RESOLVED that upon the Petition of Louis and Darlene
Gydesen for t e vacation of a strip of land at the intersection
of Charles an Carlton, bounded by Raymond, Charles, Carleton
and Universit , hereinafter described be and the same is hereby
vacated and d scontinued as a public right of way upon the follow-
ing terms and conditions :
That the vacated area be described as follows:
That p rt of Charles Avenue as dedicated with the
plat o Hewitts Out Lots First Division, Ramsey County,
Minnes ta described as follows :
Beginn ng at the most easterly corner of Lot 51, said
Hewitt Out Lots First Division; thence northeast along
the ex ension of the southeast line of said Lot 51 a
distan e of 0 . 5 feet; thence northwest to a point on
the no theast line of said Lot 51 distant 64 .2 feet
northw st of the most easterly corner of said Lot 51;
thence southeast along said northeast line to the point
of beg nning.
Together with that part of Carleton Street as dedicated
with sai plat of Hewitts Out Lots First Division described
as follo s:
Beginn ng at the most easterly corner of said Lot 51;
thence northeast along the extension of the southeast
line o said Lot 51 a distance of 0 . 5 feet; thence south-
east, erpendicular to said southeast line, 0 .2 feet;
thence southwest to a point on said southeast line distant
30 .1 f et southwest of the most easterly corner of said
Lot 51 thence northeast along said southeast line to the

l . That the vacation be subject to all the terms and conditions
of Chapt r 130, codified March l, 1981, of the St. Paul
Legislat ve Code, as amended.
2 . That the land described above is being vacated to accommodate
a buildi g encroachment and that upon removal, reconstruction,
alterati n, demolition or otherwise non-existence of the
encroach ng building the vacated land shall revert to the
City of aint Paul as street right-of-way without cost or
charges o the City.
3 . That the petitioners pay to City $500 . 00 as an administrative
fee for his vacation which is due and payable within 60 days
of the p blication date of this vacation.
4 . That the petitioner, its successors or assigns, by acceptance
of the t rms and conditions of this vacation, agrees to in-
demnify, defend and save harmless the City of Saint Paul, its
officers and employees from all suits, actions or claims of
any char cter brought as a result of injuries or damages
received or sustained by any person, persons or property
on accou t of this vacation including but not limited to a
claim br ught because of any act of omission, neglect or
miscondu t of said petitioner or because of any claims or
liabilit arising from any violation of any law or regulation
made in ccordance with the law whether by the petitioner or
any of i s agents or employees.
