THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section l .
That Section 369.02 of the Saint Paul Legislative Code is
amended to add thereto the following:
(9) Fire Sprinkler installation and repair
Section 2.
That Section 369. 04, Subdivision 7 of the Saint Paul Legis-
lative Code is amended to read as follows :

Subdivision 7 . Iteciprocity , oil , gas , plumbing,
refrigeration, fire sprinkler and steamfitting. Any applicant for
an oil , gas , plumbing , refrigeration , fire s�rinkler or
steamfitting license presently holding a valid Niinneapolis
building trade business license which meets Saint Paul standards
for such license as shall be determined by the Board of Examiners
of both Minneapolis and Saint Paul, may carry on that business in
the City of Saint Paul upon registration of that license,
compliance with Section 370. 15 of this code , and payment of the
registration fee pursuant to Section 369.03 of this chapter;
provided that N; inneapolis reciprocates by accepting the
applicable Saint Paul license. If the division requires
corrections for work that has been done by a licensee operating
under this reciprocal arrangement and the licensee fails to make
the required corrections , such failure or lack of compliance may
be acted upon by the building official and all information
relative thereto rnay be forwarded to the City of Minneapolis
building offieial.
�xcept as specifically indicated in this section , all other
provisions of this chapter shall be applicab�e to licensees
operating under this reciprocal �rrangement .
Section 3
That Section 370 .02 of the Saint Paul Legislative Code is
amended so as to add the following subsection thereto:
( 10) Fire Sprinkler

That Section 370.06 of th� Saint Paul Legislative Code is
amended so as to �dd the following subsection thereto:

Section 5
That Section 370 . 15 Subdivision 3 of the Saint Paul
Legislative Code is amended to read as follows:
Subdivision 3 . Oil, Gas, 1'lumbing, Refrigeration, Pire Sprinkler
and Steamfitting. Any master or journeyman holding a valid
Minneapolis certificate of competency for oil, gas, plumbing,
refrigeration,fire sprinkler, or steam fitting tnay carry on that
oecupation as sueh master or journeyman in the City of Saint Paul
upon payment of the requisite fee, and registration of the
Minneapolis certificate of competency with the building official,
if it has been determined by the Board of Examiners of both
cities that the Minneapolis requirements for the certificate of
competency are equal to those of Saint Paul; provided that
Minneapolis reciprocates by accepting the applicable Saint Paul
competency card. Except as specifically indicated in this
section, all other provisions of this ehapter sha�l be applicable
to certificate holders who obtain their certificates under this
reciprocal arrangement.

That Section 370. 19 be added to the Saint Paul Legislative
Code and it is to read as follows:
370.19. Exception to examination for fire sprinkYer. Person�
firms or corporations who submit proof to the examining board
that the� have been activel� en�aged in fire sPrinkler
installstion either as master fire s�rinklerucontractors or
�ourneyman sprinkler fitters for a� ep riod of five years rior to
the effective date of this section , and who a��l� for
certificates of competency within six months after the effective
date of this section shall not be re�uired to compl� with the
provisions of this section which pertain to examination b� the
board of examiners or to �a� an examination fee� but shall be

On February 5th, you will have the opportunity to vote on an issue
that affects the ability of St. Paul residents to work in their
home city.
EXISTING CONDITIONS
The City of Minneapolis is the only city in Minnesota to have
a licensing law covering contractors and craftsmen who work at
the f ire sprinkler craf t.
St. Paul does not have an ordinance.
PENDING CONDITIIONS (State Legislation)
There is presently a bill for an act ready for submittal for
vote by our state legislature. It is reasonable to assume that
this bill will be acted upon during this legislative season.

