WHEREAS, the Metropolitan Waste Control Commission (MWCC)
is condemning easements for sewer purposes over parcels described in
Exhibit "A" attached hereto; and,
WHEREAS, the City of Saint Paul also holds easements for various
public purposes over portions of these same parcels; and,
WHEREAS , the easements proposed to be condemned by the
Metropolitan Waste Control Commission for sewer purposes do not
overlap or interfere with the easements owned by the City in these
same parcels; and,
WHEREAS, the Metropolitan Waste Control Commission and the City
of Saint Paul agree that there are no damages to any easements owned
by the City in these parcels.
THEREFORE BE IT RESOLVED, that the Council of the City of Saint
Paul authorizes the proper City officials to execute a Stipulation of
Settlement that the amounts awarded by the Metropolitan Waste Control
Commission to the City are fair and reasonable value for its interests
in the properties described in attached Exhibit "A" and are listed as
follows:
1) Easements for cuts, slopes and fills - zero dollars ($0)
2) Right-of-way easements - zero dollars ($0)
3) Sewer easements - zero dollars ($0)

OF CERTAIN LANDS IN THE COUNTY OF RAMSEY,
STATE OF MINNESOTA
This Stipulation of Settlement is made and entered into this
day of , 1986, by and between the Metropolitan
Waste Control Commission (Petitioner) and the City of St. Paul, ;
Minnesota (City) , Respondent in the above-captioned matter, either on
their own behalves, or by and between their respective attorneys as
follows:
WHEREAS, Petitioner has commenced this action to acquire through
eminent domain proceedings certain easements for the construction
and/or maintenance of a metropolitan sewer interceptor; and
WHEREAS, City is the holder of an easement for cuts, slopes, and
fills on the properties on which Easement Nos. 86-3, 6 , 8, 9, 10, 11,
12 , 13 , 33, 34, 35, 36, 39, 40, 41, 43 , 49, 52, 53, 54, 55, 76, 78,
79, 80, 81, 82, 83, 84, 85, 86, 87, 88, 89, 93, 94, 512, 514, 515,
517, 519, 520, 521, 522, 524, 525, 526, 527, 530, 532, 533, 536, 537,
541, 542, 543 , 546, 547, 548, 549, 550, 551, 553, 554, 598, 599, 600,
601, 602, 603, 604, 605, 606, 607, 608, 610, 611, 612, 613 , 614, 615
taken by the Petitioner are located (all of which are hereinafter
referred to as easements for cuts, slopes and fills) ;
WHEREAS, City is the holder of an easement for sewer and/or uti-
lity purposes on the properties on which Easement Nos. 86-1, 8, 11,
13, 14 , 15, 16, 24, 25, 30, 31, 32, 37, 38, 45, 46, 47, 48, 51, 52,
53, 54, 55, 56 , 57, 59, 68 taken by the Petitioner are located (all of
which are hereinafter referred to as sewer easements ) ;
WHEREAS, City is the holder of an easement for right of way

street widening and alley paving purposes on the properties on which
Easement Nos. 86-1, 59, 518, 595 taken by the Petitioner are located
(all of which are hereinafter referred to as right-of-way easements) ;
WHEREAS, Petitioner desires the Easements listed in the preceding
three paragraphs for use as temporary and permanent easements for the
construction and maintenance of a sewer interceptor as more fully and
accurately described in Exhibit A, attached hereto; and
WHEREAS, Petitioner, and Owner desire to enter into a settlement
with respect to the easements for cuts, slopes and fills, the sewer
easements and the right-of-way easements without the necessity of a
commissioners' hearing;
NOW, THEREFORE, it is hereby stipulated and agreed by and between
Petitioner, and Owner that:
1. Petitioner is not condemning any easement for cuts, slopes
and fills owned by the City of St. Paul, Minnesota.
2 . The City of St. Paul does not object to the taking by
Petitioner of the easements on properties on which City has an ease-
ment for cuts, slopes and fills as described in attached Exhibit A for
construction and maintenance of a metropolitan sewer interceptor.
3. Petitioner and City agree that there are no damages to the
easement for cuts, slopes and fills owned by the City of St. Paul on
properties described in attached Exhibit A as a result of taking by
Petitioner of easements as described on attached Exhibit A.
4. Petitioner is not condemning any right-of-way easement owned
by the City of St. Paul.
5. The City of St. Paul does not object to be taking by
Petitioner of the easements on properties on which City has a right-
of-way easement as described in attached Exhibits A for construction

and maintenance of a metropolitan sewer interceptor.
6 . Petitioner and City agree that there are no damages to the
right-of-way easements owned by the City of St. Paul on properties
described in attached Exhibit A as a result of taking by Petitioner of
easements as described on attached Exhibit A.
7. Petitioner is not condemning any sewer easement owned by the
City of St. Paul, Minnesota.
8 . The City does not object to the taking by Petitioner of the
easements on properties on which the City has a sewer easement as
� described in attached Exhibit A for construction and maintenance of a
metropolitan sewer interceptor.
9 . Petitioner and City agree that there are no damages to the
sewer easements owned by the City of St. Paul on properties described
in attached Exhibit A as a result of taking by Petitioner of easements
as described on attached Exhibit A.
10. Petitioner and City, have agreed by separate agreement that
City will convey to Petitioner its twenty-foot wide sewer easements
located on properties described in attached Exhibit A as 86-11, 12,
13, 14, 15, 16, 24, 25, 29, 30, 35, 36, 37, 38, 40,41, 42, 43, 45, 46,
47, 52, 54, 56, 57, 59 for one dollar and other good and valuable con-
sideration.
11. The amounts to be awarded by the Commission appointed by the
District Court pursuant to Petitioner' s Condemnation Case No. 478818
to the City as fair and reasonable value for its interests in the pro-
� perties described in attached Exhibit A are as follows:
1 ) Easements for cuts, slopes and fills - zero dollars ( $0)
2 ) Right-of-way easements - zero dollars ( $0 )
3) Sewer ,easements - zero dollars ($0)

vacation of COLUMBUS AVENUE between John Ireland Blvd. and
Wabasha Street for the purpose of landscaping improvement
to Capitol Grounds arPa.
Recommended approval on 2-1 vote - Councilwoman kettman
votinq "NO".
2. 1/27/87 FINAL ORDER: Ueciding on constructing the SEVENTH/FRANK
STREET AREA STORM SEWER PROJECT. Also improving parts of
the followinq streets bY constructinq concrete curb and
, .yutter, bituminous pavinU, street lighting system and do
all necessary work to complete said project: Ross, Bush,
Reaney, Beech, Margaret, Frank, Duluth, Newcomb, Atlantic,
East and West Johnson Parkway Service Road, and Clarence.
Also constructing sanitary storm and water connections if
requested by the property owner. All to be known as the
SEVENTH/FRANK 5TREET AREA PAVING AND LIGHTING PROJECT.
Recommended approval on 3-0 vote with amendment that
service lane on Johnson Parkway be left at 18 ft.
3. l/27/87 FINAL ORDER: Decidinq on constructinq the ARCADE/MINNEHAHA
AkEA STORM SEWER PROJECT. Also improvinq the following
streets by constructinq concrete curbs and qutt.ers,

trees and do all necessary work to complete said project:
