An ordinance amending Chapter 60 of the Saint Paul Legislative Code�
pertaining to zoning for the City of Saint Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, Emily Fredricksen duly petitioned to rezone 2029 Grand
Avenue located on the north side between Cleveland and Prior from RM-2 to B-2C
for the purpose of establishing an antique shop in a portion of the first
floor the petition having been certified by the Planning Division on August
12, 1988 as having been consented to by at least two-thirds of the owners of
the area of the property to be rezoned, and further having been consented to
by at least 67� of the owners of the property situated within 100 feet of the
total contiguous property within one year preceding the date of the petition;
and
WHEREAS, The Zoning Committee on September 15, 1988 conducted a public hearing
for the purpose of considering the rezoning petition, and pursuant to Section
107.03 of the Administrative Code, submitted its reco�nendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on September 23, 1988 and recommended that the City Council
approve the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 1 , 1988 and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the
property sought to be rezoned; and

Dear President Scheibel and Council Members:
On January 5, 1989, the Council laid over the final adoption of a ordinance
rezoning the property of Mrs. Fredricksen from RM-2 to B-2C to allow the Board
of Zoning Appeals time to consider the waiver request of Mrs. Fredricksen and
her son Matthew for a home occupation. The BZA approved th�.t request on
January 24, 1989.
Subsequently, it is no longer necessary to rezone the property and the
Fredricksens have sent a letter requesting to withdraw the rezoning petition.
Therefore, the Planning Division recommends that the City Council vote to
withdraw the ordinance which is scheduled for final adoption by the Council on
March 'S�, 1989.

WHERFAS� Emily A. Fredrickson, file #10361, has petitioned to rezone 2029 Grand
Avenue situated on the north side between Prior and Cleveland from RH-2 to B2-C for
the purpose of establishing an antique shop in a portion of the first floor of the
existing residence; and
WHERFAS, the Zoning Committee of the Planning Co�ission on September 15, 1988, held
a public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance with the requireaents of Sectfon b4.400
of the Saint Paul Legislative Code; and
WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:
1. The applicant wishes to establish an antique shop in a portion of the first .

floor of her existing residence. The 300 square foot shop would be operated" by
the applicant and she would continue to live in the sest of the house.
2. The pxoperty in question is zoned RM-2 and this district does not permit retail
uses such as an antique shop. The applicant is petitioning to have the property
rezoned to B-2C� a district which permits such uses.
3. Section 60.571 states that "It is the intent of the B-2C Community Business
(Com�erted) District to create a business district eapressly for existing
residential structures in commercial areas, which will permit the operation of
businesses which do not generate large amounts of traffic and at the same time
will retain the visual character of the building forus and open space associated
With residential uses."
4. idhen euisting buildings are converted from residential to business uses, off-
street parking sust be provided as specified in Section 60.537. This proposal
requires two spaces which can be provided the rear yard.
5. Access to the parking lot would be off the alley. In general, the city's
traffic engineer strongly discourages parking off an alley used prinarily by
r�sidences. In situations where �oint use of an alley has long been
established, approval might be given however.

In this situation. the applicant's parcel is in the niddle of the block. Even
if parking is provided off the alley, customers are likely to park along Grand
Avenue and this will further contribute to the existing parking and traffic
congestion problem in this area of the Avenue.
6. The city's comprehensive plan states as policy 4.2-2 that "the city will
encourage the development of compatible mixed uses along existing commercial
strips by developing specific land use plans. . .and by modifying current land use
regulatory provisions to permit appropriate flexibility in the reuse of land and
structures.
7. The general land use goal of the Grand Avenue Design 4�idelines is that "Grand
Avenue West should be maintained and improved as a viable mixed use
commercial/residential street with special character.•
8. The surrounding neighborhood along Grand Avenue is a mixture of inedium to high
densitq residential uses. This parcel is located five lots from the commercial
cluster at the corner Grand and Cleveland. The closest B-2C zoning district is
approximately one and one-half blocks to the east. Because of the predominantly
residential character of the neighborhood, intensification at this location
would be detrimental to the adjacent properties.
9. In summary� a mixed commercial/residential use with a low volume retail store on
the subject parcel is incompatible with the existing land uses of the area and
is inconsistent with the intent of the zoning code and the adopted policies of
the city.
NOW, THBREFORE� BE IT RESOLVED, by the Saint Paul Pla�ming Co�ission that the
petition of Emily A. Fredricicson to rezone property at 2029 Grand Avernie, more
particularly described as Lot 32, Block 2, Rose Dale Park, from a RM-2 zoning
classification to a B2-C zoning classification is incompatible with the surrounding
land uses, it is inappropriate to intensify the use at this location because of
existing parking and traffic problems in the area, and is inconsistent with the
Comprehensive Plan for the City; and

