TO: Members of the City Council FROM: Karla F. Hancock f' Assistant City Attorney DATE: January 21, 1987 RE: Claim against the City of Saint Paul by Irene Gustafson and Marvelyn Gustafson Upon the recommendation of this office, the plaintiff was offered and accepted $1, 000 in settlement of her claims . In March 1972 , plaintiff Marvelyn Gustafson, age 13 , fell while skiing at Como Park on equipment rented by the City. Plaintiffs claim the equipment was defective and not adjusted properly and has expert testimony that cable bindings were unreasonably dangerous, outmoded and not state of the art in 1972 and should not have been rented in the first place. Plaintiff fractured both bonesin her lower leg and spent 4-6 months in a cast or on crutches. The orthopaedist treating her states " that she has a l0o permanent partial disability of the left lower limb with her left leg being 3/4 cro shorter than the other. Under all circumstances, the claim committee felt $1, 000 was an equitable settlement. KFH:paw enc. cc . Mayor ' s Office Edward Starr
