That a permanent utility easement shall be retained on, over, under and across that part of the
northeasterly 5.0 feet of said Lot 6 Block 2lying within the vacated area on behalf of the City
of Saint Paul, Department of Public Works, to reserve the right of the City to maintain and
operate sueet lighting faciLiries or other necessary utilities in or upon said easement azea and
to enter upon said easement area or any portion thereof at any time and from time to time, for
the purposes of future construction, reconstruction, inspecting, maintaining or repairing the
same or any part thereof. Said utility easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects that will prohibit normal access to uulity facilities for maintenance
purposes wili be permitted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Warks Sewer Division with the understanding that the
restoration and costs of such improvements sha11 be the sole responsibility of the
petiuoner, its successors and assigns in the event the City exercises its reserved
easement rights.

No change from the existing grade within the easement area will be permitted without
written permission from the Deparisnent of Public Warks.
No change in surfacing within the easement area will be permitted without written
permission from the Deparunent of Public Works.
e. The petiuoner, its successors and assigns shall indemnify, defend, and save hannless
the City of Saint Paul, its officers, agents, employees, and servants from all suits,
actions, or claims which shail arise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement arising out of
or resulung from any action or negligence of the petitioner, its employees, agents, or
business invitees.
That a permanent utility easement shall be retained within that part of the northeasterly 5.0 feet
of said Lot 6 Block 2lying within the vacated azea, to protect the interest of Northern States
Power Company.
That a permanent utility easement shall be retained within that part of the northeasterly 5.0 feet
of said Lot 6 Block 2lying within the vacated area, to protect the interest of US West
Communications.
NOW THEREFORE BE IT RESOLVED, pursuant to Section 130.06 of the Saint Paul Legislative
Code and on behalf of the City of Saint Paul and those persons for whom the City has reserved

easements, the Council of the City of Saint Paul does hereby waive and release Utiliry Easements in
the vacated properry as described above, subject to the above exceptions. And,
BE IT FURTHER RESOLVED, that upon passage of this resolution, the Ciry Clerk is hereby
authorized and duected to record a copy of this resolution in the office of the County Recorder,
Ramsey Counry, and that the Ciry Clerk shall maintain a copy of all Certificates of Intended Non-Use
referenced in this resolution on file in the office of Ciuzen Services.

A portion of Kentucky Street, Fenton Street, and the alley in Block 2, Dunwell and Spencer's
Addition to Brooklynd, were vacated by Council Files #224445 and #228666. The owner of the
property at 141 South Lafayette Freeway has requested the release of all unnecessary u6lity
easements on those vacated areas which are now part of the petitioner's property. This property
has been improved, with a building in use lying over part of the vacated street areas. Owner
wishes to transfer ownershi of the ro erty, and parts of the easements are clouding the title.

That a permanent utility easement shall be retained on, over, under and across that part of the
northeasterly 5.0 feet of said Lot 6 Block 2lying within the vacated area on behalf of the City
of Saint Paul, Department of Public Works, to reserve the right of the City to maintain and
operate sueet lighting faciLiries or other necessary utilities in or upon said easement azea and
to enter upon said easement area or any portion thereof at any time and from time to time, for
the purposes of future construction, reconstruction, inspecting, maintaining or repairing the
same or any part thereof. Said utility easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects that will prohibit normal access to uulity facilities for maintenance
purposes wili be permitted within the easement azea.
b. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Warks Sewer Division with the understanding that the
restoration and costs of such improvements sha11 be the sole responsibility of the
petiuoner, its successors and assigns in the event the City exercises its reserved
easement rights.

written permission from the Deparisnent of Public Warks.
No change in surfacing within the easement area will be permitted without written
permission from the Deparunent of Public Works.
e. The petiuoner, its successors and assigns shall indemnify, defend, and save hannless
the City of Saint Paul, its officers, agents, employees, and servants from all suits,
actions, or claims which shail arise from any injuries or damages received or sustained
by any break in any service pipe or connection in said reserved easement arising out of
or resulung from any action or negligence of the petitioner, its employees, agents, or
business invitees.
That a permanent utility easement shall be retained within that part of the northeasterly 5.0 feet
of said Lot 6 Block 2lying within the vacated azea, to protect the interest of Northern States
Power Company.
That a permanent utility easement shall be retained within that part of the northeasterly 5.0 feet
of said Lot 6 Block 2lying within the vacated area, to protect the interest of US West
Communications.
NOW THEREFORE BE IT RESOLVED, pursuant to Section 130.06 of the Saint Paul Legislative
Code and on behalf of the City of Saint Paul and those persons for whom the City has reserved

Ramsey Counry, and that the Ciry Clerk shall maintain a copy of all Certificates of Intended Non-Use

easements on those vacated areas which are now part of the petitioner's property. This property
has been improved, with a building in use lying over part of the vacated street areas. Owner
wishes to transfer ownershi of the ro erty, and parts of the easements are clouding the title.

That a permanent utility easement shall be retained on, over, under and across that part of the
northeasterly 5.0 feet of said Lot 6 Block 2lying within the vacated area on behalf of the City
of Saint Paul, Department of Public Works, to reserve the right of the City to maintain and
operate sueet lighting faciLiries or other necessary utilities in or upon said easement azea and
to enter upon said easement area or any portion thereof at any time and from time to time, for
the purposes of future construction, reconstruction, inspecting, maintaining or repairing the
same or any part thereof. Said utility easement shall be subject to the following conditions:
a. No buildings, structures, trees or any temporary structure, material storage, fixture, or
any other objects that will prohibit normal access to uulity facilities for maintenance

b. Improvements in or upon the above described easement that do not prohibit the City
from exercising its reserved rights may be allowed by obtaining written permission
from the Department of Public Warks Sewer Division with the understanding that the
