(as described in "Proceedings of the Carrtqn Council" page 220,

house located on the subject property is an abandoned 17uilding pursuant to
Section 45.01, Subd. 1 of the St. Paul Legislative Code; the dilapidated
and deteriorated detactred garage located on the Subject Property is a
dangerous stru�cture pursuant to Section 45.01, S�abd. 3 of the St. Paul
Legislative Code; and both bui.ldirx�s are nuisances pursuant to Sections
45.02, S�.ibd. 10 ancl S'�bd. 11 of the St. Paul Legislative Code. The August
4, 1988 order al�o had attached to it a list of deficiencies regarding the
structures on the Subject Property, said list is attached ar�cl incorporated
as part of this resolution; and
WE�tF,AS, the Sept�..ember 9, 1988 order informed all awners, interested
parties and responsible parties that they must either repair the
structures on the Subject Prca�erty by correcting the list of deficiencies
or demolish tl� l�uildings, either action to take place by September 30,
1988.
Wf�tEAS, no action has been taken regarding cor�liance with the
September 9, 1988 notice and order, and as a result the Division of Public
Health requested that a public hearing be scheduled to take place on
Tuesday, Novem�er 22, 1988 for the City Council to consider the
advisability and necessity of ordering the correction of the nuisance
condition or in the alternative consider the demolition and r�aval of
these structures; and
WH�tEAS, the above referenced awners, interested parties and
responsible parties have been personally served notice of the tim�e and
purpose of the Nove�er 22, 1988 hearing before the Council;
�EAS, a hearing was held before the Saint Paul City Council on
November 22, 1988 and all testimony and evidence was considered b�y the
Council.
NaW, TEffiZEEC�tE, BE IT RESOLVED that based �on all of the testimony
and evidence presented at the Nov�nber 22, 1988 hearing, the Saint Paul
City Council l�ereby ado�ts the follawing Firidings and Order concerning the
stnaatures at 725 Stryker Avenue:
1. That in October, 1987 the house located on the Subject Property
was determined to be wlo�ied. The hoaase has remained unoccupied since
October, 1987.
2. That since October, 1987 the City of Saint Paul has on rum►erous
occasions issued orders to the awners to make these structures secure and
not accessable.
3. That tYie Division of Public Health of the City of Saint Paul
condemried this structure as "Unfit for H�anan Habitation under Chapter 34
of the Saint Paul Legislative Code" in November, 1978. The lniilding is
still subject to this condenulation order.
4. That there are naw and have been sirice October, 1987 multiple
exterior Housing Code or Building Code violations in existance at the
Subject Prc�erty.
5. That the awners, interested parties and responsible parties of
these structures are as previously stated in this resolution. These
individuals have been pronerly served notice of the November 22, 1988
hearing coricerning these stnnvcctures.

6. That the awners, interested parties or responsible parties have
been ordered on nunerous occasions to repair these structures and have
failed to do so.
7. That on September 9, 1988 an P,bandoned Building Notice was sent to
the awners, interested garties and responsible parties ordering these
persons within twenty-one (21) days fro�n the clate of the Notice to either
demolish the buildings or make repairs and correct the list of
deficiencies.
8. That the order of Sept�er 9, 1988 has been disregarded by the
awners, interested parties and responsible parties.
9. That the tw�o-story wood frame single family house located on the
S�abject Property is an abandoned building under Section 45.01, Subd. 1, of
the Saint Paul Legislative Code in that it is "a bui.lding or portion
thereof which has st.00d wvoccupied for longer than one (1) year" and
during that period of time has been either "unsecured" or "boarded" or has
had "multiple exterior Ho�using Code or Building Code violations" or has
been "placarded as "Unfit for Htanan Habitation" pursuant to Chapter 34 of
the St. Paul Legislative Code."
10. That the two-story w�ood frame single family house located on the
Stxbject Property is a nuisance as defined under Saint Paul Legislative
Code Section 45.02, Sti�bd. 11, in that it is an abandoned building located
in the City of Saint Paul that has created a dangerous or unhealthy
condition or which threatens the public peace, health, safety or sanitary
condition of the City or which is offensive or has a blighting influence
on the comYUnity.
11. That the dilapidated and deteriorated detached garage located on
the Subject Property is a danc�rous structure under Section 45.01, Subd. 3
of the St. Paul Legislative Code in that it is "a struature which is
potentially dangerous to persons or property" including being "in danger
of partial or complete collapse."
12. That the dilapidated and deteriorated detached garage located on
the Subject Property is a nuisarice as defined under St. Paul Legislative
Code Section 45.02, S�bd. 10, in that it is a dangerous structure located
in the City of St. Paul that has created a dangerous or unhealthy
condition or which threatens the public peace, health, safety or sanitary
condition of the City or which is offensive or has a blighting influence
on the camnanity.
13. That the costs of abatement of these nuisances are estimated to
exceed tw�o thousand dollars ($2,000.00) or the abatement involves
demolition of a building other than a structure accessory to a residential
building.
ORDER
The Saint Paul City Council hereby makes the follawing order:
1. The above referenced awners, interested parties arxl respc»nsible
parties and their assigns shall make tl� S'�abject Property safe and not
detrimental to the public peace, health, safety, and welfare and resr�ove
its blighting inflwence on the co�xanity by rehabilitating these b�uildings