This bill was drafted by an Ad Hoc Committee of labor, management,
and a public fire offical. It is a compromise of the interests
of the committee members . It is neutral and non-discriminatory
in its application and administration.
The best part of all is that the pending state bill provides
for a very high level of : .
a. Consumer Protection
b. Fublic Safety
The tragic loss of life and property, the changing building and
fire codes, and the high cost of public fire service all point
to a need for state wide laws. Laws governing the competency

of those firms and persons contracting, designing, and installing
fire protection systems.
Attached is a copy of the proposed state bill. As you can see,
it is tough. The public and private sector demands consumer
protection and public safety. THIS BILL DELIVERS.
ST. PAUL PROPOSAL
Certain individuals are attempting to push thru, for adoption,
a city wide ordinance under the guise of sanction by labor and
management. It is not representative of labor and management.
Who is this labor and management? Is it representative of the
industry?
� In 25 years of business as a technician, manager, and owner,
I was not allowed to sit in on any formative meetings. What
is being presented to St. Paul is a proposed ordinance that was
drafted in secret by a few select people, who are interested
in work preservation and restriction via discriminatory language.
It is not in the interest of consumer protection and public safety.
NECESSARY ACTION
Delay any ordinance adoption until we can see what the state
does. The current legislative session is only 120 days long.
If no activity comes out of this session then I urge you to adopt
the non-discriminatory ordinance similar to the state bill.
CONCLUSION
1 . The St. Paul ordinance, as proposed, is discriminatory
and restrictive in its intent. Major revisions will
have to be made.
2 . This contractor einploys residents of St. Paul. It is j
conceivable that the proposed ordinance would exclude ;
our craftsmen and apprentices from working in St. Paul. �`i I
It may be ok to live in St. Paul, spend money there, but % T px�s
not be able to work in a person s home town.
3 . This contractor employs apprentice craftspersons, who are i
registered in a U.S. Department of Labor approved craft
training program.
Is St. Paul ready to tell the U.S. Department of Labor that
it does not recognize its registered contractors and apprentices?

4 . This contractor is an EEO employer with a registered Affirm-
ative Action Program who has qualified minority apprentice
employees on the payroll.
5 . The City of Eagan, Minnesota, has just recinded all of its
existing contractor licensing requirements. It appears
that they will require that the mechanical and electrical
crafts furnish the applicable state license data when working
in that city, (copy attached) . Does the City of Eagan know
something that we don' t?
6 . Please wait a few short months. If the state fails to act,
then appoint a bi-partisan committee to jointly draft a
St. Paul ordinance that produces the required consumer
protection and public safety.

8 Section 1. [299J.01] [DEFINITIONS. ]
9 Subdivision 1. [SCOPE. ] For the purposes of this chaoter,
10 the following terms have the meanings qiven them in this section.
11 Subd. 2. (BOARD. ) "Board" means the Minnesota state board
12 of examiners for fire protection systems.
13 Subd. 3. [FIRE PROTECTION CONTRACTOR. ] "Fire protection
14 contractor" means a person who contracts to sell, design,
15 install, modify, alter, repair, maintain, or inspect a fire
16 �rotection system or its parts or related equipment.
17 Subd. 4. (FIRE PROTECTION SYS'TEM. ] "Fire protection system"
18 means dn automatic or manual suoervision svstem designed to
19 protect a structure or its occupants or contents from fire.
20 Subd. 5. (FITTER. ] "Fitter" means a person who installs or
21 suoervises another who installs a fire protection system or its
22 parts oc related equipment. .
23 Subd. 6. [FITTER'S ASSISTANT. J "Fitter's assistant" means
24 a person licensed under this chapter to work under the direct
25 supervision of a fitter.. r

9 Sec. 2. (299J.02) (BOARD CREATED. ]
10 The Minnesota board of examiners for fire orotection
11 systems is created.
12 Sec. 3. [299J.03J [BOARD MEMBERSHIP, OATH. J
13 The board consists of five members appointed for a term of
14 f:ve vears by the state fire marshal with the aooroval of the -
15 c�overnor. Two members of the board must be contractors or
16 full-time, managing employees actively enqaaed in a Eire
17 protection contractor's business. One member oE the boacd must
18 be Erom the bnildinq or fire departments of incorporated
19 municipalities oE Minnesota. Two members of the board must be
20 fitters licensed under this chapter, or iE initial appointees,
21 must become licensed within 120 days of appointment. The state
22 fire marshal or the marshal's designee is the permanent chait
23 and a r,onvoting member.
24 The qovernor shall issue a certificate of appointment to a
25 member. The member shall file with the secretary of state a
26 written oath or affirmation to faithfully discharge official
27 duties.
28 A member may be reappointed.

