WHEREAS, the Board of Water Commissioners of the City of Saint
Paul plan to provide water service to the City of Maplewood which
necessitatea the acquisition of certain easements crossing portions of
public right-of-way owned by the City of Saint Paul located on Furness
Parkwayf and
WHEREAS, the City of Saint Paul, Division of Parks and Recreation
has no objection to the conveyance of these easements to the Board of
Water of Commissioners; and
WHEREAS, the Board of Water Commissioners of the City of Saint
Paul and the City of Saint Paul Division of Parks and Recreation have
agreed to certain terms and conditions for the conveyance of these
easements. The description of the easements and the terms and
conditions agreed upon are set forth as follows:
DESCRIPTION OF EASEMSNTS
I . Permanent easement No. 6 for water main construction and
maintenance over , under and across the following described
property:
Lot 1, Block 3, Furness Garden Lots Rarasey County,
Minnesota
The centerline of said easement is described as follows:
Beginning at a point, Point "A" on the north line
80.0 feet east of the northwest corner of Lot 1,
Block 3, Furness Garden Lots; thence south, parallel
to the west line of said lot a distance of 20.0 feet
to Point "B"; thence deflecting to the left 10

II . A permanent easement No. 7 for water main construction and
maintenance over , under and across the following described
property:
Furness Parkway right-of-way lying in the N£ 1/4 of
Section 23 , township 29, Range 22, Ramsey County,
Minnesota .
The centerline of said easement is described as follows:
Beginning at a point, Point "A", on the north line 80.0
feet east of the northwest corner of Lot 1, Block 3,
Furness Garden Lots; thence south, parallel to the west
line of said Lot A distance of 20.0 feet to Point "B";
thence deflecting to the left 10 degrees 06 minutes 53
seconds a distance of 323.22 feet to Point "C"; thence
deflecting to the right 45 degrees 36 minutes 29 seconds
a distance of 320.63 feet to Point "D"; thence deflecting
to the left 53 degrees 00 minutes 00 seconds a distance
of 50 feet more or less to a point on the north line 30.0
feet west of the northeast corner of Lot 3 , Block 5,
Furness Garden Lots to Point "E" and there terminating.
Said permanent easement being a strip of land 30 feet in width,
15 feet on each side of said centerline .
and together with temporary construction easements being
a strip of land 20 feet in width lying east of and
adjoining said permanent easement between Point "A"
Point "B" and Point "C", together with a strip of land 5
feet in width lying east of and adjoining said permanent
easement and a strip of land 20 feet in width lying west

Point "E". The side lines of said temporary easements
are to be lengthened or shortened to intersect at all
angle points on said centerline .
III . A permanent easement No. 8 for water main construction and
maintenance over , under and across the northerly 15 . 0 feet of the
easterly 115.0 feet of Lot 1 , Block 3, Furness Garden Lots,
Ramsey County, Minnesota.
TERMS AND CONDITIONS
1) The above described temporary easements shall expire December 31,
1987. All of the above easements are highlighted on drawing
designated File �86217 by Short, Elliott, Hendrickson, Inc. dated
September 26 , 1986 , which is attached hereto and made a part
thereof .
2) The easements herein described shall be conveyed by quit claim
deed to the Board of Water Commissioners.
3) The cost of operation, repairs , and all maintenance of the water
main located within the easement areas described herein shall be
the responsibility of the Board of Water Commissioners.
4) The permanent easement areas as described herein shall
automatically revert back to the City of Saint Paul at no cost,
when the water main is abandoned.

5) The Board of Water Commissioners shall pay to the City of Saint
Paul a sum of $ 9 , 879. 00 as payment for the permanent and
temporary easements described herein and such payment shall be
paid within 30 days of the City Council' s approval of the
resolution.
6) Once the installation and construction of the water main is
completed, the easement areas herein described shall be re-
landscaped to their condition prior to the installation and
construction of the water main. The Board of Water Commissioners
shall obtain written approval from the Division of Parks and
Recreation for both the re-landscaping plan and the completed
installation of the landscaping .
7) That the Board of Water Commissioners shall notify the Division
of Parks and Recreation of all routine maintenance within the
described easement area prior to commencement of the work.
8) The compensation received by the City for the easements shall be
dedicated for Park and Recreation purposes.
NOW, THEREFORS BE IT RESOLVED, that the proper City Officials are
hereby authorized and directed to convey by Quit Claim Deed permanent
water easements including temporary construction easements all
described in this resolution and subject to the above conditions.