Dear Sir or Madam:
The Division of Public Health has determined that the above-noted building
is an abandoned building, which Chapter 45 of the Saint Paul Legislative
Code def ines as:
" any building or portion of a building which has stood with an
incom�lete exterior shell for longer than three �3) years or any
bui.lding or portion thereof which has stood un�occupied for longer than
one (1) year and which meets one or more of the follawing criteria;
�a) wlsecured, or (b) boarded, or (c) having multiple exterior
Housing Code or Builcling Code violations, or (d) placarded as "Unfit
for ALmnan i3abitation" pursuant to Chapter 34 of the Saint Paul
Legislative Code."
The ordinance further states that an abandoned building is a nuisance and
it may be ordered torn dawn by the City.
NOTE: If you do not want to have the City begin action to have the
building torn dawn, then the attached list of deficiencies must be
repaired or yaz m�st tear the building do�wn on or before Sep�tember 30,
1988.
Any repair or demolition must be co�leted in accordance with all
applicable laws.
If the w�rk is not ca�leted or if you have not torn the building dawn by
the above date, the Division of Public Health will refer this matter to
the City Council to receive authority to te,ar dawn the building and charge
all costs incurred i.n wrecking the building against the real estate as a

special assessment to be collected in the same manner as taxes. The City
Council will schedule a public hearing to consider if the building should
be torn dawn. If a public hearing becoines necessary, you will be notified

evidence to the City Council. A copy of this order will be kept on file in
the City Clerk's Office and a resolution declaring this property to be a
nuisance shall be on file in the Ramsey County Recorder's Office.
Com�liance with the attached list of deficiencies will remove your
building fran the list of abandoned bui.ldings but it does not mean that
the building com�lies with all applicable housing and building codes.
The date for ccxnpliance with these orders shall r�t be extended unless you
receive written approval fz�► the Division of Public Health.

Failure to comply may necessitate Court action.
All repairs and new installations must be made in accordance with the

service size to present National Electrical Code requirements. Some
plumbing repairs may necessitate updating of the fixtures and/or piping
involved. A permit is required for any repair or new installation.

If you are unable to finance the correction or rehabilitation of the
premises to comply with this order, there are State and local rehabilitation
programs for which you may qualify.
If you feel that the corrections required are unreasonable or will create

of Appeals, except in cases of emergency enforcement pursuant to Chapter

City Council Members
The legal description of the property is: That part of Block B, West St.
Paul, lying Sauth of a line which is 55 feet South of and parallel with
Page Street as opened (as described in "Proceedings of the Coirmon Council"
page 220, approved June 8, 1889, on file at the City Clerk's Office, City
of St. Paul), and the East 1/3 of Lot 1 and North 25 feet of the East 1/3
of Lot 2, Block C, Jackson & Bidwell's Addition to West St. Paul.
Abstract Property.
The buildings are a tw�o story weod frame, single family house and a
dilapidated, deteriorated, detached garage.
The subject property has been unoccupied since November, 1978.
The single family house has st-,00d unoccupied for longer than one year and
meets one or more of the conditions that constitute an abandoned l�ilding
as defined in Chapter 45 of the St. Paul Legislative Code. The detached
garage meets one or more of the conditions that constitute a dangerous
structure as defined in Chapter 45 of the St. Paul Legislative Code.
On Sep�tember 9, 1988 the Division of Public Health mailed an order to the
owners, interested parties and responsible parties of these �.iildings
requiring that the buildings be either repaired, by correcting the
attached list of deficie.ncies, or demolished on or before Septgnber 30,
1988. Inasrc�h as the orders have. not been co�leted to the satisfaction
of the Division and the continued abandoned and dangerous conditions of
the buildings contribute a blighting influence and potential hazard to the
neighborhood, it is the recoccmendation of the Division that the City
Council pass a resolution ordering the owners, interested parties and
responsible parties to either repair or d�lish the b�uildings in a timely
manner to the satisfaction of the City.
In the event the awners, interested parties or responsible parties fail to
com�ly with the Council Resolution, the Division of Public Health should
be authorized to d�nolish the buildings and assess all costs incurred in
the desnolition against the real estate as a s�eci.al assessment to be
collected in the san� manner as taxes.
