WHEREAS , the Sta�e has determined th�t there is justification and it is in the nublic' s best interest to remove the existing traffic control signal and install a new traffic control signal with street lights, emer�ency vehicle pre-emption, interconnect and signing on Trunk Highway No. 51 (Snelling Avenue) at Commonwealth Avenue - Midway Parkway; and WHEREAS, it is anticipated that the traffic control signa' with street lights, emergency vehicle pre-emption, interconnect and signing work is eligible for 76 , 74 percent Federal-aid Urban Funds; and WHEREAS , the installation of intercannect ( cables and conduit ) on Trunk Highway No. 51 (Snelling Avenue) at Commonwealth Avenue - Midway Parkway is a part of a six (6 ) intersection interconnzct systzm (cables, conduit and master controller and c�abinet) which also includes the intersections of Trunk Highway ::�. 51 (Snelling Avenue) at County State Aid Highway No. 56 (Hayt Avenue) - Hayt Avenue, County State Aid Highway No. 30 (Larpenteur ��venue } , County Road No. 114 (Roselawn Avenue) , Har Mar Shopping Center Entrance, and County State Aid Highway No. 25 (West County Road B) covered under Agreement No. 63319; and 63824 vu.� -1- �7- �`/ WHEREAS, the City r.equests and the State agzees to provide an Emergency Vehicle Pre-emption System, hereinafter referred to as the "EVP System" , as a part of the traffic cont�al signal with street lights and signing installation in accordance 4aith the terms and conditions hereinafter set forth; and WHEREAS, the materials, equipmen�, labor and miscellaneous items necessary to operate, maintain, revise and renove said EVF System sha�l be at the sole cost and expense of the City; and ti9HEREAS, the City ar.d State will participate in the cost, maintenance and oneration of the traffic control signal with street lights interconnect, signing, and EVP System as nereinafter set fort�.h� NOW, THEREEORL, IT IS AGREED AS F�LLOr�J�: 1. The State will prepare any n�cessary p3an, spec� �':ications and proposal and shall perfc�rm the engineering and inspec�ion require� to cemplete the items of work hereinafter set forth. Such work as described immediately above shall constitute "Engineering and Inspection" and shall be so referred ta hereina.fter . 2. The contract cost of the work or , if the work is n�.��t. contracted , the cost of all labor, materials , and equipment rental require�d to complete the work, except the cost of providing the power su��,?ly to the service po;_e or pad, shall constitute the actual "Construction Cost" and shall be so referred to nereinafter. . 63824 � -2- ��- 4s 3 . The State with its own forces an3 equipment or by c�ntract shall perfarm the traffic control signal work provided for under State Project No. 6215-61 and Federal Project No. M 5421 (b ) with the Construction Costs shared as follows: a. Trunk Highway No. 51 (Snelling Avenue ) at Commonwealth Avenue -- Midway Parkway. System "A" . Remove the existing and install a new traffic control signal with street lights and EVP System. Estimated Construction Cost is $86, 681. 00 which includes State furnished materials. Anticipated Federal-aid share is 7G . 74 percent. City' s share is 5. 81 percent. State ' s share is 17. 45 percent. b. Install interconnect (cables, conduit and master controller and cabinet) on Trunk Highway No. 51 (Snelling Avenue) from Commonwealth Avenue - Midway Parkway to County State Aid H �_ghway No. 25 (West County Road 8 ) . T'otal Estimated Construction Cost is $102,932 . 50 w:�ich includes Stat? furnished rnaterials. Anticipated Eederal-aid share is 76. 74 percent. City` s share is 0 . 97 percent. The State shall install or cause the installation of overhea�3 signing and shall maintain said signing aII at no cost to the City. 5. Upon execution of this agreement and a request in writing by the State, tr�=� City shall advance to the State an amount equal to its portion of the project cost. Th� City' s total bortion shall consist of the sum of the following : a. The City ' s share (as specitied in Paragraph 3 ) base� on the actual bid pr_ ice and th° estimated State furnished materials costs. b. Six ( 6 ) percent of its shar` (Item a. above) for the cost of Engineering and Inspection. f, . Upon final payment to the Contractor an� computation of the City' s share �or the work provided for herein, tha� amount of the funds advanced by the City in excess of the City ' s share will be returned to ti�e City without interest and the City aqrees to pay to the State that amount of its share which is in