Dear President Scheibel and Council Members:
A proposed ordinance approving the petition by Mrs. Emily Fredricksen at 2029
Grand Avenue to rezone her property from RM-2 to B-2C just crossed my desk. I
believe that this rezoning would be a serious mistake for Grand Avenue West and
I intend to veto it.
It is my understanding that one of the main reasons the Council has voted to
approve this rezoning is because Mrs. Fredricksen operated an antique shop from
this house some 15 years ago. Good zoning decisions, however, should be based
on whether the proposed land use is appropriate to the area and in conformance
with the adopted policies of the city. Specifically, my decision to veto this
action is based on the following reasons:
1. Long-Ran�e Land Use Impact: After the Antiaue Shop.
Mrs. Fredricksen's house is in the middle of a long block that is
solidly residential. While the proposed antique shop would
probably attract only a moderate number of customers, the property
could easily be sold in the future for a more intensive retail use
that will exacerbate the existing parking and traffic problems in
the area. Apart from restaurants, which are not permitted in B-2C,
almost any business found in the Mac Market area could move into
this location to meet an ever growing demand on the part of St.
Thomas students.
2. Violates the Intent of the B-2C Zoning District.
The intent of the B-2C zoning district is to allow existing
residential structures that are located in commercial areas to be
used for commercial purposes. 2029 Grand Avenue is not a
commercial area. It is half a block away from the commercial
cluster at the intersection of Cleveland and Grand and is
surrounded on all four sides by residential uses.

3. Conflicts with the Policies and Guidelines for Grand Avenue and the
City•
In 1982, this parcel along with five other parcels on the north
side of Grand and east of Cleveland were rezoned from B-2 to RM-2
as a result of the Grand Avenue West study. At that time all of
the structures were being used for residential purposes and the
study concluded that this area was not an appropriate location for
commercial expansion. The 1987 report of the Planning Commission,
Saint Paul Tomorrow, reaffirmed the need to preserve the city's
single family housing stock and identified as a primary concern the
need to find the sensitive balance between commercial expansion and
the stability of the residential areas. This rezoning sets a
precedent contrary to adopted city policy without any evidence that
a change in policy is appropriate.
4. May Encourage Additional Commercial Expansion.
Allowing commercial intensification may have a negative impact on
the value of the adjacent residential properties and already has
encouraged another property owner on this block to seek rezoning
from residential to commercial. The owner of a large house at 2047
Grand (four doors to the west) was cited by the Zoning
Administrator for operating an illegal contractor's office in a
residential zoning district and he is now trying to get signatures
on a petition to rezone to B-2C.

� 5. Amnle Supplv of Commercial Space Elsewhere.
The city has an ample supply of commercial space elsewhere,
including Marshall and Cleveland. To allow the city's limited
housing stock to be converted to commercial uses when there is
vacant and low-cost commercial space in appropriately zoned areas
is not an efficient utilization of the community's resources.
6. Neighborhood's Concerns About St. Thomas' Expansion To The West.
The College of St. Thomas's expansion plans have been a
long-standing neighborhood concern and the college's current
acquisition efforts along the Grand Avenue west of Cleveland is
likely to increase the pressure to intensify the residential uses
and to expand the commercial uses east of Cleveland. This rezoning
sends an inproper signal to the property owners that it is
appropriate to intensify use east of Cleveland.

Zoning is an important regulatory tool for preserving and enhancing our
neighborhoods. In Mrs. Fredricksen's case, I am afraid that the Council has
been swayed by the appeal of the particular proposed use as a high quality
antique shop and has lost sight of the probable long-run effect on the
neighborhood.

