City of Saint Paul Our File 585-0673 Plaintiff Muriel Pavlick fell on August 14 , 1985, on the north- side of East Third Street between Germain and Hazelwood just south of the Harding High School football field. She claims her fall was the result of a pipe sticking up through the sidewalk. Our investigation disclosed that the pipe was part of a stopbox in- stalled by the Water Utility before Third Street was paved in 1959 to provide water service to vacated properties. The plain- tiff ' s claim is against the City of Saint Paul and the Water Utility. The City of Saint Paul received at least two complaints from the general public about the pipe sticking up through the sidewalk. On November l, 1983 , a Public Works employee burned off several of the pipes . It appears that frost action may have pushed the pipe up through the sidewalk. The plaintiff suffered a fracture of her right elbow which required the surgicial removal of the radial head. Her attending physician finds she has a 25-30 per cent permanent partial disability. She was employed as a housekeeper, earning approximately $105 per week and her ability to return to that occupation has been limited. Her medical expenses are approximately $2 , 750 . The plaintiff ' s claim has been settled in the total amount of $15, 000 . The Broad of Water Commissioners of the City of Saint Paul previously aqreed to contribute on an equal basis and the City' s contribution is therefore $7 , 500 . Pursuant to Minnesota Statutes, Section 410. 12, Subdivision 7 , and upon recommendation of the Chart�r Commission of the City of Saint Paul, Section 12.04.1 of the Charter of the City of Sai�t Paul is amended to read as follows: "Section 12.04.1 . Hearing of grievances. The civil service rules shall include provisions estab- � lishing a formal procedure for the review of employee grievancss not covered under labor agreements. After exhausting the formal grievance procedure, the com- . _ pl.aining employee may petition the civil service commission for a hearing and the commission shall, --- � within a reasonable time, conduct a hear�ing at which all parties to the grievance or their representatives may be heard. The commission shall have the power to issue subpoenas and to administer oaths and to compel the atte�dance and testimony of witnesses and the producti�n of books and papers relevant to the grievanc�. The commission may make complaint to the district court of disobedience of its subpoena or orders under this section. Following the hearing, the commission shall promptly rule on the grievance petition. Its decision shall have such binding effect as the civil service rules prescribe."