29 Sec. 4. [299J.04� [INITIAL TERiN; COMPENSATION, REMOVAL, 3
30 VACANCY. ]
31 Subdivision 1. (INITIAL TERM. J Notwithstanding section 3, �

32 initial appointments to the board must be made in such a manner
33 and period, not exceedina five years, that the term of each �i

34 member expire9 in a different year. After the appointment oE ,`i
35 the initial board members, Ehe term of a member is five years.

6 vacancy has occurred, the board may fill the vacancy until a new
7 member is aoproved and appointed.
8 Sec. 5. (299J.OSJ [LICENSE REQUIRED. J
9 Subdivision 1. (IN GENERAL. J A person shall not sell,
10 design, install, modifv, alter, repair, maintain, or make a
, 11 maintenance inspection, or offer to do so, unless licensed to
12 perform these duties or except as a registered professional
13 enaineer acting solely in a professional capacity.
14 Subd. 2. (FIRE PROTECTION CONTRACTOR. J (a) A �erson shall
15 not act, assume to act, or advertise as a fire protection
16 contractor without oossessing a license received under this
17 chaoter.
18 (b) A fice protection contractor may be required by a
19 municioality to ay fees normally im�osed for local permits and
20 to submit lans for review. However, a political subdivision of
21 the state shall not impose other requirements to prove
22 aualifications or financial responsibility other than the
23 �roduction of a license valid under this chapter.
24 Subd. 3. (FITTER. ] A person shall not undertake the
25 prescribed activities oE a fitter under this chaoter without a
26 valid license in possession.
27 Subd. 4. (FITTER'S ASSISTANT. J A pecson shall not
28 undertake the prescribed activities of a fitter's assistant
29 under this chapter without a valid license in possession.
30 Subd. 5. [RESPONSIBLE MAINTENANCE EMPLOYEE. ] A person
31 shall not undertake the prescribed activities of a responsible
32 maintenance employee under this chapter without a valid license
33 in possession. '.
34 Sec. 6. (299J.06] (EXAMINATION REQUIRED. j
35 Subdivision 1. (FIRE f�ROTECTION CONTRACTOR. ] To be
36 licensed as a fire protection contractor, a person must

13 examinations within this time period is not eliqible for renewal
14 of the temporary license.
15 Subd. 2. (FITTER. ] To be licensed as a fitter a person
16 must successfully complete a state-recoqnized aporenticeship
17 proaram, be certified as a iourneyman by that program, and
19 successfully complete, with a minimum score of 75 percent
19 correct answers, an examination approved by the boacd.
20 Subd. 3. [FITTER ASSISTANT. ] To be licensed as a Eitter
21 assistant, a oerson must have worked a minimum of 1,000 hours
22 under the temoorary license arovisions of section 7.
23 Subd. 4. (RESPONSIBLE MAINTENANCE EMPLOYEE. ] To be
24 licensed as a responsible maintenance emoloyee, a person must
25 successfully complete, with a minimum score of 75 percent
26 correct answers, an examination approved by the board. However,
27 a person previously licensed as a fitter is eligible foc a
26 responsible maintenance employee license, unless the fitter
29 license is revoked and the person is still not eliqible to apoly
30 for a license under the limits of section 12.
31 Sec. 7. [299J.07� (TEMPORARY LICENSE. J
32 Subdivision 1. (FIRE PROTECTION CONTRACTOR. J When an
33 application has been filed, on forms prescribed by the board,
34 the board may issue a temporary license, renewable annually, to ;
35 existing fire nrotection contractors who are actively engaged in .
36 that business on the effective date of sections 1 to 13. A

11 Subd. 3. [FITTER ASSISTANT. � A person who can demonstrate
12 the availability to that person of employment as a Eitter
13 assistant must be issued a temporary license until the
14 requiremencs of section 6 are fulfilled and a regular license is
15 issued.
16 Subd. 4. [RESPONSIBLE MAINTENANCE EMPLOYEE. j A oerson who
I7 is cercified bv an emnloyer as beinq regularly enqaged in
18 maintaininq the employer's fire protection system and who is a
19 bona fide employee of that employer must be issued a temporary
20 license until the requirements of section 6 are fulfilled and a
21 regular license is issued.
22 Sec. 8. (299J.08) (LICENSE DISPLAY, RENEWAL, DUPLICATE. )
23 Subdivision 1. �IN GENERAL. J Licenses are valid for a
24 period oE one year and expire December 31 of each year.

