WHEREAS, Pursuant to Minnesota Statutes Sec. 462.357 and Sec. 64.400 of the
Saint Paul Legislative Code, Andrew Realty Corporation duly petitioned to
rezone 850 Arcade Street located on the east and west sides of Arcade Street
between York and the Burlington Northern Railroad tracks from I-2 and P-1 to a
Planned Development (PD) for the purpose of redeveloping the site as a mixed
commercial/industrial site, the petition having been certified by the Planning
Division on February 24, 1986 as having been consented to by at least 67% of
the owners of the area of the property to be rezoned, and further having been
consented to by at least two-thirds of the owners of the property situated
within 100 feet of the total continguous property within one year preceding
the date of the petition; and
WHEREAS, In accordance with the requirements of Section 60.730 of the Zoning
Ordinance, a preliminary plan was prepared and submitted depicting phased
development of the site including new construction of 15,000 square feet of
retail commercial space with parking and rehabilitation of an existing
industrial structure on that portion of the site lying west of Arcade Street
. as Phase I and mixed commercial industrial development on the east side of
Arcade Street as phase II of the project; and
WHEREAS, the proposal submitted by the petitioners meets the requirement of
Section 60.743 phasing of planned development in that the parcel is more than
5 acres in size, the proposed phases can operate independently from one
another, that the first phase constitutes 1/3 of the total proposed
development, and the entire PD can be developed within five (5) years; and
WHEREAS, the Zoning Committee on March 20, 1986 conducted a public hearing for
the purpose of considering the rezoning petition and pursuant to Section
107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, the Planning Commission has reviewed the preliminary plan and
rezoning petition at its meeting held on March 28, 1986 and recommended that
the City Council approve the petition; and

WHEREAS, Notice of a public hearing before the City Council on the Said
rezoning petition was duly published in the official newspaper of the City on
or before April 7, 1986 and notices were duly mailed to each owner of property
situated wholly or partly within 350 feet of the property sought to be
rezoned; and
WHEREAS, A public hearing before the City Council having been conducted on
April 17, 1986 where all interested persons were heard, and the Council
hearing considered all the facts and recommendations concerning the petition
and the preliminary plan;
NOW,THEREFORE, BE IT RESOLVED, that the Council of the City of Saint Paul
hereby approves the preliminary plan submitted for the planned development
district rezoning for 850 Arcade Street legally described as Lots 11-18,
Blk 39, Schumeiers Sub, vacated Weide St., Vacated Whitall , Lots 13-25, Blk
40, Weides Sub, Part of SE 1/4 of SE 1/4 of Section 29, Lots 1-4, Blk 40, Weides Sub,
Lots 1-12, C. Weides Sub of East 1/2 Blk 31 , and Lots 1-36, Blk 2, Williams
Re., Auditor's Subdivision No. 57.

Attached per your letter of request dated April 17, 1986 is a draft resolution approving the
preliminary Planned Development rezoning of property owned by Andrew Realty
Corporation. The public hearing on this matter was held by the City Council on April 17,
1986. This resolution has been held up awaiting the submission of approvable plans by the
Developer, and completion of the Developer's negotiated purchase of the Nalipinski property
situated at the southwest corner of York and Mendota.
Since the obligations of the Developer have now been met for this step, staff recommend
approval of this resolution.