Dear Sir:
On September 16, 1988, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner's representative testified.
At the close of the public hearing, the Committee voted 5 to 2 to deny the
rezoning based on the findings that it is incompatible with the existing land
uses, inappropriate to intensify the use at this location because of the
existing traffic and parking problems, and it is inconsistent with the
Comprehensive Plan.
On September 23, 1988, the Planning Commission upheld the Zoning Committee's
recommendation for denial on a vote of 11 to 6.

At the hearing, the Committee discussed the policy direction of the Planning
Commission's Grand Avenue Task Force and concluded that rezoning to commercial
at this location would be inconsistent with the Task Force's findings. The
initial zoning staff recommendation for approval was made without knowledge of
the policies currently being developed for land use along Grand Avenue. With
this information the Planning Division supports the Planning Commission
recommendation for denial.
Mrs. Fredricksen's house is in the middle of a long block that is solidly
residential. While Mrs. Fredricksen's antique shop would probably attract only
a moderate number of customers, the property could easily be sold in the future
for much more intense retail use based on the market demand of the large
college population in the immediate area.
This rezoning is scheduled to be heard by the City Council on October 18, 1988.
Please notify me by October 17, if any member of the City Council wishes to
have slides of the site presented at the public hearing.

Avenue situated on the north side between Prior and Cleveland fron RIi-2 to B2-C for
the purpose of establishing an antique shop in a portion of the first floor of the
existing residence; and
WHEREAS� the Zoning Committee of the Planning Cou�ission on Septenber 15, 1988, held
a public hearing at which all persons present were given an opportunity to be heard
pursuant to said application in accordance vith the requirenents of Section 64.400
of the Saint Paul I.egislative Code; and
_ WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:
1. The applicant wishes to establish an antique shop in a portion of the first
floor of her existing residence. The 300 square foot shop would be operated by
the applicant and she would continue to live in the sest of the house.
2. The property in question is zoned RM-2 and this district does not permit retail
us�s such as an antique shop. The applicant is petitioning to have the property
rezoned to B-2C, a district which permits such uses.
3. Section 60.571 states that "It is the intent of the B-2C Comaunity Business
(Converted) District to create a business district espressly for existing
residential structures in co�ercial areas, vhich Nill permit the operation of
_ businesses vhich do not generate large amounts of traffic and at the saae time
will retain the visual character of the building forss and open space associated
Nith residential uses."
4. tihen existing buildings are com�erted froa residential to busin�ess uses, off-
street parting aust be provided as specified in Section 60.537. This proposal
requires two spaces which can be provided the rear yard.
5. Access to the parking lot would be off the alley. In general, the city's
traffic engineer strongly discourages parking off an alley used priaarily by
residences. In situations where �oint use of an alley has long been
established, approval night be given however. .

In this situation� the applicant's parcel is in the niddle of the block. Even
if parking is provided off the alley, customers are likely to park along Grand
Avenue and this will further contribute to the existing parking and traffic
congestion problem in this area of the Avenue.
6. The city's comprehensive plan states as policy 4.2-2 that "the city will
encourage the development of compatible mixed uses along existing co�ercial
strips by developing specific land use plans. . .and by modifying current land use
regulatory provisions to permit appropriate flexibilitq in the reuse of land and
structures.
7. The general land use goal of the Grand Avenue Design G�idelines is that "Grand
Avenue West should be maintained and iaproved as a viable mixed use
commercial/residential street with special character."
8. The surrounding neighborhood along Grand Avenue is a nixture of inedium to high
density residential uses. This parcel is located five lots from the commercial
cluster at the corner Grand and Cleveland. The closest B-2C zoning district is
approximately one and one-half blocks to the east. Because of the predominantly
residential character of the neighborhood, intensification at this location
would be detrimental to the adjacent properties.
9. In summary, a mixed com�ercial/residential use with a low volume retail store on
the subject parcel is incompatible aith the existing land uses of the area and
is inconsistent with the intent of the zoning code and the adopted policies of
the city.
NOW, TH�EF'ORE. BE IT BESOLVBD, by the Saint Paul Pla=ming Coanission that the