excess of the amount of the funds advanc�d by the City. 7. The City shall pernetuate an adequate �lectrical pa-:�:>r supply to the s�rvice pad or pole, an3 upon comp3etion of �;::.id traffic control signal with street ligh'ts instalZation shall continue to provide necessary electrical power for its operation at the cost and expense ot the City. �h b38?.4 —4-- �� - �� 8 . Upon completion of the work contemplated in Paragraph 3 hereof, it shall be the City' s respansibility, at its cost and expense, to: ( 1 ) maintain the luminairies, ( 2.) relam� the traffic control signal and street lights, and (3 ) cl.ean and naint the traffic control signals, cabinet, and luminaire mast arm �xtensions. The State shall maintai.n the traffic signal cabine't and control equipment, repair knock�owns of the traffic control signal system, perform all other traffic control signal and street light maintenance, and is responsible for the timing and operation of the traffic control signal, all on a r�imbursable basis with thE City. 9. The State and tne City shall enter into a Tr.affic Control �ignal Maintena�nce Agreement No. 1890-R coverzng r.iaintenance of the traffic signal cabinet and control equipment, repa�.r of knockdowns of the traffic control signal s�stem, performance of all other traffic control signal and street light maintena�zce not performed by the City, and the responsibility for the timing and operation ot the traffic control signal by State Forces and the terms and condi�ions covering payment therefor by the City. 10. The EVP System provided for in Paragraph 3 hereof shall be installed, operated, maintained, revised or removed in accordance with the foilowing conditions and requirements : 63824 O -5- ��_ r9 a . All modifications, revisions and maintenance . of the EVP System considered necessary or d�sirable , for any reaso�, shall be done by State forces, or, upon concurrence in writing by th:�, Stst� ' s Traffic Engin4�r, may be don� by others all at the cost and expense of the City. b. Emitter units may be installec� and used only on v�hicl?s responding to an emergency as detined in Minnesota Statutes Chapter 169 .01 , Subdivision 5 and 169 . 03o The City will provide the State' s District Engineer or his , duly appointed repr.esentative a list of all such vehicles with emitter units. co The City shall maintain and requir� others using th� EVP System to maintain a log showing the date , ti.me and type of emergency for each time tPie traffic signal covered hereby is actuat�d and controlled by the EVP S�stem, and that said logs shall. be mada available to the St_ate upon request. In the event said EVP System or campanents are, in the opinion of the State, being misused or the conditions set forth in Paragraph b. above are violated , and such misuse or violation continuzs after receipt by the City of written notice thereof from the State, the State shall remove th� EVP System. Upon removal of the EVP System pursuant to this Paragraph, the field wiring, cabinet wiring and other components shall became the property of the State. Al1 infrared detector heads and indicator lamps mounted external to the traffic signal cabinet �aill be returned ta the City. The detector receiver and any other assembly locatPd in the traffic control signal cabinet, which if removed will not affect the tr�ffic control signal operation, will be returned to the City. e. Al1 timing of said EVP System shall be determined by the State through its Commissioner of Transportation. 11 . U�on proper execution by tne City and �tate, the E�:�P System for the traffic c�ontrol signal on Trunk Highway No. 51 : (Snelling Avenue ) at Commonwealth Avenue - Midway Parkway shall become a �art of �Signal Maintenance Agreement No. 2085-R between 63824 � -7- tu�:U , �� ��� the City and Stat2 covering opc�ration, revision, maintenance and " removal of EVP System by Stat� forces at the cost and expense of the City. 12 . Any and all pezsons engaged in the a�oresaid work to be performe:� by the State shaZl not be c<�nsidered emoloyeas of the City and any and all claims that may or might aris� under the Worker ' s Compensatian Act of this State on behalf of said employees while so engaged , and any and all claims made by any third party as a consequence of any act or o;nission on tne part of said employe2s while so engaged on any of the work contemplated herein shall not be th� obligation and responsibility of the City. The State shall not be resr�ansible under the ti�'orker ' s Co�pensation Act for any employees of t�e City. 13 .
