Carolen Bailey, et al . Our File No. S88-0298 Dear Mr. Blees : In May, the City Council approved the appointment of the law firm of Popham, Haik, Schnobrich and Kaufman, Ltd. to represent St. Paul Police Officers Carolen Bailey, Richard Simmons and Cheryl Indehar in the above captioned action. As part of Council File No. 88-726, the 1988 Budget was amended to add $50, 000 to the City Attorney Outside Counsel Fund. The Popham, Haik firm successfully defended this action in Federal Court and we paid their fees which are approximately $40, 000 to date. Joseph Carchedi has now refiled his suit in Ramsey County District Court alleging a common law action for slander. I have prepared a new resolution appointing the Popham, Haik firm to represent the defendants in that action. I think it appropriate that an additional $15, 000 be transferred to the Outside Counsel Fund for legal fees which will be incurred to the end of the budget year.
