•�' 1988 MEMORANDUM OF AGREEMENT
This Memorandum of Agreement is by and between the City of Saint Paul and
the Saint Paul Supervisors Organization. In full settlement. the parties
hereto have agreed as follows: .
1. Except as herein modified the signed 1988-1989 Collective Bargaining
Agreement entered into between the parties on June 17� 1988� shall
remain in effect.
2. Article 17 of said agreement shall be replaced with Article 17 which
is attached hereto and made a part hereof.
� It is understood that the above settlement shall be recommended by the
Labor Relations Manager, but is subject to approval by the City
Administration and adoption of the City Council.
IN WITNESS WHEREOF, the parties hereto have affixed their signatures this

ARTICLE XVII - SEVERANCE PAY
17.1 The employer shall provide a severance pay program as set forth in this
Article.
17.2 To be eligible for the severance pay program� an employee must meet the
following requirements:
17.21 The employee must be 58 years of age or older or must be eligible
for pension under the "rule of 90" or the "rule of 85" provisions
of the Public Employees Retirement Association (PERA) .
17.22 The employee must be voluntarily separated from City employment
or have been subject to separation by lay-off or compulsory
retirement. Those employees who are discharged for cause,
misconduct, inefficiency, incompetency� or any other disciplinary
reason are not eligible for the City severance pay program.
17.23 The employee must have at least ten (10) years of service under
the classified or unclassified Civil Service at the time of
separation.
17.24 The employee must file a waiver of re-employment with the
Personnel Director, which will clearly indicate that by
requesting severance pay, the employee waives all claims to
reinstatement or re-employment (of any type) � with the City or
with Independent School District ATo. 625.
17.25 The employee must have accumulated a minimum of sixty (60)
days of sick leave credits at the time of his separation from
service.
17.3 If an employee requests severance pay and if the employee meets the
eligibility requirements set forth above, he or she will be granted
severance pay in an amount equal to one-half of the daily rate of pay
for the position held by the employee on the date of separation for
each day of accrued sick leave subject to a maximum of 200 accrued
sick leave days.
17.4 The maximum amount of money th�t any employee may obtain through this
severance pay program is $6�500.

17.5 For the purpose of this severance program, a death of an employee shall
be considered as separation of employment, and if the employee would have
met all of the requirements set forth above, at the time of his or her
death, payment of the severance pay may be made to the employee's
estate or spouse.
17.6 For the purpose of this severance program� a transfer from the City
of Saint Paul employment to Independent School District No. 625
employment is not considered a separation of employment� and such
transferee shall not be eligible for the City severance program.
17.7 The manner of payment of such severance pay shall be made in accordance
with the provisions of City Ordinance No. 11490.
17.8 This severance pay program shall be sub3ect to and governed by the pro-
visions of City Ordinance No. 11490 except in those cases where the specific
provisions of this article conflict with said ordinance and in such cases,
the provisions of this article shall control.
17.9 The provisions of this article shall not be effective until December 31,
1982, and until such date, the provisions of Ordinance No. 11490� as amended,
shall apply in their entirety.
17.10 Any employee hired prior to December 31� 1982, may, in any event� and
upon meeting the qualifications of this article or City Ordinance No.
11490, as amended by City Ordinance No. 16303, section 1, section 6,
draw severance pay. However� an election by the employee to draw
severance pay under either this article or the ordinance shall constitute
a bar to receiving severance pay from the other. Any employee hired after
December 31, 1982, shall only be entitled to the benefits of this article
upon meeting the qualifications herein.

17.11 For employees appointed to a title covered by this Agreement on or after
October 29, 1988� the employer shall provide only the severance pay program
as set forth in 17.12 through 17.17.
17.12 To be eligible for the severance pay program, an employee must meet the
following requirements:
17.12.1 The employee must be voluntarily separated from City employment
or have been subject to separation by lay-off or compulsory
retirement. Those employees who are discharged for cause�
misconduct, inefficiency, incompetency� or any other disciplinary

WHEREAS, on March 17, 1988, the Saint Paul City Council approved the
following allocation of Emergency Shelter Grant funds granted to the City by
the U.S. Department of Housing and Urban Development (HUD) (direct entitlement
funds) :

WHEREAS, the State's Emergency Shelter Grant allocation has been
increased providing an increase of $7,814 in Saint Paul's allocation to be
utilized by December 31, 1988; and
WHEREAS, all five recipients could use additional ESG funds for their
programs, amounting to increases of $1,562.00 on each contract;
NOW THEREFORE BE IT RESOLVED, that the City Council of the City of Saint
Paul hereby accepts the additional funds and approves the recommendation for
expenditure of Emergency Shelter Grant funds; and be it
FURTHER RESOLVED, that the City Council authorizes City staff to amend
the contracts to reflect the increase in the grant amount; and be it
FINALLY RESOLVED, that the City Council adopts the following changes to
the 1988 budget:
