WHEREAS, the Metropolitan Waste Control Commission condemned
easements 'for sewer purposes over land described in Exhibit "A"
attached hereto; and,
WHEREAS , the City of Saint Paul is named as an easement holder in
said condemnation; and,
WHEREAS, the Metropolitan Waste Control Commission and the City
of Saint Paul desire to enter into a settlement with respect to the
value of Easement Nos. 86-1, 72, 75 , without the necessity of a
commissioners ' hearing;
THEREFORE BE IT RESOLVED, that the Council of the City of Saint
Paul authorizes and directs the proper City officials to execute a
stipulation that the values to be paid by the Metropolitan Waste
Control Commission to the City of Saint Paul are fair and reasonable
as follows:
Value of easement no. 86-1 $15 ,368 .00
Value of easement no. 86-72 $12, 703. 00
Value of easement no. 86-75 $10 ,251.00
TOTAL $38, 322. 00
BE IT FURTHER RESOLVED, that said compensation shall be deposited

OF CERTAIN LANDS IN THE COUNTY OF RAMSEY,
STATE OF MINNESOTA
This Stipulation of Settlement is made and entered into this
day of , 198b , by and between the Metropolitan
Waste Control Commission (Petitioner) and the City of St. Paul,
Minnesota tCity) , Respondent in the above-captioned matter, either on
their own behalves, or by and between their respective attorneys as
follows :
WHEREAS, Petitioner has commenced this action to acquire through
eminent domain proceedings certain easements for the construction
and/or maintenance of a metropolitan se��er interceptor; and
WHEREAS, City is the fee owner of the properties on
which Easement No. 86-1, 86-72, 86-75, taken by the MWCC are located;
and
WHEREAS, Petitioner desires the Easements listed in the preceding
paragraph for use as a temporary and permanent easements for the
construction and maintenance of a sewer interceptor as more fully and
accurately described in Exhibit A, attached hereto; and
WHEREAS, pursuant to Order of the District Court dated
September 10, 1986 Petitioner has deposited with the Clerk oF Court

$38, 322. 00, its approved appraisal value for Easement Nos. 86-1, 72,
� 75. :
WHEREAS, Petitioner, and Owner desire to enter into a settlement
with respect to the value of Easement Nos. 86-1, 72, 75, without the
necessity of a commissioners ' hearing;
NOW, THEREFORE, it is hereby stipulated and agree3 by and between •
Petitioner, and Owner that:
1. The value to be paid for the easements described in
attached Exhibit A taken by the Petitioner is fair and reasonable.
2. The value of Easement Nos . 86-1, 72, 75, are as follows :
86-1, Fifteen thousand three hundred sixty-eight dollars t $15,368 . 00) ;
86-72, Twelve thousand seven hundred three dollars ( $12,703 . 00) ;
86-75, Ten thousand two hundred fifty-one dollars ( $10,251. 00 ) ;
3 . The amounts to be awarded by the Commission appointed by the
District Court pursuant to Petitioner' s Condemnation Case No. 478818
to the City as fair and reasonable value for its interest in the pro-
perties described in attached Exhibit A are as follows:
1) Parcel 86-1, Fifteen thousand three hundred sixty-eight
dollars ( $15 , 368 . 00 ) ;
Parcel 86-72, Twelve thousand seven hundred three dollars
( $12,703 .00 > ;
Parcel 86-75 , Ten thousand two hundred fifty-one dollars
( $10,251.00 ) ;
4 . Upon Owner signing this Stipulation of Settlement,
Petitioner shall pay the sum of Thirty eight Thousand Three Hundred
Twenty two and 00/100 Dollars ( $38, 322.00) by check directly to City
of St. Paul, as full, final and complete payment for Easement Nos.
86-1, 72, 75, as described in attached Exhibit A.

5 . Receipt by Owner of direct payment by Petitioner' s check for
the Easements described in the preceding paragraph s:�all be evidenced
by the Acknowledgment of Receipt executed by Owner and attached to
this Stipulation as Exhibit B.
6 . Payment of the principal sum of Thirty Eight Thousand Three
Hundred Twenty Two and 00/100 Dollars ( $38,322.00 ) plus accrued
interest held by the Clerk of District Court for Ramsey County shall
be made directly to the �Ietropolitan Waste Control Commission,
Petitioner, as full reimbursement for its direct payment by check to
Owner for Easements described in Paragraph 4 above.

2. 1/27/87 FINAL ORDER: Ueciding on constructinq the SEVENTH/FRANK
STREET AREA STORM SEWER PROJECT. Also improving parts of
the followinq streets by constructinq concrete curb and
� .yutter, bituminous pavinq, street liqhting system and do
all necessary work to complete said project: Ross, Bush,
� Reaney, Beech, Margaret, Frank, Duluth, Newcomb, Atlantic,
East and West Johnson Parkway Service Road, and Clarence.
Also constructing sanitary storm and water connections if
requested by the property owner. All to be known as the
SEVENTH/FRANK STREET AREA PAVING AND LIGHTING PROJECT.
Recommended approval on 3-0 vote with amendment that
service lane on Johnson Parkway be left at 1£i ft.
3. 1/27/87 FINAL ORDER: Decidinq on constructing the ARCADE/MINNEHAHA
AREA STORM SEWER PROJECT. Also improving the following
streets by constructinq concrete curbs and gutters,
bituminous p�viny, concrete driveways and outwalks, plant
trees and do all necessar�y work to complete said pro,ject:
Part of Sims, Frank, York, Mendota, Fa�aquier Place, Bush,
Weide, Reaney, Sinnen, Hope, Eichenwald, Maple, Marclaret,
Qellwood, and Greenbrier. Also constructinq sanitary
storm and water connections, if requested by the property
owners. All ta be known as the ARCADE/MINNEHAHA AREA
STREET PAVING AND LIGHTING PROJECT.
Recommended approval on 2-0 vote, Councilwoman Sonnen had
left meeting prior ta this discussion.
4. 1/27/87 FINAL ORDER: Condemninq and taking a temporary slope
easement in the raisinq and reconstruction of the alley in
Block 16, Fairview Addition (bounded t�y Jenks, Edqerton,
Case and Jessie) in con,junction with the PAYNE/ARCADE WEST
STURM SEWER PROJEC�f (order to be amended} .
Recommended approval on 3-0 vote with amendment to add to
the Final Qrder the words "chanqing grade".

5. 1/27/87 RATIF[CATION OF ASSESSMENTS: For qradinq and paving,
� construction of a sanitary sewer, storm water drainage
facilities, and an ornamental liqhtinq s.ystem. Also,
construction of sanitary service connections on BIRCH
Sl�REET from BONNIE LANE to BOXWOOD AVENUE and on BONNIE
LANE from the cul-de-sac west of BIRCH STREET. Also,
ratification of assessments for constructing a water main
and service connectians on E3irch Street and on Bonnie

6. 2/3/87 RATIFICATION UF ASSESSMENT5: For the construction of 2
