An Or inance amending Chapter 60 of the Saint Paul
Legislative Code pertaining to zoning f r the City
of Saint Paul and the zoning maps there f.
WHEREAS, Pursuant to Minnesota Statutes Sec. 462.35 and Sec. 64.400 of the
Saint Paul Legisla ive Code, Andrew Realty Corporatilon duly petitioned to rezone
850 Arcade Street, located on the east and west sid s of Arcade Street between
York and the Burli gton Northern Railroad tracks fr I-2 and P-1 to a Planned
Development (PD) f r the purpose of redeveloping the site as a mixed commercial/
industrial site, t e petition having been certified y the Planning Division on
February 24, 1986 s having been consented to by at least 67% of the owners of
the area of the pr perty to be rezoned, and further �aving been consented to by
at least two-third of the owners of the property siituated within 100 feet of
the total contiguo s property within one year preced�ng the date of the petition;
and �
WHERE:AS, In accord nce with the requirements of Sect on 60.730 of the Zoning
Ordinance, a preli inary plan was prepared and submi�ted depicting development
of the site includ ng new construction of retail comrpercial space with parking
and rehabilitation of existing industrial structurest and

WHEREAS, the Zonin Committee on March 20, 1986 cond�cted a public hearing for
the purpose of con idering the rezoning petition and pursuant to Section 107.03
of the Administrat've Code, submitted its recommenda�ion to the Planning Commission
that the petition e granted; and �
WHEREAS, the Planning Commission reviewed the prelimiinary plan and rezoning
petition at its me ting held on March 28, 1986 and r�commended that the City
Council approve th petition; and �

WHEREAS, Notice of public hearing before the City ouncil on the said rezoning
petition was duly p blished in the official newspape of the City on or before
April 7, 1986 and n tices were duly mailed to each o ner of property situated
wholly or partly wi hin 350 feet of the property soug t to be rezoned; and

WHEREAS, A public hearing before the City Council was co�hducted on April 17,
1986 where all interes ed persons were heard, and the Co�ncil having considered
all the facts and reco endations concerning the petitiod� and the preliminary
plan, approved the pet tion and the preliminary plan; and
WHEREAS, The final pla for the Planned Development Dist�ict has now been
presented, reviewed an approved by the Planning Adminis�rator in accordance
with the requirements f Section 60.738, and indicates p�oposals for a grocery
store, retail strip ce ter and fast food restaurant, des�gnated as projects A,
B and C on the attache site plan; a mixed-use retail an� parking development,
designated as project ; renovation of an existing indus rial building for
primarily (two-thirds) light industrial uses, designated as project E; and
renovation of an exist ng industrial building, designated as project F; and
WHEREAS, The developer has agreed that common design ele ents such as color and
exterior materials wil be carried across the facades o each project, A
through F, and that la dscaping materials will be coordinated with each
project, and that each project will meet the parking sta�ndards as set forth in
Section 62.103 of the aint Paul Legislative Code; now tlherefore,

WHEREAS� the Zonin Committee of the Planning Commi�sion on September 17� 1987� held
;' a public hearing a which all persons present were �iven an opportunity to be heard
. pursuant to said a plication in accordance with thelrequirements of Section 64.400
� of the Saint Paul gislative Code; and
, WHEREAS Saint Pa Planning Commission, based on tl�e evidence presented to its
Zoning Committee the public hearing as substanti�lly reflected in the minutes,
made the followin findings of fact: �
' 1. The petitioner proposes amending the final PD r zoning which was granted by the
, City Council i April� 1987. The amendment wou d permit greater flexibility in
the use of the existing 150�000 square foot bui ding lrnown as building no.17.
The ordinance ow states that building No. 17 w 11 be used "for primarily (two-
- thirds) light ndustrial uses."
� 2. The amendment ould permit any combination of o fice/retail/industrial uses .
throughout the building and is intended to "bro den the economic base of the

3. The amendment is in substantial agreement with he preliminary plan which

4. The petitioner states that the amendment is nece sary because the whole pro�ect�
including prop rty on both sides of Arcade� must be able to meet market demands.
: Restricting us s in one building consequently li its the flexibility to market
each separate roperty� not just building No. 17 Rents that can be charged for
industrial use are generally less than those ch rged for retail or other
commercial use . If one building is designated or a use which generates a low
� rental rate� t e other properties must be market d at a rental rate which can
generate the h rdle rate of return for the entir project. Consequently� the
other properti s' rental rate may be even beyond the current market rate for
� similar facil ies. Permitting more flexibility in the use of building No. 17
� will affect t flexibility� and viability, of t e entire PD project.
"'�� 5. The city's Co rehensive Plan states in land use policy 4.3-7 that "the city
r ' will work wit property owners to develop site r use plans and designs� and use
incentives to encourage reuse of structures and and. . ."
The amendment will provide more flexibility to t�he reuse of the structure and
will help to nsure that the overall PD is succe�ssful.

NOW� THEREFORE� B IT RESOLVED� by the Saint Paul P�ar►ning Commission that the
petitian of Andre Realty Corporation to amend the lanned District ordinance for
� property at 850 A cade Street� more particularly de�cribed as that part of the
Southeast Quarter of the Southeast Quarter of Secti�n 29� and of the Southwest
Quarter of the So thwest Quarter of Section 28� and in Township 29, Range 22, Ramsey
- ' County, 1�1. � lyin westerly of the east line of Arc de Street and lying northerly of

the Burlington No thern Railroad Company's right-of way� for the purpose of

DR W 0 PO T 0 90 : An Amendmen to Planned District (PD) for
'; property locat d at 850 Arcade Street to permit ore flexibility in the use of
, building No. 1 as designated in the PD ordinanc .
The applicant as present. There was opposition present at the hearing.
Ms. Datsko sho ed slides of the site and reviewe the staff report with a
recommendation for approval.
,: Larry Pregon, drew Realty Corporation� New Roc elle� New York, offered to
answer questio s from the Zoning Committee membe s.
Mr. Neid state if this amendment is approved� iF will allow Andrew Realty and
Seeger to deve op building No. 17 as best meets �the market needs and said that
he expects it ill not diminish Andrew's commitmlent to find an industrial
tenant for the building. Mr. Pregon responded t�at Andrew Realty is currently
working with D ve Gontarek of the Planning Divis�ion staff and a potential
industrial use who would occupy 50 to 75 thousa�d square feet. He stated
, that they will continue to work on this but that� it has been very difficult to
find leads in he industrial arena and because Of this they want to expand the
possible use o the building.
�. Lucille Bobler, 4300 Trenton Lane North� #205� P�lymouth, Minnesota� stated
�'. � that she owns he vacant lot at 915 Wells Street� and asked if her property
,' would be� affec ed by this amendment. Ms. Datskd stated that this proposal
would not cha e the zoning of Ms. Bobler's prop�erty.
� Hearing no fu ther testimony, Ms. Morton closedithe public pprtion of the
meeting.
Mr. Christens n made a motion to recommend thatjthe ordinance be amended so
; that all refe ences to the use of building No. �7 as primarily industriel be
deleted. Mr. Neid seconded the motion which pa�sed on a roll call vote of
; 7-0. I

Amendments o the final plan may be approved l�y the City Council, by ordinance,
when those a endments are in substantial agree�ment with the preliminary plan and
when those endments are required by changesjin conditions that have occurred
since the f' al plan was approved. In the ca�e of a phased planned development,
final plans for phases subsequent to Phase I Shall be treated as amendments.

, , The Plannin Commission and the City Council hall hold public hearings on
� amendments o the final plan and shall give m iled notice to all property owners
'' within 350 eet of the PD at least ten days b�fore the hearings.

'�' Changes to he final plan shall be recorded a� amendments to the recorded copy

F. FINDINGS: j
1. The petitio er proposes amending the final PDlrezoning which was granted by the
� City Counci in April, 1987. The amendment wbuld permit greater flexibility in
the use of he existing 150,000 square foot bµilding known as building no.17.
1'he ordinan e now states that building No. 171 will be used "for primarily (two-
thirds) lig t industrial uses." !
`�' 2. The amendme t would permit any combination o� office/retail/industrial uses
. throughout he building and is intended to "�roaden the economic base of the
site." �

� 3. The amendme t is in substantial agreement wi h the preliminary plan which
indicated ixed uses of retail/office/indust ial. Building No. 17 was the only
building d dicated for reuse which had a spe ific industrial use percentage
, indicated 'n the ordinance.

4. The petitioner states that the amendment is nec�'ssary because the whole project,
including prop rty on both sides of Arcade, mustl be able to meet market demands.
Restricting us s in one building consequently 1 mits the flexibility to market
each separate roperty, not just building No. 1 . Rents that can be charged for
industrial us s are generally less than those c arged for retail or other
commercial us s. If one building is designated for a use which generates a low
rental rate, e other properties must be marke ed at a rental rate which can
generate the urdle rate of return for the enti e project. Consequently, the
; i other propert es' rental rate may be even beyon the current market rate for
� similar facil'ties. Permitting more flexibilit� in the use of building No. 17
will affect t e flexibility, and viability, of the entire PD project.

