WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul: and
WHEREAS, �293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a£inding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Saint Professional Baseball Club,
Inc., represented by Bill Fanning, Vice-President and General
Manager, who has been designated as the responsible person on the
application, has applied for a variance to allow live music at
Midway Stadium, 1771 Energy Park Drive, on Su1y 16, 17, 18 and
August 21, 1999; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to 10:00 p.m. on July 16, 1999; 1:00 to 10:00 p.m on
July 17, 1999; 1:00 p.m. to 9:00 p.m. on July 18, 1999 and 7:00
p.m. to 10:30 p.m. on August 21, 1999; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the concerts; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to the Saint Paul Saints Professional Baseball
Club, Inc., subject to the following conditions:
1) The variance shall be for the hours of 6:00
p.m to 10:00 p.m. on July 16, 1999; �

3) The applicant shall provide personnel and
equipment who shall provide continuous sound

As near neighbors to Midway Stadium and residents of St. Anthony Park, we request that
IlQ sound level variances be granted to the Saints for concerts on July 16, July 17, July
18, and August 21, 1999.
No matter what the type of music, making it louder won't make it better; it will only
spread it farther and distort it more. The Saints are requesting sound level variances for a
• total of 21 hours in a singie 72-hour period from July 16 though July 7 8, 1999. The
neighborhoods around Midway Stadium are filled with families with young children
and/or people who work odd schedules, who may be trying to sleep during that time.
During the summer, most o£ us in the older homes and apartments in our neighborhoods
wil] be relying on open windows and outdoor living to tolerate the heat . A constant
barrage of loud music would be intolerable.
We thank you for your considerarion of our request that no sound level variances be
granted.

Attached is a sound level variance application from the St. Paul Saints Baseball Club for
four live music concerts. One concert to be held on July 16, 1999 from 6:00 p.m. to
10:00 p.m., one on 7uly 17, 1999 from 1:00 p.m. to 10:00 p.m., one on July 18, 1999
from 1:00 p.m. to 9:00 p.m., and one to be held on August 21, 1999 from 7:00 p.m. to

As near neighbors to Midway Stadium and residents of St. Anthony Park, we request that
IlQ sound level variances be granted to the Saints for concerts on July 16, July 17, July
18, and August 21, 1999.
No matter what the type of music, making it louder won't make it better; it will only
spread it farther and distort it more. The Saints are requesting sound level variances for a
• total of 21 hours in a singie 72-hour period from July 16 though July 7 8, 1999. The
neighborhoods around Midway Stadium are filled with families with young children
and/or people who work odd schedules, who may be trying to sleep during that time.
During the summer, most o£ us in the older homes and apartments in our neighborhoods
wil] be relying on open windows and outdoor living to tolerate the heat . A constant
barrage of loud music would be intolerable.
We thank you for your considerarion of our request that no sound level variances be
granted.

WHEREAS, Chapter 293 of the Saint Paul Legislative Code was
enacted to regulate the subject of noise in the City of Saint
Paul: and
WHEREAS, �293.11 provides for the granting of variances from
the sound level limitations contained in §293.09, upon a£inding
by the City Council that full compliance with Chapter 293 would
constitute an unreasonable hardship on an applicant, other
persons or on the community; and
WHEREAS, the Saint Paul Saint Professional Baseball Club,
Inc., represented by Bill Fanning, Vice-President and General
Manager, who has been designated as the responsible person on the
application, has applied for a variance to allow live music at
Midway Stadium, 1771 Energy Park Drive, on Su1y 16, 17, 18 and
August 21, 1999; and
WHEREAS, applicant is seeking a variance for the hours of
6:00 p.m. to 10:00 p.m. on July 16, 1999; 1:00 to 10:00 p.m on
July 17, 1999; 1:00 p.m. to 9:00 p.m. on July 18, 1999 and 7:00
p.m. to 10:30 p.m. on August 21, 1999; and
WHEREAS, if applicant is not granted a variance it will not
be able to present the concerts; and
WHEREAS, the Office of License, Inspections, and
Environmental Protection has reviewed the application and has
made recommendations regarding conditions for the variance; now,
therefore, be it
RESOLVED, that the Council of the City of Saint Paul hereby
grants a variance to the Saint Paul Saints Professional Baseball
Club, Inc., subject to the following conditions:
1) The variance shall be for the hours of 6:00
p.m to 10:00 p.m. on July 16, 1999; �

Attached is a sound level variance application from the St. Paul Saints Baseball Club for
four live music concerts. One concert to be held on July 16, 1999 from 6:00 p.m. to
10:00 p.m., one on 7uly 17, 1999 from 1:00 p.m. to 10:00 p.m., one on July 18, 1999
from 1:00 p.m. to 9:00 p.m., and one to be held on August 21, 1999 from 7:00 p.m. to
1030 p.m.

Also attached is a copy of the Public Hearing Noflce sent to property owners within 200
feet of Midway Stadium.

As near neighbors to Midway Stadium and residents of St. Anthony Park, we request that
IlQ sound level variances be granted to the Saints for concerts on July 16, July 17, July
18, and August 21, 1999.
No matter what the type of music, making it louder won't make it better; it will only
spread it farther and distort it more. The Saints are requesting sound level variances for a
• total of 21 hours in a singie 72-hour period from July 16 though July 7 8, 1999. The
neighborhoods around Midway Stadium are filled with families with young children
and/or people who work odd schedules, who may be trying to sleep during that time.
During the summer, most o£ us in the older homes and apartments in our neighborhoods
wil] be relying on open windows and outdoor living to tolerate the heat . A constant
barrage of loud music would be intolerable.
We thank you for your considerarion of our request that no sound level variances be
granted.
