condition use permit, nor have you
removed cars displayed on the adjoining properly, and you are therefor in
violation of Saint Paul Legislative Code §60.544(2). Failure fo comply with
provisions of the zoning code is a basis for adverse action against your
license, pursuant to §310.06(b)(3).
At this point you may adxnit the violation alleged above and either withdraw your license
application or immediately come into compliance with the existing special condition use permit,
as outlined in Mr. Zangs letter of January 27, 1999. If you wish to contest the allegations
contained above, you are entitled to a hearing before an Administrative Law Judge.

Hand Dealers Motor Vehictes. Lic. ID#19980006445 dba "Mr. Auto Broker"
This office is asking the City Attorney's office to prepare the necessary notice, referenced
above, because the license applicant is operating his business in violation of Saint Paul
Leg. Code 60.544(Z). This provision in the zoning code requires a"Special Condition Use
Permit" to display outdoors motor vehicies for sale at this property. Specifically, Gerald
Grossman , the applicant for the for the referenced licenses, has established an outdoor
vehicle sales display area on the adjacent property immediately east of the subject property
without obtaining the requisite special condition use permit.
Mr. Grossman had applied for the licenses noted above only after license inspector ,
following up on routine license fee delinquent notice, discovered that the existing business
was under new ownership. On that day, Aug. 28, 1998, Mr. Grossman was given five
days to apply for the required licenses. Mr. Grossman does not presently have a license
because of the zoning violation noted above and continues to operate his business at this
address. Operating without these licenses is a violation of Chapters 401 and 423 of the
City's Legislative Code.
Facts
• A Geraid Grossman, on September 15, 1998, applied for Second Hand Motor
Vehicle Sales and Generai Repair Garage License.
• The property at 545 University, iabeled (114) on attached parcel map, is located in a
B-3 commercial zoning district. Auto sales with outdoor display is a use permitted
in the district subject to certain conditions. A special condition use permit is
required in this case. This permit, wfien approved by City's Pfanning Commission, is
issued to the specific property.
• 545 University has a speciai condition use permit to disptay cars for saie and was
previously license by the City to sell cars (See attached ). However, the license
applicant has expanded the vehicle display area on to the adjoining property to the
east outside the "perm+tted" area.
• The parcel of land where the violation has occurred is labeled (254) on the enclosed
parcel map. Parcel 254 is also zo�ed B-3 and could be used for outdoor vehicle
display area if a special condition use permit was obtained. Mr. Grossman has not
appropriately responded to verbal or written orders to bring his business into
complia�ce.

• A site plan submitted by the applicant indicates the parking and vehicle dispiay area
to be at the tront of the building next to the street. There are no property lines
shown on the site plan but since the building's width approximates the width of thz
lot, it appears as though all parking and vehicle display would occur on the property
at 545 University described herein. The present vehicle dispiay observed during my
inspections extends beyond the area shown on the site plan, submitted by the
appiicant.
Inspection notes regarding the zoning violation:
I inspected the property in late December of 1998 and did observe that a used car business
was already in operation. I also observed that there were cars, with for sale stickers
located on an adjacent parcel immediately east of 545 University, labeled (254) on the
parcel map. I confirmed with the store manager of the next door business (Fsed's Tire
Service 519 University) that they had leased a portion of this property to Mr Grossman to
park his cars. This was corroborated by Mr Grossman in conversation I had with him at
that December inspection. According to City records, parcei 254 was not incVuded in the
special condition use permit issued to 545 University. I informed Mr. Grossman that he
couid either apply for a new permit to include this new parcei or remove his vehicles from
the "non-permitted" area. If he chose to confine his activity to only the currently
"permitted area", he wouid need to limit the number of "for sale" vehicles to 14 cars and
maintain at least 6 off-street parking spaces for customer and employees. At our
December meeting, he was given a copy of a site pian which iliustrated these
restrictions(see attached). In late January of 1999, I wrote a letter to Mr. Grossman
apprizing him of the zoning violation and giving him a deadline of February 16, 1999 to
compiy with one of the options above. On February 19t Mr. Grossman had stilf not filed
the necessary permit application and; upon inspection of the property that same day, had
not removed any of the vehicles (see photographs).

