served on all awners, interested parties and responsible p�rties of the

S�.ibject Property is a dangeraus structure pursuant to Section 45.01, Subd.
3 of the St. Paul Legislative Code; aryd both buildings are nuisarices
pursuant to Sections 45.02, S'�abd. 10 and Stiibd. 11 of the St. Paul
Legislative Code. The Auc�st 4, 1988 order aleoo had attached to it a list
of d�eficiencies regarding the stnactures on t.he S�.ibject Praperty, said

WF�tEAS, the August 4, 1988 order infonned all awners, interest.ed
parties and responeible parties that they must either rep�air the
strt�ctures on the Subject Property by �rrecting the list of deficiencies
or demolish the huildirigs, either action to t,ak�e place by August 25, 1988.
W[�2EAS, no action has been tak�en regarding com�liance with the August
4, 1988 notice and order, and as a result the Division of Public Health
requested that a public heari.ng be echeduled to take place on Tuesday,
Nove�er 22, 1988 for the City Council to consiciex the advisability arid
necessity of ord�ering the c7orrection of the mxisance condition or in the
alternative consi�r the danolition and removal of tl�ese stru�ctures; and
WE�2EA.S, the abo�ve referer�ced awners, interested parties aryd
responsible parties have been personally served notice of the time and
purpose of the November 22, 1988 hearing before the Council;
Wf�2EA.S, a hearing was held before the Saint Paul City Co�il on
Navember 22. 1988 and all testi.mony and evidenc� was considered by the
Council.
1VaV, TEgREE�OlZE, BE IT RE90LVE� that based upon all of the testimony
ar�cl evidence presented at the Nove�nber 22, 1988 hearing, the Saint Paul
City C'auncil hereby adopts the follawing Findings an�l Order concerning the
structures at 851 Marion Street:
1. That in November, 1986, the house located on the Subject Pro�erty
was determir�ed to be vacant and cypen to access. T'he house has remairied
vacant and has been either c�pen or boarded since Nove�er, 1986.
2. That sirice Nove=ober, 1986, the City of Saint Paul has on rnanerous
ocr.asions isstxed orders to the awrtiers to make these strwctures secure and
not accessable. On many oocasions, because of the inaction on the part of
the avrlers, the City has had to hire a private contractor to mak�e the
buildings secure and not open to access.
3. T'hat the awners of the S�abject Prc�erty have repeatedly failed to
register and p�y the vacant building fee for this pro�erty as required by
City Ordinance.
4. That the Division of Public Health D�partment of the City of Saint
Paul cond� this structure as "Dnfit for Hunan H�abitation under Chapter
34 of the Saint Paul Legislative C7ode" in November, 1986. The building is
still subject to this aond�mation order.
5. That there are naw arid have been since NovemUer, 1986, multiple
exterior Housing Code or Building Oode violations in existance at tYre
Stabject Property.
6. That the awners, interested parties and responsible parties of
theee stn�ctures are as previously stated in this resolution. T�se
;nrl;viduals have been prq�erly served notice of the November 22, 1988
hearing concerning these structures.
7. 7'h�at the awners, interested parties or responsible parties have
been ordered on rnanerous occasions to repair these stria�ctures and have
failed to do so.

