WI�tEAS, the Division of Public Health has req��ested the City Council
to hold a public tiearing to consider the advisability and riecessity of the
correction or wreckirig and removal of a tw�o-story �aood frame, fire�lan►aged
single family house arid a dilapidated and deteriorated detached garage,
which are located on property hereafter referred to as the "Subject
Prc�erty" co�m�nly lmown as 520 North Kent Street, Saint Paul, Minnesota
and legally described as:
Lot 16, Block 2, except the S�zth 59.8 feet thereof, Micl�ls
Subdivision of Block 14 of Stinson's Division of Section Thirty
six, Tawnship 29, Range 23.
�FAS, based upon the records in the Ramsey County Recorder's Office
on May 12, 1988 the follawing persons are awners, interested parties or
responsible parties of the Subject Property. The owners are Federal
National Mortgage Association, P.O. Box 28459, Los Angeles, CA 90024 as to
fee awner; Sears Nbrtgage Corporation, 300 Knightsbrige Parkway,
Lincolnshire, IL 60069, ATTN: Margaret E. S�nith, possible mortgage holder;
Department of HUD, 220 S. 2nd Street, Minneapolis, NH�T 55401, possible
mortgage holder. There are no judc�ments or liens of record against these
parties; and
WI�tF.AS, the Division of Public Health ha� issued orders identified as
an "Abandoned &.iilding Notice" dated August 24, 1988 which is attached and
irx:orporated as part of this Resolution by this reference. This order was
served on all vwners, interested parties and respc>nsi.ble parties of the
Subject Praperty }mown to the enforcement officer. The notice and order
inforn►ed these parties that the two-story w�ood frame, fire damaged single

family house located on the subject property is an abandoned building
pursuant to Section 45.01, Subd. 1 of the St. Paul Legislative Code; the
dilapiclated and deteriorated detached garage located on the Subject
Property is a dangerous structure pursuant to Section 45.01, Stiibd. 3 of
the St. Paul Legislative Code; and both b�iildings are nuisances pursuant
to Sections 45.02, Subd. 10 and Subd. 11 of the St. Paul Legislative
Code. The August 24, 1988 order also had attached to it a list of
deficiencies regarding the buildings on the Subject Property, said list is
attached and incorporat.ed as part of this resolution; and
WHERF.AS, the August 24, 1988 order inforn►ed all owners, interested
parties and respc»nsible parties that they mz.°ct either repair the
structures on the Subject Property by correcting the list of deficiencies
or d�trolish the buildings, either action to take place by September 13,
1988.
Wf�REAS, no action has been taken regarding c�liance with the August
24, 1988 notice and order, and as a result the Division of Public Health
requested that a public hearing be scheduled to take place on Tuesday,
Nov�nber 22, 1988 for the City Council to consider the advisability and
necessity of ordering the correction of the nuisance condition or in the
alternative consider the desnolition and re�noval of these structures; and
Wf�REAS, the above referenced owners, interested parties and
responsible parties have been personally served notice of the time and
purpose of the Noveinber 22, 1988 hearing before the Council;
Wf�2EAS, a hearing was held before the Saint Paul City Council on
November 22, 1988 and all testimony and evidence was considered by the
Council.
1�W, THII�EFORE, BE IT RESOLVID that based �on all of the testimony
and evidence presented at the Nov�nber 22, 1988 hearing, the Saint Paul
City Council hereby adopts the follawing Firulings and Order concerning the
stru�ctures at 520 N. Kent Street:
1. That in August, 1987 the house located on the Subject Property was
determined to be unocc�ied. The house has remained unoccupied since
August, 1987.
2. That since August, 1987 the City of Saint Paul has on nimnerous
occasions issued orders to the owners to make these structures secure and
not accessable. On many occasions, because of the inaction on the part of
the owners, the City has had to hire a private contractor to make the
buildings secure and not open to access.
3. That the awners of the S�abject Property have repeatedly failed to
register and pay the vacant b�ilding fee for these structures as required
by City ordinance.
4. That there are naw and have been since August, 1987 m�ltiple
exterior Housing Code or Building Code violations in existance at the
Subject Property.
5. That the owners, interested parties and responsible parties of
these structures are as previously stated in this resolution. These
individuals have been properly served notice of the November 22, 1988
hearing concerning these structures.

