WIIEREAS, based upon the records in the Ramsey County Recorder's Office and information
obtained by Division of Code Enforcement on or before Apri12, 1998, the following are the now known
interested or responsible parties for the Subject Property: Bankers Trust Co. of California, c!o National
Banc Mortgage. Corp, Attn: Reo Dept - 7essica Osborne, 1Q 1 Main Street East, Louisville, KY 40202-

WIIEREAS, Division of Code Enforcement has served in accordance with the provisions of

Council on Tuesday, Apri120, 1999 to hear testimony and evidence, and after receiving testimony and
evidence, made the recommendation to approve the request to order the interested or responsible parties
to make the Sub}ect Property safe and not detrimental to the public peace, health, safety and welfaze and
remove its blighting influence on the comxnunity by rehabilitating tlus struchxre in accordance with all
applicable codes and ordinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition of the structure to

WHEREAS, a hearing was held before the Saint Paul Ciry Council on Wednesday, April 28,

BE IT RESOLVED, that based upon the testimony and evidence presented at the above
referenced public hearings, the Saint Paul City Council hereby adopts the following Findings and Order
concerning the Subject Property at 726 Geranium Avenue East:
That the Subject Property comprises a nuisance condition as defined in Saint Paul

parties to correct the deficiencies or to demolish and remove the building(s).
That Division of Code Enforcement has posted a placard on the Subject Property which
declares it to be a nuisance condition subject to demolition.
That this building has been routinely monitored by the Citizen Service Offices, Division
of Code Enforcement, VacantlNuisance Buildings.
That the Irnown interested parties and owners are as previously stated in this resolution
and that the notification requirements of Chapter 45 have been fulfilled.

The Saint Paul City Council hereby makes the following order:
The above referenced interested or responsible parties shall make the Subject Property safe and
not detrnnental to the public peace, health, safety and welfare and remove its blighting influence
on the community by rehabilitating this structure and correcting all deficiencies as prescribed in
the above referenced Order to Abate Nuisance Building(s) in accordance with all applicable
codes and ardinances, or in the alternative by demolishing and removing the structure in
accordance with all applicable codes and ordinances. The rehabilitation or demolition and
removal of the structure must be completed within after the date of the Council

1 Office, Division of Code Enforcement is hereby authorized to take whatever steps aze necessary

5 3. In the event the building is to be demolished and removed by the City of Saint Paul, all personal
6 property or fixtures of any kind which interfere with the demolition and removal shall be
7 removed from the properiy by the responsible parties by the end of this tune period. If all
8 personal property is not removed, it shall be considered to be abandoned and the City of Saint
9 Paul shall remove and dispose of such property as provided by law.

Hector Ponce de I,eon, owner, appeazed and stated he just purchased this property Aprii 1, 1994.
Chuck Votel reported this building has been vacant since 1997. There have been two summary
abatement notices issued to secure it. Recently, the registration fees and taJCes have been paid. Code
Enforcement esumates the cost to repair this building at $35,000; the cost to demolish, $6,000 to
$7,000. As of today, a code compliance inspection was obtained and a bond posted.
Gerry Strathman recommended the owner be given six months to complete the rehabilitation.
Hector Ponce de L,eon stated he was fine with this recommendafion. The house is almost done; the
electrical and plumbing need to be completed.
Resolution ordering the owner to remove or repair the building located at 918 Park Street. If
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Chuck Votel reported this building has been vacant since 1997. There has been one summary
abatement order issued to remove refuse and secure it. Taxation has placed an estimated market
value of $31,500 on the properiy. Recently, a code compliance inspection was completed. A bond
has not been posted. Code Enforcement esfimates the cost to repair this building at $30,000.
Gerry Strathman recommended six months to complete the rehabilitation on condition that a$2,000
bond is posted by noon of April 28, 1999.
805 Central Avenue West (This item is continued from earlier.)
Chuck Votel reported a series of orders were issued going back to August and September 1998. A
summary abatement ordet was issued on November 24 to remove refuse from the yazd. An extension
was granted. A work order was issued January 8, and on that day the city removed a pile of rehab
debris on the west side of the garage, tires and styrofoam from the south side of the garage. The total

bill to remove 4 yazds of refuse and two tires is $455. Mr. Votei stated he does not have the
videotape, but can bring it at a later date.
Gerry Suathman added the order at issue here is an abatement order dated September 24, 1998.