We have stili not received the required information from you to complete the licensing
process for the businesses presently operating at this address. I met with you in late
December and explained what the City needed to see from you.
The issues are as follows:
My inspection of your facility in December revealed that your business extends into
the adjoining property to the east (Fred's Tire Service 5� 9 University). You indicated that
you have a iease with this property owner to park your vehicles. As I explained, this
expansion onto the adjacent fot goes beyond the limits o4 the Specia4 Condition Use
Permit granted to 545 University for a used car dealership. Saint Paul Leg. Code
64.300(m) (4) requires a new Special Condition Use Permit for the expansion of the used
car lot (see reverse side of this letter). You must either operate your business on the
"permitted" property or appiy for a new special condition use permit. An appiication for
this permit along with filing information accompanies this tetter.
• if you decide to operate only on the property at 545 University, you will need to comply
with the enclosed site pian which limits the number of vehicles for display to (14)fourteen
and provides for on-site traffic maneuvering and (6)six off-street parking spaces for
customers and employees.
If we have not received an application for the Special Condition Use permit or a writfen
response that you intend to comply with item #2 above by February 16, 1999; this office will
recommend that your license request be d2nied. You will also be subject to a criminal
citation on the violation of zoning provision above.

Deaz Mr. Grossman:
The Office of License, Inspections and Environmental Protection has recommended the
denial of your license applications for an Auto Repair Garage License and Second Hand Motor
Vehicle Dealer's License at the above-referenced premises. The basis for the denial is as
follows:
The property at 545 i3niversity Avenue is located in a B-3 commercial zoning
district. Auto sales with outdoor display requires a special condition use
permit which must be approved by the Saint Paul Planning Commission.
Although the property at 545 University Avenue has a special condition use
permit, you have been advised both verbally and in writing that the use by
you of property leased from Fred's Tire Service at 519 University Avenue
requires that you obtain a new special condition use permit for that property.
You have not applied for the special condition use permit, nor have you
removed cars displayed on the adjoining properly, and you are therefor in

RE: 545 University Ave W- Request Form "A" notice denying the license for a Second
Hand Dealers Motor Vehictes. Lic. ID#19980006445 dba "Mr. Auto Broker"
This office is asking the City Attorney's office to prepare the necessary notice, referenced
above, because the license applicant is operating his business in violation of Saint Paul
Leg. Code 60.544(Z). This provision in the zoning code requires a"Special Condition Use
Permit" to display outdoors motor vehicies for sale at this property. Specifically, Gerald
Grossman , the applicant for the for the referenced licenses, has established an outdoor
vehicle sales display area on the adjacent property immediately east of the subject property
without obtaining the requisite special condition use permit.
Mr. Grossman had applied for the licenses noted above only after license inspector ,
following up on routine license fee delinquent notice, discovered that the existing business
was under new ownership. On that day, Aug. 28, 1998, Mr. Grossman was given five
days to apply for the required licenses. Mr. Grossman does not presently have a license
because of the zoning violation noted above and continues to operate his business at this
address. Operating without these licenses is a violation of Chapters 401 and 423 of the
City's Legislative Code.
Facts
• A Geraid Grossman, on September 15, 1998, applied for Second Hand Motor
Vehicle Sales and Generai Repair Garage License.
• The property at 545 University, iabeled (114) on attached parcel map, is located in a
B-3 commercial zoning district. Auto sales with outdoor display is a use permitted
in the district subject to certain conditions. A special condition use permit is
required in this case. This permit, wfien approved by City's Pfanning Commission, is
issued to the specific property.
• 545 University has a speciai condition use permit to disptay cars for saie and was
previously license by the City to sell cars (See attached ). However, the license
applicant has expanded the vehicle display area on to the adjoining property to the
east outside the "perm+tted" area.
• The parcel of land where the violation has occurred is labeled (254) on the enclosed
parcel map. Parcel 254 is also zo�ed B-3 and could be used for outdoor vehicle
display area if a special condition use permit was obtained. Mr. Grossman has not
appropriately responded to verbal or written orders to bring his business into
complia�ce.

