That Section 200. 06 of the Saint Paul Legislative Code is � amended as follows: - 200. 06. Running at large. The license holder, orvner or keeper of any canine shall be responsible for the effective restraint of said canine and shall not permit the canine to run at large. Any canine ahfch is not effectively contained Nithin a fenced area, or any canine �hich is on any unfenced area or lot abutting a street, alley, public park, public place or upon any other private land without being effectively restrained by chain or leash from moving beyond such unfenced area or lot, or any canine on any street, public park, school grounds or public place without being effectively restrained by chain or leash not exceeding six feet in length, shall be deemed to be running at large. Violation of this section shall be punished by a fine not to exceed 5100. Any person �rho is guilty of .a subsequent violation of this sectian within a period of one year of another violation of this section shall be punished by a fine of at lesst 550 but no more than 5100. Section 2. This ordinance shall take effect and be in force 30 days after its passage, approval, and publication. (Purpose/ Ratio�ale) : This amendment will provide better protection to the public. Electronic type dog fences--those which rely only on an electric shock to the dog--will be eliminated as acceptable means of restraint. They may be � used but the dog still must be restrainted by a leash, chain or conventional fence. We do not feel the electronic type fence would be an j effective barrier to a running dog. Also it would not prevent a pereon from coming into the area where the dog is confined. COST/BENEFIT, BUDGETARY AND PERSONNEL IMPACTS ANTICIPATED: The electronic type dog fence would make the enforcement of the Running at �` Large aection much more difficult. We feel it does not provide sufficient protection to the public. See attached memos from B.A. Fritz and Bill Gunther. We have drafted an amendment to the dog ordinance which would disallow the substitution of such devices for more traditional means of restraint. We feel it is important to incorporate this change into the ordinance as soon as possible to prevent the use of such devices from becoming established. Please review.
