Return copy to: ' p } ' y� ,— Valuations - Room 218 Coun l RGS� GZ�/L (Resolution) (RM) ' / � �S Presented By Referred To �v��t�- �� Committee: Date �� '� Out of Committee By Date WHEREAS , the Council of the City of Saint Paul, by Council Resolution C.F. 251087 approved November 5, 1970 did vacate certain public right-of-way in the City of Saint Paul described as follows: That part of the east-west alley in Block 12, Dawson's Lake Como and Phalen Avenue Addition to the City of St. Paul, Ramsey Co., Minnesota, lying between Westminster Street and the easterly right-of-way line of Interstate Highway No. 35E WHEREAS , based upon utility easement certificates of Intended Non-Use filed voluntarily on behalf of Northern States Power Company, the Department of Public Works , the Water Utility, Western Union, District Heating and Development Company, and Northwestern Bell Telephone and made a part hereof by this reference and filed in the office of the City Clerk of Saint Paul, the City for itself and on behalf of these corporations and departments waives the right to utility easements in the vacated areas as described in the Certificates of Intended Non-Use. NOW THTREFORE BE IT RESOLVED, pursuant to Section 130.06 of the Saint Paul Legislative Code and on behalf of the City of Saint Paul and those persons for whom the City has reserved easements , the Council of the the City of Saint Paul does hereby waive and release the retained utility easements in the vacated public property as specified in the Certificates of Intended Non-Use; and BE IT FURTHER RESOLVED that upon passage of this resolution, the City Clerk is hereby authorized and directed to file a copy of this resolution for recording in the office of the Register of Deeds of Ramsey County, and shall maintain a copy of all Certificates of Intended Non-Use referenced in this resolution, on file in the office of the City Clerk. Recommended approval on 2-1 vote - Councilwoman Rettman votinq "NO". 2. 1/27/87 FINAL ORDER: Ueciding on constructing the SEVENTH/FRANK STREET AREA STORM SEWER PROJECT. Also improving parts of the followinq streets by constructinq concrete curb and � .yutter, bituminous paving, street lightinq syst.em and do all necessary work to complete said project: Ross, Bush, Reaney, Beech, Margaret, Frank, Duluth, Newcomb, Atlantic, East and West Johnson Parkway Service Road, and Clarence.