26 Subd. 2. [RENEWAL. ) A license that has not been suspended
27 or revoked, upon payment of the renewal fee prescribed, is
28 renewed for an additional period of one year from its expiration
29 on filing an application for renewal on forms prescribed by the
30 board. �.
31 Subd. 3. (DUPLICATE. ] A duplicate license must be issued
32 to replace a lost, destroyed, or mutilated license upon
33 application on a form prescribed by the board and the payment of
34 the fee prescribed A duplicate license must have the word .
35 "dunlicate" stamped on its 'face and must bear •the same number as
36 that on the license reolaced.

S Subd. 5. (FITTER'S LICENSE IN POSSESSION; SIGNATURE WITH
9 NUMBER. J Fitters shall carry their license on their person at
10 any time and place they are engaqed in activities of their
11 profession. A fitter is required to present the license on
1.2 request to the authority having �urisdiction. The fitter shall
13 afEix the license number to those certificates that require the
14 fitter's signature.

24 Sec. 10. [299J.10� (FINANCIAL RESPONSIBILITY. )
25 Subdivision 1. [HOND. ) The board shall require an
26 applicant who is a contractor to put up a suretv bond in an
27 amount not less than 510,000 executed by the applicant as
28 . principal and by a surety company authorized to do business in
29 Minnesota as a surety.
30 Subd. 2. [INSURANCE. ] Before a license as a fire
31 protection contractor is issued, the applicant must get and
32 maintain in force at all times a full-term, comprehensive, .
33 qeneral liability insurance policy from an insurance company
34 authorized to do business in Minnesota. The policy must have an
35 aggreqate limit of at least �5500,000. Evidence of insurance'
36 must be filed with the board.

` 2 Subdivision 1. [BOARD DETERMINATION. J Within 120 days
f 3 after an aoplicant has filed a complete application for a
4 license and paid the required fees, the board shall:
5 (1) conduct the testinq required under this chapter;
6 (2) conduct an investivation of. the applicant, limited to
7 the applicant's eliqibility; and
8 (3) either issue a license to the ap�licant, or notify the
9 applicant in writina by reqistered mail of the decision not to
10 grant the license and the reasons for the denial.
11 Subd. 2. [NOTICE OF HEARING. ] When application is denied,
12 the board shall s ecifically notify the applicant that the
13 a�licant has a right to a hearing conducted under section 13.
1C Sec. 12. [299J.12J (REVOCATION, SUSPENSION, RENEWAL. )
15 Subdivision 1. [CAUSES FOR REVOCATION OR SUSPENSION. ) The
16 board shall revoke a license, suspend the right. oE the license
17 holder to use a license, or refuse to renew a license issued
18 under this chapter, for any of the following causes:
19 �1) fraud, bad faith, misrepresentation, or bribery, either
20 in securinq a license or in conducting business under a license;_
21 (2) making a false statement about a material matter in an
22 apolication for a license; or
23 (3) failinq to maintain the requirements of the license.
24 Subd. 2. (TERM OF REVOCATION OR SIISPENSION. ) A license
25 must not be suspended for longer than two years. A person whose
26 license is revoked is eligible to apply for a license only after
27 the expiration of two years.
28 Sec. 13. (299J.13] [HEARINGS.1
29 When the board decides not to grant a license or not to
30 renew a license, it shall give adequate notice and, if
31 requested, provide a hearinq. Notice of the hearing must be
32 given in writing, by registered or certified mail with a return
33 receipt requested, at least 15 days before the hearing.
34 Sec. 14. [EFFECTIVE DATE. ]
35 Sections 1 to 13 are effective January 1, 1988.
