The first item—no electricity and water—has been taken care of. He is particularly concerned about Item 2, which is a broken guazdrail on the second floor. Thomas Zachary, owner, appeared and stated he received a correction notice dated December 9, 1998, to turn on the electracity and the water by December 11. When the electricity and water were restored, David Weisberg added additional items to the December 14 condemnafion notice. Mr. Zachary feels these additional violations do not constitute making a building unfit for human habitation. Gerry Strathman asked about the general condition of the building. David Weisberg responded he has received complaints about this building, particularly that the interior is grossly unsanitary, however, he has not been able to confirm it. Thomas Zachary stated it concerns him that people are peeking inside his house. Gerty Strathman asked was the building unoccupied and the plans for the building. Thomas Zachary responded he is living there. He teaches at the Saint Paul Area I.earning Center on Dale and University. His belief is that he should live in the neighborhood where he teaches. If the City continues to hazass him, he will live elsewhere. Gerry Strathman stated the correction nouce of December 9 only mentions electricity and water, which have been restored. This leaves the condemnation notice of December 14. While Items 3 through 7 holes in the soffits, missing storm windows, torn and missing screens, broken windows on the garage, garage vehicle door not secured—may not be the basis for condemning a property as unfit for human habitation, they are things under the Saint Paul Property Code that need to be corrected. Mr. Strathman asked for specific correction dates on these items. Thomas Zachary responded one of his students will do the storm windows. Mr. Zachary will find out which screens are torn. He will have someone bid on the holes in the soffit, which may not be repaired until spring. The guardrail will be fixed by April L However, the guardrail is not a condemnaUon item; only items that threaten the structure are condemnation issues. Mr. Strathman stated he would like to see the guardrail fixed sooner than April 1. A second story guazdrail is a life safety issue, and it goes directly to the safety and habitability of the building. Mr. Zachary responded that he missed that appointment because he assisted with a situation at his school in which some students were assaulted. Thomas Zachary stated he had asked for a different building inspector, preferably an African American inspector. Geiry Suathman responded the assignment of building inspectors is done by the administration and is out of Mr. Suathman's authority.