• A site plan submitted by the applicant indicates the parking and vehicle dispiay area
to be at the tront of the building next to the street. There are no property lines
shown on the site plan but since the building's width approximates the width of thz
lot, it appears as though all parking and vehicle display would occur on the property
at 545 University described herein. The present vehicle dispiay observed during my
inspections extends beyond the area shown on the site plan, submitted by the
appiicant.
Inspection notes regarding the zoning violation:
I inspected the property in late December of 1998 and did observe that a used car business
was already in operation. I also observed that there were cars, with for sale stickers
located on an adjacent parcel immediately east of 545 University, labeled (254) on the
parcel map. I confirmed with the store manager of the next door business (Fsed's Tire
Service 519 University) that they had leased a portion of this property to Mr Grossman to
park his cars. This was corroborated by Mr Grossman in conversation I had with him at
that December inspection. According to City records, parcei 254 was not incVuded in the
special condition use permit issued to 545 University. I informed Mr. Grossman that he
couid either apply for a new permit to include this new parcei or remove his vehicles from
the "non-permitted" area. If he chose to confine his activity to only the currently
"permitted area", he wouid need to limit the number of "for sale" vehicles to 14 cars and
maintain at least 6 off-street parking spaces for customer and employees. At our
December meeting, he was given a copy of a site pian which iliustrated these
restrictions(see attached). In late January of 1999, I wrote a letter to Mr. Grossman
apprizing him of the zoning violation and giving him a deadline of February 16, 1999 to
compiy with one of the options above. On February 19t Mr. Grossman had stilf not filed
the necessary permit application and; upon inspection of the property that same day, had
not removed any of the vehicles (see photographs).

My inspection of your facility in December revealed that your business extends into

The Office of License, Inspections and Environmental Protection has recommended the
denial of your license applications for an Auto Repair Garage License and Second Hand Motor
Vehicle Dealer's License at the above-referenced premises. The basis for the denial is as
follows:
The property at 545 i3niversity Avenue is located in a B-3 commercial zoning
district. Auto sales with outdoor display requires a special condition use
permit which must be approved by the Saint Paul Planning Commission.
Although the property at 545 University Avenue has a special condition use
permit, you have been advised both verbally and in writing that the use by
you of property leased from Fred's Tire Service at 519 University Avenue
requires that you obtain a new special condition use permit for that property.
You have not applied for the special condition use permit, nor have you
removed cars displayed on the adjoining properly, and you are therefor in
violation of Saint Paul Legislative Code §60.544(2). Failure fo comply with
provisions of the zoning code is a basis for adverse action against your
license, pursuant to §310.06(b)(3).
At this point you may adxnit the violation alleged above and either withdraw your license
application or immediately come into compliance with the existing special condition use permit,
as outlined in Mr. Zangs letter of January 27, 1999. If you wish to contest the allegations
contained above, you are entitled to a hearing before an Administrative Law Judge.

