An ordinance amending Chapter 60 of the Saint Paul Legislative Code
pertaining to zoning for the City of Sai,nt Paul and the zoning maps
thereof.
WHEREAS, Pursuant to Minnesota Statutes, § 462.357 and § 64.400 of the
Legislative Code, DeZurik Builders duly petitioned to rezone 473-483 Carroll
Avenue located on the north side between Arundel and Mackubin from RM-3 to
RT-2 for the purpose of constructing three single family dwellings, the
petition having been certified by the Planning Division on August 15, 1988, as
having been consented to by at least two-thirds of the owners of the area of
the property to be rezoned, and further having been consented to by at least
67% of the owners of the property situated within 100 feet of the total
contiguous property within one year preceding the date of the petition; and
WHEREAS, The Zoning Committee on September 29, 1988, conducted a public
hearing for the purpose of considering the rezoning petition, and pursuant to
Section 107.03 of the Administrative Code, submitted its recommendation to the
Planning Commission that the petition be granted; and
WHEREAS, The Planning Commission considered the rezoning petition at its
meeting held on October 7, 1988, and recommended that the City Council approve
the petition; and
WHEREAS, Notice of a public hearing before the City Council on the said
rezoning petition was duly published in the official newspaper of the City on
October 29, 1988, and notices were duly mailed to each owner of affected
property and property situated wholly or partly within 350 feet of the
property sought to be rezoned; and

WHEREAS, A public hearing before the City Council , having been conducted on
November 3, 1988, where all interested persons were heard, and the Council
having considered all the facts and recommendations concerning the petition;
now, therefore,
THE COUNCIL OF THE CITY OF SAINT PAUL DOES ORDAIN:
Section 1.
That the zoning map of the City of Saint Paul , Sheet No. 20, as
incorporated by reference in Section 60.301 of the Saint Paul
Legislative Code, as amended, is hereby further amended as follows:
That property located at 473-483 Carroll Avenue, being more particularly
described as Except part in McKinley Row Townhouses Phase One, the south
116' of Lots 20, 21, 22, Block 17, Mackubin and Marshall 's Addition to
St. Paul , be and is hereby rezoned from RM-3 to RT-2.
Section 2.
This ordinance shall take effect and be in force thirty (30) days from
and after its passage, approval and publication.

B. SUFFICIENCY: The petition was declared sufficient by the Planning Division on
August 15, 1988; 13 parcels eligible, 9 parcels required, 10 parcels signed.
C. PARCEL SIZE: This 17,156 square foot area is being replatted into 3 lots, each
with 49.3' of frontage on Carroll Avenue� a depth of 116' and a total lot area
of 5,718 square feet.
C. EXISTING LAND USE: The subject area is vacant.
D. SURROUNDING LAND USE:
North: Office, OS-1
East: Commercial, B-2
South: Single Family Residential, RT-2
West: 5-Unit Townhouse development, RM-3; Industrial (Control Data) , I-1
E. ZONING HISTORY: Prior to 1975, this property was zoned "C1" residential.
F. FINDINGS:
1. The applicant plans to replat the subject area into three 5,718 square foot lots
in order to construct three detached single family homes. The property is zoned
RM-3, a multiple family district that does not permit single family homes.
Therefore, the applicant is petitioning that the property be rezoned to RT-2.
2. The area to the south is zoned RT-2 and is developed predominately as one and
two family dwellings. The parcel to the immediate west is zoned RM-3, but is
developed as a lower density 5 unit townhouse complex. The lots to the
immediate north and east are zoned for and have been developed as commercial and
office uses.
3. The RM=3 Multiple Family Residential District is designed to provide sites for
high density multiple dwelling structures adjacent to high traffic generators
commonly found in the proximity of major shopping centers and areas abutting
major thoroughfares.
Although the subject area is close to the I-94/Dale interchange, the site is
accessible only via residential stre�ts. As well, the entire site is only
17,156 square feet and would have limited development potential as a high
density residential development.