6. That the o�mers, interested parties or responsible parties have
been ordered to repair these structures and have failed to do so.
7. That on August 24, 1988 an Abandoned Building Notice was sent to
the awners, interested parties and responsible parties ordering these
persons within twentyrone t21) days frotn the date of the Notice to either
de�lish the buildings or make regairs and correct the list of
deficiencies.
8. That the order of August 24, 1988 has been disregarded by the
awners, interested parties and responsible parties.
9. That the tw�o-story vaood frame, fire damaged single family house
located on the Stiibject Property is an abandoned lniilding under Section
45.01, Subd. 1, of the Saint Paul Legislative Code in that it is "a
building or portion thereof which has st.00d unoccupied for longer than one
(1) year" and during that period of time has been either "unsecured" or
"boarded" or has had "multiple exterior Housing Code or Building Code
violations" or has been "placarded as "Unfit for H�mian Habitation"
pursuant to Chapter 34 of the St. Paul Legislative Code."
10. That the tw�-story �aood frame, fire clamaged single family house
located on the Subject Property is a nuisarice as defined ur�ler Saint Paul
Legislative Code Section 45.02, Stabd. 11, in that it is an abandoned
bu.ilding located in the City of Saint Paul that has created a dangerous or
unhealthy condition or which threatens the public peace, health, safety or
sanitary condition of the City or which is offensive or has a blighting
influence on the cammanity.
11. That the dilapidated and deteriorated detached garage located on
the Subject Property is a nuisance as defined under St. Paul Legislative
Code Section 45.02, Subd. 10, in that it is an abandoned building located
in the City of St. Paul that has created a dangerous or unhealthy
condition or which threatens the public peace, health, safety or sanitary
condition of the City or which is offensive or has a blighting influence
on the co�r�munity.
12. That the costs of abatement of these nuisarices are estimated to
exceed tw�o thousand dollars ($2,000.00) or the abatement involves
demolition of a building ott�r than a structure accessory to a residential
building.
ORDER
The Saint Paul City Council hereby makes the follawing order:
1. The above referenced awners, interested parties and responsible
parties and their assigns shall make the S�abject Property safe and not
detrimental to the public peace, health, safety, and welfare and remove
its blighting influence on the c�nity by rehabilitating tl�se b�zildings

arid correcting those deficiencies set forth in the list previously
referenced in accordance with all applicable codes and ordinances, or in
the alternative by d�lishing the bu.ildings and filling the site in
accordance with all applicable codes and ordinances. The rehabilitation
or demolition of these buildings m�zst be co�rpleted within thirty (30) clays
of the date of mailing of this resolution.
2. If the above corrective action is not canpleted within the thirty
(30) day time period, the proper City officials of the City of Saint Paul
are hereby authorized to take whatever steps are necessary to demolish
these bniildings and fill the site and charge the costs incurred against
the Stiabject Property p�zrsuant to the provisions of Section 45.08 of the
Saint Paul Legislative Code.
3. In the event the structures are to be demolished by the City of
Saint Paul, all personal property or fi�ctures of any kind which shall
unreasonably interfere with the d�nolition and rernoval shall be rgr�oved
from the structures by the awners, interested parties and respc�nsible
parties by the end of the thirty (30) day time period. If the personal
property is not so rermved, the City of Saint Paul shall remove and
dispose of such property and fixtures as is provided by law.
4. IT IS FClR7.'HIIt ORDIIt� that a certif ied copy of this resolution and
the incorporated order and list of deficiencies be mailed to the last
)mawn address of the awners, interested parties and responsible parties
pursuant to Section 45.11, Subdivision (5) .

The Division of Public Health has determined that the above-noted building
is an abandoned buildi.ng, which Chapter 45 of the Saint Paul Legislative
Code defines as:

NOTE: If you do not want to have the City begi.n action to have the
builcling torn dawn, then the attached list of deficiencies must be
repaired or you m�st tear the building dawn on or before Sep�tgnber 13,
1988.
Any repair or d�nolition must be com�leted in accordance with all

2. Windows are broken, missing screens, and some are fire damaged and
boarded. Repair or replace with unboarded windaws.
3. Eaves are fire damaged and have holes (on all sides of the house.>

5. East side wall has holes in it and is fire damaged. Repair. .
6. Chimney is leaning and has loose bricks and missing mortar.

7. Foundation has cracks on all sides. Regair.
8. No handrail on front steps. Provide legal handrail.
9. Electric meter is broken, disconnected. Repair.
10. Electric conduit on east side is cracked. Repair.
11. No water service. Restore water service.