Mel Allen, owner, appeazed and stated he signed a contract with Panelcraft to install siding and do
additional work on the property. There was a problem with Panelcraft, and Mr. Allen filed suit
against them. His neigJibor was not satisfied with how fast the issue was being resolved. The
inspector continued to come to the property unannounced. Mr. Allen told the inspector he needed to
discuss things with Mr. Allen and not dictate when, where, and how much time Mr. Allen needed to
resolve issues with the properiy. He also told the inspector he would try to meet the deadline given.
Mr. Allen did not meet that deadline, and the inspector removed the materials from the yazd. The
records show that Styrofoam was removed; however, it was actually foam insulation for the house.
Also removed was oak and a fixture to be re-enameled. The debris was stacked in an orderiy fashion.
There was no fire hazazd.
Gerry Strathman stated an extension was given to 7anuary. Mel Allen responded he told the
inspector that he was in negotiations with Panelcraft. Once the lawsuit was settled, a contractor
would install siding, and Mr. Allen would not have to pay for a 2° and 3` removal of debris.
Paneicraft left debris in his yud for 6 weeks. Mr. Allen paid almost $500 for a dumpster. Mr. Allen
stated he is not going to gay $SQO for this assessment when he already toid the inspector he was not
going to remove any debris on the property until after the siding issue was resolved. When the
pernut was pulled to do the work, a year was given to finish the work on the property.
Gerry Strathman stated the owner is not allowed to store building materials outside under city
ordinance. There are alternatives, such as putting the materials in the garage. Mel Allen responded if
the inspector had said this was going to be an issue, Mr. Allen would have put the materials in the
garage. He was not storing it. The siding has been completed. He is wiliing to sue the city over this
abatement because he is not going to pay it.
Chuck Votel stated he did not have the current worksheet with him.
Gerry Strathman recommended laying over this matter to the June 1, 1999, I.egislative Heazing citing
he needs to view the videotape.

Hector Ponce de I,eon, owner, appeazed and stated he just purchased this property Aprii 1, 1994.
Chuck Votel reported this building has been vacant since 1997. There have been two summary
abatement notices issued to secure it. Recently, the registration fees and taJCes have been paid. Code
Enforcement esumates the cost to repair this building at $35,000; the cost to demolish, $6,000 to
$7,000. As of today, a code compliance inspection was obtained and a bond posted.
Gerry Strathman recommended the owner be given six months to complete the rehabilitation.
Hector Ponce de L,eon stated he was fine with this recommendafion. The house is almost done; the
electrical and plumbing need to be completed.
Resolution ordering the owner to remove or repair the building located at 918 Park Street. If
the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Chuck Votel reported this building has been vacant since 1997. There has been one summary
abatement order issued to remove refuse and secure it. Taxation has placed an estimated market
value of $31,500 on the properiy. Recently, a code compliance inspection was completed. A bond
has not been posted. Code Enforcement esfimates the cost to repair this building at $30,000.
Gerry Strathman recommended six months to complete the rehabilitation on condition that a$2,000
bond is posted by noon of April 28, 1999.
805 Central Avenue West (This item is continued from earlier.)
Chuck Votel reported a series of orders were issued going back to August and September 1998. A
summary abatement ordet was issued on November 24 to remove refuse from the yazd. An extension
was granted. A work order was issued January 8, and on that day the city removed a pile of rehab
debris on the west side of the garage, tires and styrofoam from the south side of the garage. The total

bill to remove 4 yazds of refuse and two tires is $455. Mr. Votei stated he does not have the
videotape, but can bring it at a later date.
Gerry Suathman added the order at issue here is an abatement order dated September 24, 1998.

Mel Allen, owner, appeazed and stated he signed a contract with Panelcraft to install siding and do
additional work on the property. There was a problem with Panelcraft, and Mr. Allen filed suit
against them. His neigJibor was not satisfied with how fast the issue was being resolved. The
inspector continued to come to the property unannounced. Mr. Allen told the inspector he needed to
discuss things with Mr. Allen and not dictate when, where, and how much time Mr. Allen needed to
resolve issues with the properiy. He also told the inspector he would try to meet the deadline given.
Mr. Allen did not meet that deadline, and the inspector removed the materials from the yazd. The
records show that Styrofoam was removed; however, it was actually foam insulation for the house.
Also removed was oak and a fixture to be re-enameled. The debris was stacked in an orderiy fashion.
There was no fire hazazd.
Gerry Strathman stated an extension was given to 7anuary. Mel Allen responded he told the
inspector that he was in negotiations with Panelcraft. Once the lawsuit was settled, a contractor
would install siding, and Mr. Allen would not have to pay for a 2° and 3` removal of debris.
Paneicraft left debris in his yud for 6 weeks. Mr. Allen paid almost $500 for a dumpster. Mr. Allen
stated he is not going to gay $SQO for this assessment when he already toid the inspector he was not
going to remove any debris on the property until after the siding issue was resolved. When the
pernut was pulled to do the work, a year was given to finish the work on the property.
Gerry Strathman stated the owner is not allowed to store building materials outside under city
ordinance. There are alternatives, such as putting the materials in the garage. Mel Allen responded if
the inspector had said this was going to be an issue, Mr. Allen would have put the materials in the
garage. He was not storing it. The siding has been completed. He is wiliing to sue the city over this
abatement because he is not going to pay it.
Chuck Votel stated he did not have the current worksheet with him.
Gerry Strathman recommended laying over this matter to the June 1, 1999, I.egislative Heazing citing
he needs to view the videotape.

