WHEREAS , the City has implemented a 10 year sewer separation
program to abate pollution caused ; by combined sewer overflow '
as a condition of the City' s National Pollutant Discharge E�.imi-
nation System (NPDE5) and State Disposal System (SDS) Permit
Number 0025470, ar�d;

WHEREAS , an effective sewer separation program requires
the removal of inflow sources to sanitary sewer system, and;
WHEREAS , building rainleaders (roof drains) that are con- '
nected to the City' s sanitary or combined sewer system are
a major source of system inflow and a cause of combined sewer
over�low, combined sewage flooding of streets and combined
sewage backup into basements , and;
WHEREAS , federal and state governments are provi:d�ng grants
and low interest loans to help fund the City' s sewer separatior_
program and under Minnesota Statutes 116. 162 , Sec�ion 3 , Subd.
7 , rainleader disconnection is required, and;

WHEREAS , the Council of the City of Saint Paul on February
11 , 1986 adopted a Rainleader Disconnect Plan (Council File
No. 86-162) which incorporates incentives and voluntary compliance
by the citizens of Saint Paul for 1986 and 1987 with required
compliance after December 31 , 1987 , and;
WHEREAS , the City implemented several programs to assis'�
property owners to accomplish disconnections including a Rain-
leader Rebate Program and the Residential Rainleader Assistance
Program, now, therefore;

Section l .
' That Sections 41 .02 and 41 .03 of the Saint Paul Legislative
Code be and are hereby repealed, and that Section 41 .04 be
renumbered as Section 41 .02.
Section 2.
That Chapter 41 of the Saint Paul Legislative Code be
and is hereby amended so as to add the following thereto:
41 .03. Disconnection of Stormwater and Clearwater Connections.
Rainleaders and other connections for stormwater and clear-
water (as defined in section 76. 26) from all buildings
and premises which buildings and premises are connected
directly or indirectly to the public combined or sanitary
sewer, shall be disconnected from the combined or sanitary
sewer system no later than December 31 , 1987 . Al1 rain-
leader downspouts shall drain to the back and/or to the
front roof lines with no downspouts to be allowed in the
existing side yards where two adjacent homes are separated
by 10 feet or less. An extension of time to comply with
this ordinance may be granted by the Director of the Public
Works Department upon application of the affected property
owner, and upon the Director ' s determination that the
disconnection is not prudent nor feasible .
If an extension of time is granted by the director, the
property will be billed an annual charge for the stormwater
entering the sewer system through the rainleader or other
connection. The annual charge for one and two family
buildings shall be the current "Sewer Service Charges"
rate for the first 100 cubic feet of water consumption
(as established by the City Council pursuant to section
77 .02) multiplied by the factor of 25. The annual charge
for all other buildings or premises shall be the current
"Sewer Service Charges" rate for the first 100 cubic feet
of water consumption multiplied by the factor of 0. 025
and the product thereof multiplied by the number of square
feet of the building roof area and/or ground area con-
tributing rain water to the public sanitary or combined
sewer system. The annual charge shall be added to the
water bills for the properties and collected with and
in addition to the water charges for water services.

� Introduction
' A survey conducted in the fall of 1985 identified over 17,000 homes and an estimated
3,000 commercial and industrial buildings that have rainleaders (downspouts)
, connected to the sanitary sewer system. During periods of moderate to heavy rainfall
stormwater from thousands of rainleaders overtax the sanitary sewer system
contributing to basement backups and the dischazge of raw,untreated sewage directly
' into the Mississippi River. To conect this problem,the City of Saint Paul has
implemented its Rainleader Disconnect Plan with an objective of removing 95% of
the connected rainleaders from the sanitary sewer system by December 31, 1987.
, There are about 5,000 homes owned by persons with low incomes that have
rainleaders connected to the sanitary sewer. Because the cost of disconnecting
� rainleaders on a typical house by a contractor generally ranges from $100.00 to
$150.00,this expenditure would be a hardship for those homeowners. Recognizing
this, the Residential Rainleader Assistance Program (RRAP) was developed.

