Abstract Property. WfiEREAS, based upon the records in the Ramsey County Recorder's Office on June 15, 1988 the following persons are owners, interested parties or responsible parties of the Subject Property. The fee owners are James A. Logan, Sr., 1331 Dayton Avenue, St. Paul, NIl�T 55104 and Lora Etta Logan, 1331 Dayton Avenue, St. Paul, N1�1 55104; Richard J. Schoen, 1393 Mechanic Avenue, St. Paul, NII�t 55106 is also a possible fee holder. There are no judgn�ents or liens of record against these parties; and Wf�REAS, the Division of Public Health has issued orders identified as an "Abandoned Building Notice" dated August 17, 1988 which is attached and incorporated as part of this Resolution by this reference. This order was served on all owners, interested parties and responsible parties of the Subject Property ]mown to the enforcement officer. The August 17, 1988 order also had attached to it a list of deficiencies regarding the building on the Subject Property, said list is attached and incorporated as part of this resolution; and WEIEREAS, the August 17, 1988 order informed all owners, interested parties and responsible parties that they m�zst either repair the structure on the Subject Property by correcting the list of deficiencies or demolish the building, either action to take place by Sep�tember 7, 1988. WFIEREAS, no action has been taken regarding co�liance with the August 17, 1988 notice and order, and as a result the Division of Public Health requested that a public hearing be scheduled to take place on Tuesday, Nov�nber 29, 1988 for the City Council to consider the advisability and necessity of ordering the correction of the nuisance condition or in the alternative consider the d�nolition and removal of this structure; and WEiEREAS, the above referenced owners, interested parties and responsible parties have been personally served notice of the time and purpose of the November 29, 1988 hearing before the Council; WEIEREAS, a hearing was held before the Saint Paul City Council on Noveinber 29, 1988 and all testimony and evidence was considered by the Council. 1Wi(n1, THEREFORE, BE IT RESOLVED that based upon all of the testimony and evidence presented at the November 29, 1988 hearing the Saint Paul City Council hereby adopts the following Findings and Order concerning the structures at 790 Selby Avenue: 1. That in June, 1984 the house located on the Subject Property was determined to be unoccupied. The house has remained unoccupied since June, 1984. 2. That since June, 1984 the City of Saint Paul has on rnm�erous occasions issued orders to the owners to make this structure secure and not accessable. On many occasions, because of the inaction on the part of the owners, the City has had to hire a private contractor to make the building secure and not open to access. 3. That the owners of the Subject Property have repeatedly failed to register and pay the vacant building fee for this structure as required by City ordinance. 4. That there are now and have been since June, 1984, multiple exterior Housing Code or Bizilding Code violations in existance at the Subject Property. 5. That the owners, interested parties and responsible parties of this structure are as previously stated in this resolution. These individuals have been properly served notice of the November 29, 1988 hearing concerning this structure. r���� � l�� a � � �g-1 g��o 6. That the owners, interested parties or responsible parties have been ordered to repair this structure and have failed to do so. 7. That on August 17, 1988 an Abandoned Building Notice was sent to the owners, interested parties and responsible parties ordering these persons within thirty (30) days from the date of the Notice to either deqnolish the building or make repairs and correct the list of deficiencies. 8. That the order of August 17, 1988 has been disregarded by the owners, interested parties and responsible parties. 9. That the two and one-half story wood frame, fire damaged single family house located on the Subject Property is an abandoned building under Section 45.01, Subd. 1, of the Saint Paul Legislative Code in that it is a building or portion thereof which has stood unoccupied for longer than one (1) year" and during that period of time has been either "unsecured" or "boarded" or has had "multiple exterior Housing Code or Building Code violations". 10. That the two and one-half story wood frame single family house located on the Subject Property is a nuisance as defined under Saint Paul Legislative Code Section 45.02, Subd. 11, in that it is an abandoned building located in the City of Saint Paul that has created a dangerous or unhealthy condition or which threatens the public peace, health, safety or sanitary condition of the City or which is offensive or has a blighting influence on the comnunity. 11. That the costs of abatement of these nuisances are estimated to exceed two thousand dollars ($2,000.00) or the abatement involves demolition of a building other than a structure accessory to a residential building. ORDER The Saint Paul City Council hereby makes the following order: 1. The above referenced owners, interested parties and responsible parties and their assigns shall make the Subject Property safe and not detri.mental to the public peace, health, safety, and welfare and remove its blighting influence on the community by rehabilitating this building and correcting those deficiencies set forth in the list previously referenced in accordance with all applicable codes and ordinances, or in the alternative by demolishing the building and filling the site in accordance with all applicable codes and ordinances. The rehabilitation or demolition of this building must be completed within -f38a days of the date of mailing of this resolution. ��� �qo, � 2.