Inasmuch as this Order to Abate has not been complied with the nuisance condition remains unabated, the
community continues to suffer the blighting influence of this property. It is the recommendation of the
Division of Code Enforcement that the City Council pass a resolution orderin� the responsible parties to
either repair, or demolish and remove this building in a timely manner, and failing that, authorize the
Division of Code Enforcement to proceedto demolition and removal, and to assess the costs incurred against
the real estate as a special assessment to be coilected in the same manner as taxes.

Hector Ponce de I,eon, owner, appeazed and stated he just purchased this property Aprii 1, 1994.
Chuck Votel reported this building has been vacant since 1997. There have been two summary
abatement notices issued to secure it. Recently, the registration fees and taJCes have been paid. Code
Enforcement esumates the cost to repair this building at $35,000; the cost to demolish, $6,000 to
$7,000. As of today, a code compliance inspection was obtained and a bond posted.
Gerry Strathman recommended the owner be given six months to complete the rehabilitation.
Hector Ponce de L,eon stated he was fine with this recommendafion. The house is almost done; the
electrical and plumbing need to be completed.

the owner fails to comply with the resolution, Code Enforcement is ordered to remove the
building.
Chuck Votel reported this building has been vacant since 1997. There has been one summary
abatement order issued to remove refuse and secure it. Taxation has placed an estimated market
value of $31,500 on the properiy. Recently, a code compliance inspection was completed. A bond
has not been posted. Code Enforcement esfimates the cost to repair this building at $30,000.
Gerry Strathman recommended six months to complete the rehabilitation on condition that a$2,000
bond is posted by noon of April 28, 1999.
805 Central Avenue West (This item is continued from earlier.)
Chuck Votel reported a series of orders were issued going back to August and September 1998. A
summary abatement ordet was issued on November 24 to remove refuse from the yazd. An extension
was granted. A work order was issued January 8, and on that day the city removed a pile of rehab
debris on the west side of the garage, tires and styrofoam from the south side of the garage. The total

bill to remove 4 yazds of refuse and two tires is $455. Mr. Votei stated he does not have the
videotape, but can bring it at a later date.
Gerry Suathman added the order at issue here is an abatement order dated September 24, 1998.

Mel Allen, owner, appeazed and stated he signed a contract with Panelcraft to install siding and do
additional work on the property. There was a problem with Panelcraft, and Mr. Allen filed suit
against them. His neigJibor was not satisfied with how fast the issue was being resolved. The
inspector continued to come to the property unannounced. Mr. Allen told the inspector he needed to
discuss things with Mr. Allen and not dictate when, where, and how much time Mr. Allen needed to
resolve issues with the properiy. He also told the inspector he would try to meet the deadline given.
Mr. Allen did not meet that deadline, and the inspector removed the materials from the yazd. The
records show that Styrofoam was removed; however, it was actually foam insulation for the house.
Also removed was oak and a fixture to be re-enameled. The debris was stacked in an orderiy fashion.
There was no fire hazazd.
Gerry Strathman stated an extension was given to 7anuary. Mel Allen responded he told the
inspector that he was in negotiations with Panelcraft. Once the lawsuit was settled, a contractor
would install siding, and Mr. Allen would not have to pay for a 2° and 3` removal of debris.
Paneicraft left debris in his yud for 6 weeks. Mr. Allen paid almost $500 for a dumpster. Mr. Allen
stated he is not going to gay $SQO for this assessment when he already toid the inspector he was not
going to remove any debris on the property until after the siding issue was resolved. When the
pernut was pulled to do the work, a year was given to finish the work on the property.
Gerry Strathman stated the owner is not allowed to store building materials outside under city
ordinance. There are alternatives, such as putting the materials in the garage. Mel Allen responded if
the inspector had said this was going to be an issue, Mr. Allen would have put the materials in the
garage. He was not storing it. The siding has been completed. He is wiliing to sue the city over this
abatement because he is not going to pay it.
Chuck Votel stated he did not have the current worksheet with him.
Gerry Strathman recommended laying over this matter to the June 1, 1999, I.egislative Heazing citing
he needs to view the videotape.