disconnect rainleaders on homes owned or occupied by persons with low to moderate
� incomes. Persons hired for this program will receive salaries from state and federal
work programs. Tools,materials, and vehicles will be funded from a$50,000.00
' Communiry Development Block grant. The Public Works Department will provide a
program supervisor and any needed on-the-job training. Properties having their
ramleaders disconnected under this program will not be eligible for the $40.00 rebate
� under the current Rainleader Disconnect Program because the rebate is an incentive
to offset the disconnection costs to the property owner and those assisted by this
program will not have those expenses. Instead,the funds will be recycled back
� into the program.

1 Rainleader Disconnection Criteriac
, After a homeowner is determined to be eligible for a rainleader disconnection under
the RRAP program,the property will be reviewed by a field investigator. The review
� will be initially done by a Sewer Division employee. As the requests grow in number,
it is proposed that individuals from the MN Employment&Economic Development
(MEED)program will be trained to do the review under the supervision of the

The supervisor will review it and if he concurs,the property will not be included in
this program, although it is possible that a partial rainleader disconnect�on could be
' done. If the property satisfies the above listed criteria,the homeowner shall be
consulted as to the type of disconnection he or she wants. The types of disconnection
are described on the next page. This information will be relayed to the foreman for

� Method to Organize RRAP Crews
' Crews will be provided by and paid for through PED Job Creation(1V�ED and
Summer Youth Programs). Jacqui Shoholm and the program supervisor(from Sewer
' Division)will interview and select workers and foremen. We will begin the program
with 2 crews consisting of 4 workers. As the program gets underway,additional crews
may be hired if the response warrants it.
, Training will be the responsibiliry of the program supervisor It will be"on-the job"
training and will include instruction on the proper way to disconnect the rainleader,
/ what to look for in terms of drainage,what to do in case of unusual problems, safety
practices and the importance of projecting a positive image of the City.
, After a house has been disconnected,it will be the responsibility of the foreman to
inspect the work to make sure it was done correctly.
' The program supervisor may fire a worker that was hired under PED Job Creation for
failing to report for work,unsadsfactory performance or other good cause.

' Financing Plan
, There is a$50,000.00 Community Development Block Grant available to get the
program underway(see the last page of this report). The grant's project summary
� states"... This program will provide partial reimbursement to homeowners and
landlords who disconnect their rainleaders from the sanitary sewer system. Single
family units must be low/mod,and multi-family units must be occupied by at least 51%
' low/mod income persons."
The CDB grant will be used to purchase tools, supplies, and rental of vehicles. Once
1 the program gets underway, monies from the Sewer Service Fund that were
eannazked for rebates (for those homes disconnected under the RRAP program)will
be transfered back into the program. This will allow the maximum number of
, qualified homes to be disconnected.
Salaries for the foremen, crew chiefs and workers will be paid by PED Job Creation
, through Minnesota Employment and Economic Development(MEED)and the
Summer Youth Program. The salary of the program supervisor will charged to the
Sewer Service Fund.

' Liability
' The City of Saint Paul is open to liability from three azeas: workers injuring
themselves or others,property damage from careless work habits or improper
disconnections, and civil suites arising from injuries due to the disconnection causing
' an unsafe condition to exist.The liability risk will always be present but will be
minimized by the cazeful hiring of foremen and workers, and by having a responsible
program supervisor who will be able to identify problem areas that surface in the
disconnection process. In addition, standard disconnection methods and drawings will
' be developed. If the proposed disconnection does not conform to one of those
standards, the disconnection on that rainleader will not be done and the homeowner
' will be refered to the Citywide Rehabilitation Program where eligible homeowners
may receive a no-interest deferred loan.

It is anticipated that this program will experience a high turnover of workers because
� of the salaries offered,nature of the work and other factors.To compensate, we will be