5. The city's Co prehensive Plan states in land us policy 4.3-7 that "the city
will work wit property owners to develop site �euse plans and designs, and use

incentives to encourage reuse of structures andlland. . ."
The amendment will provide more flexibility to the reuse of the structure and
will help to nsure that the overall PD is successful. ___

Section 60.73 L Int t. The PD Planned Development Distr�ict is intended to permit more
flexible and creati e private or public development or red�velopment than is possible under
standard zoning cl ssifications. Planned Developments sh$11 be harmonious with the general
surrounding uses, ermitting flexibility in overall developfnent while ensuring adequate
safeguards and sta dards for public health, safety, conven�ience and general welfare. ,
G. FINDINGS: i
1. The applicant proposes a two-phased planned develop#nent; the first phase would include
construction o a 11,760 square foot retail shopping c�nter and parking lot on the west
side of Arcad between York and Wells and a 3,000 square foot fast food restaurant
directly south across Wells. Both of these areas were �arking lots at one time. Construc-
tion is propos d for Spring, 1986.
The second p ase includes partial or total demolitionjof an existing 500,000 square foot
building and onstruction of a two-story multi-purpo�e building used for

ANDRE REALTY P RATI N #9 71 : Rezone property located at 850 Arcade from I-2
and P-1 to PD (Planned evelopment) to allow development of c mmercial and industrial uses. ,
The applicant was prese t. There was no opposition present at t e hearing. Two letiers were
received in support and letter including a petition with 9 nam s on it was received in opposition.
The District 5 Planning ouncil submitted a letter in support at he meeting.
Ms. Datsko showed slide of the site and reviewed the staff repo�t with a recommendation for
approval. Ms. Datsko no ed that this is a preliminary phased de�elopment being reviewed.
Larry Pregon, 59 Kensin ton Road, Bronxville, New York, repr ented the applicant. He sum-
marized the project and howed the committee a drawing indica ing the present location of build-
ings and the proposed lo ation for retail/industrial uses and a f st food restaurant. He said that
one of the buildings on he site would be difficult to retrofit, a d may be razed, depending on the
tenant. He said it would probably be a retail use on top, with in ustrial use below.
Ms. Morton said that th neighborhood was concerned about a r�staurant that serves liquor being
built at this location.
Mr. Pregon said they in nd to build a fast food restaurant, notla restaurant that serves alcoholic
beverages.
Ms. Zieman asked if th re would be buffering along the parkin� lot.
Jim Cox, Winsor/Faricy Architects, said they plan to rebuild thp present retaining wall, and that
there would also be fen ing erected to buffer the site from the Iresidential neighborhood.
Milt Evenson, �33 Wells spoke in support. He said that the nei�hborhood needs a fast food res- �
taurant and some new evelopment in the area. He said that th�e neighborhood could use a
restaurant, as long as it didn't serve liquor. �
Hearing no further test mony, Mr. Pangal closed the public heajring portion of the meeting.
Ms. Morton moved app oval of the rezoning from I-2 and P-1 t� PD based on findings 1 and 2 of
the staff report. Ms. S mmers seconded the motion.
Mr. Segal stated rezoni g to PD is a 2 step process. He said th�,t this application is for preliminary
approval of the plan. e said that it must be reviewed by the lanning Commission and approved
by the City Council. e stated that the final plan will come b fore the Planning Administrator

Dear Co ittee Members:
The eas side of St. Paul suffered a significant economic setback
when th Whirlpool Company vacated the Arcade Street plantsite.
This ex'sting complex of buildings offers no hope for
redeplo ment by a single site user. All citizens of the city
will re eive greater benefit from creativ redevelopment of this
area th n from a vacant industrial plant site.
Therefo e, 3M would like to go the record in support of Andrew
Realty' multiple-use redevelopment concept for the site. A
Planned Unit Development (PUD) would allo maximum flexibility
for sit renovation. Needed goods and se�rvices, production space
and job will be provided for residents a�nd employees on St.
Paul 's ast side. We trust that your pla�n review process under
PUD zon'ng will allow adequate controls t' protect the health,
safety nd well-being of area property o ners.