Dear Sir:
On September 29, 1988, the Zoning Committee of the Planning Commission held a
public hearing on this rezoning. The petitioner testified. At the close of
the public hearing, the Committee voted 4 to 0 to approve the rezoning based on
staff findings.
On October 7, 1988, the Planning Commission upheld the Zoning Committee's
recommendation on a unanimous voice vote.
This rezoning is scheduled to be heard by the City Council on November 3, 1988.
Concurrently, the Council will also consider approval of a final plat for this
property. Please notify me by November 2, 1988 if any member of the City
Council wishes to have slides of the site presented at the public hearing.

WHEREAS, Saint Paul Planning Commission, based on the evidence presented to its
Zoning Committee at the public hearing as substantially reflected in the minutes,
made the following findings of fact:

4. The Comprehensive Plan states that "the compatibility of new housing structures
with the areas surrounding them is the key to maintaining neighborhood
stability." The ad�acent residential uses are lower density residential and
rezoning the area in question conforms with this key objective. The St. Yaul
Tomorrow report findings reaffirm the need to preserve the character of the
single family neighborhoods.
S. In conclusion� rezoning the the subject area to RT-2 would be compatible with
the surrounding land uses and is consistent with the policies of the city.
NOW, THEREFORE, BE IT RESOLVED� by the Saint Paul Planning Commission that the
petition of DeZurik Builders to rezone property at approximately 473-483 Carroll
Avenue more particularly described as Except park in McKinley Row Townhouses Phase
One, the south 116.0 feet of Lots 20, 21 and 22, and that part of the South 116.0
feet of Lot 19 which lies East of a line described as follows: Beginning at a point
on the south line of said Lot 19 distan� 132.12 feet East, measured along the south
line of said lots from the southwest corner of Lot 6� Block 1, McKinley Row
Townhouses Phase One; thence running North at right angles to said south line of Lot
19 to the north line of the South 116.0 feet of said Lot 19, and there terminating
all in Block 17, Mackubin and Marshall's Addition to St. Paul, Ramsey County,
Minnesota, from a RM-3 zoning classification to a RT-2 zoning classification is
consistent with the surrounding land uses and is in conformance with the
Comgrehensive Plan for the City; and
BE IT FURTHER RESOLVED� that the Saint Paul Planning Commission does hereby
recommend to the Council of the City of Saint Paul that property located at
approximately 473-483 Carroll Avenue be rezoned from RM-3 to RT-2 in accordance with

Dear Chairperson Morton:
As you are aware, the Summit-University Planning Council , at its
September 27 , 1988 IIoard meeting received the request by PED and
Ted DeZurili to rezone from R�f-3 to RT-2 located on Carroll
between Arundel and Mackubin .
The iss>>e �;<�s first discussed at our Community Issues meeting on
H'ednesdaS-, September 21st . Residents present at the meeting
'st.ated thet- could support the rezoning for two single family
homes, but not for three. Their reasons included the fact that
their or.�n lots c:ere ninet.y ( 90 feet ) wide and that they had been
ass�ared ';�- the ci tSr when they bought their homes that townhouses
or houses of like size would be built on these sites . The
cummunity forwarded the rezoning issue to the full Board without
rerommendation.
The full B��ard discussed the issue at great length at its
September 27t:h meeting. The Board had discussed the property two
months pre�•iousl;, r.ind had recommended the developer explore the
idea of single family homes, as he said the townhouse market was
soft and he did not want to build the townhouses. After mueh
discussion the motion was made and seconded to "Readvertise the
sites for t��o single f�mily homes, " the motion failed, 5 yes, 7
no and 4 abstentions . Another motion was introduced that stated
"Move to support the developers proposal for this site, " the
motion failed, 5 yes , 6 no and 5 abstentions.
:�s you can see, the 13oard was divided on the issue of rezoning
this prop�srt�• for three single family homes. Most present, both
residents and Board members would agree to the rezoning for two
single family homes but not three . The developer stated he could
not build two homes on this site.
