RE: Min ie E. Murphy v. City of St. Paul, et al.
The plaintiff is an 86 year old widow who fell on the sidewalk
at 212 Maple treet in the City of St. Paul on Tuesday, February
19, 1985, at pproximately 9 : 00 a.m. Mrs. Murphy was on her way
to the bus st p at the time of her fall. She worked one day a
week as a hou ekeeper for the late Thomas Ellerbe and his wife.
Plaintiff suf ered comminuted displaced radial and ulnar fractures
of the left a m. Conservative treatment was unsuccessful and
several days ater the plaintiff underwent surgery where metal
plates were i serted on both bones and bone grafting from her h.in
was performed Mrs. Murphy was treated at St. Paul Ramsey Hospital
by Dr. Thomas H. Comfort. He opined that she has suffered a 10%
permanent par ial disability of her wrist. Her medical expenses
are approxima ely $8, 000. She has not returned to her employment
as a housekee er since the fall and claims a loss of income of
approximately $2, 000 per year.
Plaintiff co enced her action against the City and the adjoining
property owne , who settled with the plaintiff in the amount of
$5, 000 . The ity of St. Paul has reached a settlement with the
plaintiff in he sum of $4, 500 and our office recommends approval .
