WHEREAS, the City's Planning Department issued a Special
Condition Use Permit allowing a community residential facility at
1636 W. Minnehaha for teenage boys who are sexually abused and/or
sex offenders; and
WHEREAS, the Midway area neighbors have appealed the
Planning Department's actions to the Planning Commission; and
WHEREAS, the Planning Commission will be holding a public
hearing on the appeal within a few weeks; and
WHEREAS, the neighborhood appeal is based on several grounds
including 1) there already is another community residential
facility within a quarter mile of 1636 W. Minnehaha, 2) mixing
youthful sex offenders with the sexually abused children is ill-
advised, and 3) this type of facility is inappropriate for a
residential neighborhood so close to an elementary school,
recreation center, public library and housing for the elderly;
and
WHEREAS, the owner of 1636 W. Minnehaha, Leo J. McCormick
has applied with the Saint Paul License Division for a Class I
Room and Board License for this community residential facility;
and
WHEREAS, the Saint P��:i Legislative Code authorizes the
License Inspector to issue Class I licenses; and
WHEREAS, despite the License Inspector's authority to issue
Class I Licenses, the Saint Paul City Council has occasionally
held public hearings prior to the issuance of a Class I License;
and

WHEREAS, the neighbors have asked for a City Council public
hearing before action is taken on the Class I Room and Board
License;
THEREFORE, BE IT RESOLVED, that the City Council directs the
License Inspector to schedule a City Council public hearing with
proper public notice in order for the Council to be able to
review the merits of the Room and Board License application in
light of the Planning Commission appeal and the issues raised by
the Midway neighbors.

This is to let you know I have submitted a Council resolution to
the City Clerk asking for a public hearing before any room and
board license is issued to the proposed McCormick Group Home at
1636 W. Minnehaha.
A copy of that resolution is enclosed. As you'll note from the
resolution, the special condition use permit has been appealed by �
the neighbors. The appeal will be before the Planning Commission
soon. •
The grounds for the PZanning Commission appeal are numerous.
However, the main points are (1) there already is another
community residential facility within a quarter mile of 1636 W.
" �finnehaha; (2) mixing youthful sex offenders with the sexually
abused children is ill-advised; and (3) this type of facility is
inappropriate for a residential neighborhood so close to an
elementary school, recreation center, public library and housing
for the elderly.
The resolution recognizes the authority of the License Inspector
to issue Room and Board Licenses since they are a Class I type
license. However, in view of the fact of the seriousness of the
situation and the pending zoning appeal, I will be asking the
Council to pass this special resolution so we would be able to
hold a public hearing before the room and board license
application is acted upon.
