Presented By °2� Referred To Committee: Date Out of Committee y Date FINAL PLAT APPROVAL FOR EDGCUMBE PLACE ADDITION WHEREAS, errance Troy has submitted the attached proposed final plat for City Council a proval ; and WHEREAS, T e Departments of Planning and Economic Development and other affected depar ents have reviewed the proposed final plat at 1600 Edgcumbe Road as descri d on the attached survey; and WHEREAS, th proposed final plat meets the requirements of Sections 67.406 and 67.703 of t e Zoning Code, except for bluff setback, slope requirement, and front yard etback; and WHEREAS, th City Council on February 19, 1987 held a public hearing to determine the a visability and necessity for the granting of variances from the strict appl cation of the provisions of Sections 67.406 and 67.703 of the Zoning Code at hich hearing all persons present were given an opportunity to testify; and WHEREAS, fo lowing said public hearing, the City Council made the following findi gs of fact: 1 . The intent f this chapter is met. 2. The grantin of the variance will not be detrimental to the public safety, health or w lfare or injurious to other property or improvements in the neighborhood in which the property is located. 3. The conditio s upon which the request for a variance is based are unique to the prope ty for which the variance is sought and are generally not applicable t other property. There is an existing single family h me with a detached garage located on the property. The property is surrounded by ark land and other single family homes. We have receiv d a letter approving this plat from District 15. We have also re eived one letter in opposition from a neighbor. C. IR D F N R L TIN APPR VAL TI N 7 4 : 1. All the app icable provisions of the Legislative Code are complied with. 2. The propos d subdivision will not be detrimental to the present and potential surrounding land uses. This subdiv sion is self-contained with a cul-de-sac street. This will not be detrimental to the surroun ing land uses. 3. The area su rounding the subdivision can be planned and developed in coordination and compatibili y with the proposed subdivision. 4. The subdivi ion is in conformance with the Comprehensive Plan. When the proprty is ready for I developm nt, a stormwater managment plan must be approved by the Sewer Division. Also, the ngineering Division will have to approved the final design for the construction of the roa way. � D. D VA N E V TI 7 : 1. The propo ed subdivision will meet the intent of this chapter. 2. The grant ng of the variance will not be detrimental to the public safety, health or welfare or injurious to other property or improvements in the neighborhood in which the property i loeated. 3. The condi ions upon which the request for a variance is based are unique to the property for which he variance is sought and are generally not applicable to other property. This is an nusually shape lot with only 100 feet of frontage along Edgcumbe Road. The bluff that uns across this property makes it difficult to plat. � 4. The literal interpretation of the provisions of this chapter would deprive the applicant of rights com only enjoyed by other properties in the same zoning district. There is a imilar development on the south side of this property. That development has large lots a 20 foot wide private road ending in a cul-de-sac. 5. The specia conditions and circumstances do not result from the actions of the applicant. : The applic nt wishes that this property be utilized to its best potential. The variance for location of the two homes along the bluff on lots 3 and 4 will create attractive home sites utilizing t exiting landscape. Part of the house located on lot 3 will be on a 5096 slope in an area pproximately 16 feet deep by 25 feet long. Part of the house located on lot 4 will be on 2596 slope in an area approximately 20 feet deep by 40 feet long. The site plan review process shall include a soil analysis and a y needed corrective measures and an erosion control program for the period of construction.