Emily Fredricksen [#10361) : A Rezoning from RM-2 to B2-C for property located
at 2029. Grand Avenue to establish an antique shop in a portion of the first
floor of the existing residence.
The applicant's representative was present; there was no opposition present at
the hearing.
Ms. Freese showed slides of the site and reviewed the staff report With a
recommendation for approval. She said that the applicant bad operated an
antique shop at 2029 Grand Avenue prior to 1975, that the use vas discontinued
prior to city-wide rezoning� and that the Ms. Fredricksen vants to
re-establish the antique business in her home.
Matthew Vincent Fredricksen, Route 2, Box 41, Isanti, Miimesota� represenLing
the applicant, said that he is Emily Fredricksen's son, that the family
purchased the Victorian house in 1967, and that his mother aanaged Enily's
Antiques until 1974 when she had to close the business due to her health
problems. Mr. Fredricicsen stated that he is an antique dealer in Isanti,
Miimesota, and would be operating the shop with his aother's asaistance.
Items sold in the shop would be turn-of-the-century antiques, at least 1920 or
older, and that it �rould be a low-traffic busi�ss. He said tbat he attended
a District Council 14 meeting, that they are in support of the rezoning. Mr.
FYedxicksen dascribed positive past experiences Nith the usa naighbore,
businesses and schools.
lis. Zieman asked for aore details on the earlier history of the antique shop.
lir. Fredricksen replied that his aother ran the business fron 1967 until 1974
when the business was closed due to Ms. Fredricksen's health as well as for
needed renovation and refurbishing of the house. When questioned about the
future of the business should anything happen to his mother, I4r. Fredricksen
replied that he would like to buy the house, but might encounter so�e
opposition from faaily members. Ms. Lane outlined city requireaents for
handicapped entrances and for the need to comply with the Grand Avenue Sign
Ordinance.
Mr. Christenson questioned Mr. Fredricksen about the floor plan of the house.
Mr. Fredricksen stated that the home has been kept, with a few reaodeling
exceptions, as a Victorian structure, that the comoercial portion of the house
is on the first floor� and that there are bedrooms on the second fZaor. He
said that the remodeling/renovation vas accomplished between 1975 and 1985 and
was contracted by his mother.

Mr. Christanson asked if Emily Fredricksen could presently be actively
im�olved in tha business. Mr. Fredricksen replied affirvatively, and said
that his mother's health problems involve her legs and that she would not be
able to leave the house easily.
Mr. Repke .made a aotion to approve the Rezoning based on staff findings 1
through 8. Mr. Levy seconded the motion. Discussion folloved. Ms. Tracy
stated that she would like to see the entire block re•evaluated. Ms. Zieaaii
said that it may lead to additional requests for intensification in this area
of the avenue. PIr. Christenson stated his opposition to the notion because of
the more intensive use of the site. Ms. Hirte concurred Mith Mr. Christenson.
Mr. Repke said that the small lot was four spaces away from a B-2 district and
that the case should be judged on its merits.
The motion failed on a roll call vote of 2-5 (Tracy, Zieman, Christenson,
Hirte, Morton) .
Mr. Christenson �ade a motion to recommend denial of the Rezoning based on the
findings that it is incompatible with the existing land uses, inappropriate to
inteasify the use at this location because of the existing traffic and
probleas in the area and that it is inconsistent with the Comprehensive Plan.

The District 14 Communit� Council vould like to make �ou aware of
our support for the re-zoning of the home at 2029 Grand Avenue
from Mutliple Family Reeidential to B2C.
Thia home Was re-$one'd by the City Council in 1983 in response to
the recommendations of the Grand Avenue West Plan. While there
had been an antique businesa on part of the first floor of this
home previously� there was no buaineas uae there in 1983. It was
felt that from a planning atandpoint it made sense for this lot
to be zoned the same as four lota ad3acent to it- which had
earlier in 1983 been re-zoned to allow for development of an
spartment building. So it was recommended that the property be
re-zoned fron B2 to RM2.
The owner of the home novr wants to reaume her antique business
but cannot becauae of the 1983 actiori. �le support that the
propert� be re-soned back to busineas but to B2C rather than B2.
We believe that the low inteneity of a BZC busineas in this
location aill not present a threat to tkat neighborhood .
Further , the neighbora have no problem with a low inteneit�
buainesa beiag located on this block. They, in fact, believe
that a B2C busineas rould have less impact on the neighborhood in
terms of traffic and parking than vould a Multiple Fa.ily zoning.