RE: 545 University Ave W- Request Form "A" notice denying the license for a Second
Hand Dealers Motor Vehictes. Lic. ID#19980006445 dba "Mr. Auto Broker"
This office is asking the City Attorney's office to prepare the necessary notice, referenced
above, because the license applicant is operating his business in violation of Saint Paul
Leg. Code 60.544(Z). This provision in the zoning code requires a"Special Condition Use
Permit" to display outdoors motor vehicies for sale at this property. Specifically, Gerald
Grossman , the applicant for the for the referenced licenses, has established an outdoor
vehicle sales display area on the adjacent property immediately east of the subject property
without obtaining the requisite special condition use permit.
Mr. Grossman had applied for the licenses noted above only after license inspector ,
following up on routine license fee delinquent notice, discovered that the existing business
was under new ownership. On that day, Aug. 28, 1998, Mr. Grossman was given five
days to apply for the required licenses. Mr. Grossman does not presently have a license
because of the zoning violation noted above and continues to operate his business at this
address. Operating without these licenses is a violation of Chapters 401 and 423 of the
City's Legislative Code.
Facts
• A Geraid Grossman, on September 15, 1998, applied for Second Hand Motor
Vehicle Sales and Generai Repair Garage License.
• The property at 545 University, iabeled (114) on attached parcel map, is located in a
B-3 commercial zoning district. Auto sales with outdoor display is a use permitted
in the district subject to certain conditions. A special condition use permit is
required in this case. This permit, wfien approved by City's Pfanning Commission, is
issued to the specific property.
• 545 University has a speciai condition use permit to disptay cars for saie and was
previously license by the City to sell cars (See attached ). However, the license
applicant has expanded the vehicle display area on to the adjoining property to the
east outside the "perm+tted" area.
• The parcel of land where the violation has occurred is labeled (254) on the enclosed
parcel map. Parcel 254 is also zo�ed B-3 and could be used for outdoor vehicle
display area if a special condition use permit was obtained. Mr. Grossman has not
appropriately responded to verbal or written orders to bring his business into
complia�ce.

• A site plan submitted by the applicant indicates the parking and vehicle dispiay area
to be at the tront of the building next to the street. There are no property lines
shown on the site plan but since the building's width approximates the width of thz
lot, it appears as though all parking and vehicle display would occur on the property
at 545 University described herein. The present vehicle dispiay observed during my
inspections extends beyond the area shown on the site plan, submitted by the
appiicant.
Inspection notes regarding the zoning violation:
I inspected the property in late December of 1998 and did observe that a used car business
was already in operation. I also observed that there were cars, with for sale stickers
located on an adjacent parcel immediately east of 545 University, labeled (254) on the
parcel map. I confirmed with the store manager of the next door business (Fsed's Tire

park his cars. This was corroborated by Mr Grossman in conversation I had with him at
that December inspection. According to City records, parcei 254 was not incVuded in the
special condition use permit issued to 545 University. I informed Mr. Grossman that he
couid either apply for a new permit to include this new parcei or remove his vehicles from
the "non-permitted" area. If he chose to confine his activity to only the currently
"permitted area", he wouid need to limit the number of "for sale" vehicles to 14 cars and
maintain at least 6 off-street parking spaces for customer and employees. At our
December meeting, he was given a copy of a site pian which iliustrated these
restrictions(see attached). In late January of 1999, I wrote a letter to Mr. Grossman
apprizing him of the zoning violation and giving him a deadline of February 16, 1999 to
compiy with one of the options above. On February 19t Mr. Grossman had stilf not filed
the necessary permit application and; upon inspection of the property that same day, had
not removed any of the vehicles (see photographs).

The issues are as follows:
My inspection of your facility in December revealed that your business extends into
the adjoining property to the east (Fred's Tire Service 5� 9 University). You indicated that
you have a iease with this property owner to park your vehicles. As I explained, this
expansion onto the adjacent fot goes beyond the limits o4 the Specia4 Condition Use
Permit granted to 545 University for a used car dealership. Saint Paul Leg. Code
64.300(m) (4) requires a new Special Condition Use Permit for the expansion of the used
car lot (see reverse side of this letter). You must either operate your business on the
"permitted" property or appiy for a new special condition use permit. An appiication for
this permit along with filing information accompanies this tetter.
• if you decide to operate only on the property at 545 University, you will need to comply
with the enclosed site pian which limits the number of vehicles for display to (14)fourteen
and provides for on-site traffic maneuvering and (6)six off-street parking spaces for