8. That on August 4, 1988 an Abandoned Building Notice was sent to
the awners, interested parties and responsible parties ordering these
persons within twenty-one (21) days from the date of the Notice to either
demolish the buildings or make repairs and correct the list of
�1C7.@11C1�.
9. T'hat the order of August 4, 1988 has been disregarded by the
awners, interested parties and responsible parties.
10. That the two-story �aood frame fire damaged single family house
located on the S�bject Property is an abandoned building under Section
45.01, Subd. 1, of the Saint Paul Legislative Code in that it is "a
building or portion thereof which has stood unoccupied for longer than one
(1) year" and during that period of time has been either "unsecured" or
"boarded" or has had "mzltiple exterior Hausing Code or Buildirig t7ode
violations".
11. That the twe-story w�ood frame fire damaged si.ngle family house
located on the Subj�ct Property is a nuisance as defined under Saint Paul
Legislative Code Section 45.02, S�bd. 11, in that it is an ab�andoned
lxzilding located in t�he City of Saint Paul that has cr�ted a dangerous or
unhealthy condition or which threatens the public peace, health, safety or
sanitary condition of the City or which is offensive or has a blighting
inf li�ence on the car�nanity.
12. That the dilapidated, deteriorat.ed, and stnaaturally unsound shed
located on tl� Subject Prol�erty is a dangeraas structure urider Section
45.01, Subd. 3 of the St. Paul Legislative Code in that it is "a structure
whicY► is p�tentially dangeraus to persons or prc�aerty" including being "in
danger of partial or oan�lete collapse."
13. That the dilapidated, deteriorated, and structurally unsound shed
located on the S�bj�ct Praperty is a nuisance as defiried under St. Paul
Legislative Code Section 45.02, Subd. 10, in that it is a dangerous
stn�cture located in the City of St. Paul that has created a dangerous or
unhealthy condition or which threatens the public peace, health, safety or
sanitary condition of the City or which is offensive or has a blighting
influet�ce on the camunity.
14. That tY�e oosts of abatement of these nuisances are estimated to
exceed tw�o tl�usarxl dol lars ($2,000.00) or the abatgnent involves
denalition of a building other than a structure accessory to a residential

1. The abave referenced o�wr�ers, interested parties and responsible
parties and their asgigns shall make the Subject Property safe and not
detrimental to the public peace, health, safety, and welfare and remove
its blighting inflwence on the co�muiity by rehabilitati.ng these buildings
arid correcting those deficiencies set forth in the list previo�usly
referenced in acvordance with all applicable codes and ordinances, or in
the alternative by denalishing the buildings and filling the site in
accordance with all applicable codes and ordinances. The rehabilitation
or de�nolition of these buildings m�ast be c�ompleted within-t�rirty-t-39�i-�ays�

. The Division of Public Health has determined that the above-noted building
is an abandoned building,. which Chapter 45 of the Sai�t Paul Legis;lative
Code defines as:
" any building or portion of a building which has ��.00d with ar►
incom�lete exterior shell for longer than three (3) years or ��t���
building or portion thereof which has st.00d unocc�spied for lc�tiger than
one (1) year and which meets one or more of the following crileria;
(a) unsecured, or (b) boarded, or (c) having rrul�tiple extera��i
Housing Code violations, or (d) placarded as "Unfit for Hwnan
Habitation" pursuant to Chapter 34 of the Saint Faul Legislat�ve
Code.��
The ordinance further states that an abandoned building is a nuist�nce and
it may be ordered torn down by the City.
NOTE: If you do not want to have the City begin actioz to have tl-�f�
building torn dawn, then the attached list of defici�cies rrazst bc�
repaired or you mist tear the building dawn on or before August 2!'i, 1988.
Any repair or demolition ma�st be completed in accord�ce with al]
applicable laws.
If the work is not completed or if you have not torn the building dok*n by
the above date, the Division of Public Health ki11 refer this matler to
the City Council to receive authority to raze the building and chtarge all
costs incurred in wrecking the building against the real estate a�; a
special assessment to be collected in the same manner as taxes. Tlie City
Council will schedule a public hearing to consider if the buildinc� should
be torn down. If a public hearing becomes necessary, you will be riotified
of the time and date of the hearing and you will be alloti,ed to pr�>sent

the City Clerk's Office and a resolution declaring this property to be a
nuisance shall be on file in the Ramsey County Recorder's Office.

building from the list of abandoned buildings but it does not mean that
the building complies with all applicable housing and building codes.
The date for com�liance with these orders shall not be extended unless you
receive written approval from the Division of Public Health.

All repairs and new installations irnist be made in accordance with the
appropriate codes. Pernuts must be obtained where changes and/or
additions to an electrical system require upgrading of the service size to
current National Electrical Code (N.E.C.) requirements. Some pliunbing
repairs may necessitate updating of the fixtures and/or piping involved.
A pernut is required for any repair or new installation. Permits may be
obtained from the Building Inspection and Design Division, Roo�n 445, City

5. Facia and soffit are unprotected, have peeling paint. Scrape
loose paint, and paint unprotected wood surfaces.
